Applicant:First National Bank ofVail DESCRIPTION OF VARIANCE This request isto construct a drive-up bank facility at the southeast corner oftheVaildas Schone shopping center.This facility would includea "drive- thru"building and alandscapedarea defining the entry tothe structure.A setback variance is required becausethe proposed location forthe structure abutsthe side property ~ine.The required setbackinthe CCIII zone is 20 feet. CRITERIA AND FINDINGS Upon reviewof Criteria and Findings,Section 18.62.060ofthe Municipal Code, the Department of Community Development recommends denial ofthe requested variance based upon thefollowing factors: Consideration of Factors The relationship ofthe requested variance to other existing or potential uses and structures inthe vicinity. Thisproposalisin conflict withboth existing and proposed usesinthe vicinity. Atthe present timea Town ofVailbikepathfeeds directly into theshopping center's parking lot.As proposed,cars using this facility would circulate directly throughthe point where thebikepath adjoins theparking lot.This would create a serious conflict between vehicular traffic and usersofthe bikepath. Potential usesinthe vicinity include theVail Commons project immediately .tothe east ofVaildas Schone.During annexation,the Town ofVailaccepted ·the County'sapprovaloftheVail Commons development plan.Thisapproval stands aslongasthe development planremains unchanged (if changesareproposed, theplanwillbe resubmitted to PEC).Thisplan calls fora pedestrian walkway and internal vehicular circulation that would run directly into theproposed bank facility.Access toVail Commons underground parking would also be adversely affected by this driveup facility. •1st Nati~Bk -2-5/7/84 The degreeto which relief from the strict or literal interpretation and enforcement of a specified regulation is necessary toachieve compatibility and uniformity. of treatment among sites inthe vicinity orto attain the objectives of this title without grant of special privil ege .. The question hereiswhetherdenying this variance would deny the applicant the right tousehis property.Inlooking at this site,it is evident that the drive-up facility couldbe accommodated in another location that would not require a setback variance.To approve this variance would bea grant of special privilege. The effect ofthe requested variance on light and air,distribution of population, transportation and traffic facilities,public facilities and utilities,and public safety. Transportation and traffic facilities would be impacted by this proposal's conflict with existing circulation patterns.Public safety would also be affected by the location ofthe facility with respect tothe existing bikepath.This proposalhas also been reviewed by the Town ofVailRecreationDepartment, andthey are veryconcernedwith this proposal's impactonthebikepath. REVISED SITE PLAN The revised site plan is aproductof input from the Community Development Department staff,theRecreation Department,the Vail Fire Department,and the applicant.the staff reaction to this latest submittal is favorable in that prior problems withthe site plan have been mitigated toa great extent. The following is a summary ofthe issues that were raised at the May 14th PEC meeting. BIKE PATH The applicant has proposed relocating thebikepath off oftheparking lot to eliminate potential "head-on"confrontations between cars and bikes.This was inresponsetoreview by theRecreation Department.While thebikepath will still bisect a heavily traveled road (access toVaildasSchone),it is no different thanthe many other points where bikepaths cross roadways. Signage will be relocated to warn motorists and bikers ofthe crossing. CIRCULATION WITHIN THE PARKING LOT Staff was oftheopinion that the addition ofthe bank facility added tothe congestion and lackof control intheparking lot.The addition ofa "landscape element"at the east end ofthe two parking rows will define the end of these rows and prevent cars from parkinginthe lot's circulation lane.This was a recommendation ofthe Fire Department (the fourspaces lost will be replaced by thespacesalong side thebike path),The staff would like toseethe lot striped to better define parkingspaces and the applicant hasagreedto work withtheVaildas Schone Condominium Association to work toward this objective. ,0.•1st NalllPnk -2-5/19/84 Issue ofSpecial Privilege The staff initially felt this setback variance would bea grant of special privilege.With the addition ~f a 19 foot wide landscapedareaalongthe east (andsouth)side ofthe property,staff feels the setback is no longer a signifi- cant issue.One main objective of setbacks is toallow for buffers between properties.Thislandscapedarea is a welcome addition to this project in that it essentially creates a buffer between ~djacent properties •.It is also a fine addition fro m an pesthetic point of view.
