I42 VAIL COMMONS Vail, Colorado OWNER: City Market, Inc. 105 West Colorado Ave. Grand Junction, CO. 81502 Introduction: It is the purpose of this sign progrtrm to serve the communication needs of the Ouner while creating an upscale, effective sign program commensurate with the building and , sunounding area. The program addresses the following criteria: l. Identifu the project and its purpose to vehicular and pedestrian traffic. j ' 2. Identifr site. circulation, including traffic and building entrances, parking and tenant locatlons. 3. Restrict other signage that doesn't meet these objectives. A. PURPOSE ! The purpose of this sign program is to serve as a guide for all initial and future exterior . Uuilding identification signage. All signage shall be of superior quality and image and shall be compatible with the architecture and design of the City Market Building. . B. GENERAL l. City Market Building Identification Sign (Sign Type "A") The Owner shall install two three dimensional signs. One shall be located over the Main Entrance to the City Market Slore on the West Elevation. The second sign shall be located on the South Elevation of the Tower located at the Southu'est comer of the City Market Store. See attached drawing prepared by Bud's Signs for details. Signs shall not exceed the maximum allowable 20 s.f. 2. Professional Retail Service Signs (Reference Sheets I of5 thru 5 of5) There shall be individual Professional Retail Service Signs on the Retail Building ,' on the North end of the site consisting of the following requirements: Shall not exceed 20 square feet per Tenant. Shall be illuminated pan channel letters. Letter heights shall be I8". Pan Channel letters shall be 5" deep, .040 aluminum, pre-finished black. Letters shall be 3116" ,2157 Red Acrylic faces. Letters shall have I " Gold Trim Cap. Signs shall be mounted on 10" x 7" (deep) exterior raceway, painted to match building. Signs shall be illuminated with l5mm clear red neon. See sheets one (l) through five (5) for sign locations. (1. f h. l. Box 729 Grand Junction, CO 81502 RE: Sign Program Amendment Dear Mark: At their November 3,1999, the Design Review Board reviewed your proposal for an amendment to the sign program at Crty Market, located at2109 N. Frontage Road West. The following were their comments and concerns: 1. No tenant sign allowed on Frontage Rd.2. Sign locations need to respect the existing architecture ofthe building. 3. The type of sign prcferred was indirectly lit individual letters on a raceway. The lighting shall be the same fixture for each sign.4. The sign sizes are limited to 5 sq. ft. for those with no extcrior access/frontage.5. Forthe retail space with frontage. sign size is limited to 2.5 sq. ft. for each 5 lincal ft. of frontage. This sign shall be the individual pan-chanellcd lcttcrs similar to City Market's existing signs. 6. The Design Review Board was also in favor of the location of thc proposed parking garage sign. should the Planning and Environmental Commission choose to grant the variance request on November 22, 1999. At the applicant's request, the application for the sign variance has been withdrawn. City Market is interested in exploring other opportunities to accentuate the underground parking. After a meeting on site with staff, the applicant agreed with staff that doing some sort of architectural feature above the entry-way to the garage and additional lighting would bring more attention to the garage parking than the sign proposed. Most likely, these could be done within the Town Code, requiring no variances. The sign code also allows for a traffic-directional sign at 1 sq. ft. or 4 sq. ft, depending on the message. The code also allows for a joinfdirectory (the First Bank Building in West Vail, for example). The applicant has expressed interest in both of these options, but also has concerns about the size and number allowed. Should the applicant pursue another variance, staff will likely continue to recommend denial, depending on the proposal. The purpose statement of the variance section of the sign code states: In order to prevent or to lessen such practical difficulties and unnecessary physical hardships inconsistent with the objectives of this Title, variance from the regulations may be granted. A practical difficulg or unnecessary physical hardship may result from the size, shape, or dimensions of a structure, or the location of the structure, from topographic or physical conditions on the site or in the immediate vicinity, or from other physical limitations, street locations, or traffic conditions in the immediate vicinity. City Market (rea11y Kroqer Cos., the largest super market operator in this count,ry, and maybe on this planet) was able to effectively receive a subsidy from the Town of Vail by waving their checkbook and convincing the Town Council (I know, not aI1 of you guys) to 1et them develope a supermarket and other comnerciaL space on Town oltned property in conjunction with an "affordable housing project". They hired an architect and a 1oca1 developer, both familiar with Vail's zoning ordinances and related requirements , and they built their buildinq. At that time, they agreed to Town rules and requlations, and were issued, I assume. a Certificate of occupancy after they renoved an iL1eqa1 sign on the southwest corner of the building that directed autos to underqround parking and also at the same Eime effectively gave then another building identification sign. 2. Now, three years 1ater, some member(s) of the Town Council think chat city Market should be "subsj.dized't again with a sign variance because the facility that they designed and built has not particularly worked out the way they .,,anted it to. City Market relates that the upper deck parking is "usua11y full" ( I itispute that) and that "circulation in their 1ot is restricted,'. (Which I f eel- is due to poor design-I know I don't like drivinq in there, so f avoid it. But I don't go underground either, and f know it's there) 3. City Market has established a pattern of applyinq for variances like this. They did the sane thinq in Eagle after being in buginess awhile. Usually in these cases, a communication breakdown is the root of the problem. As you know we waited for a very long time to get the signage accomplished at Vail Commons. Once our Director at the center gave me a copy of the sign plan and vendors we initiated the project. I contacted you to review plans to make sure we were handling things appropriately. During our conversation, we discussed that I wanted to follow the sign plan exactly so that we could expedite the process. I even discussed the fact that I planned to use Bud Signs, the vendor that has produced all other channel letter signs in the Business Park. The only other thing that we discussed was faculty and parent drop- offparking. We then contacted Bud from Bud signs to begin the project. We explained the specifications we had received from you and told Bud to handle everything from his end. This included pulling the permit for town approval. We were not at all concerned because we were following the exact sign plan given to us' On Tuesday, March 10, 1998, we leamed of the problem with the permit from the center director and contacted Bud immediately to ask him why he did not pull the permit. Bud explained that he had talked with you originally and you stated that he did not need a separate permit because City Market had already pulled a permit that would cover this sign as well. I am not sure where the communication broke down, I know that it seemed to occur between you and Bud. Bud explained that he would have gone through the permit process if you had not told him otherwise. Bud is now in the process of applying for the permit. My major concern is that Bright Horizons has gonethrough all the proper channels and are faced with the possibility of not being able to use a $4000 sign. I hope to clari$r the history ofapprovals forthis development as well as educate you on the approval process for signs at this site. On August 20, 1997, the Design Review Board approved a sign program for the City Market/Vail Commons development. A sign program is required for new development or redevelopment projects. The program establishes sign locations and sizes based upon the standards found in the Sign Regulations. The sign program does not allow any variation for the square footage of signs or numbers of signs permitted. Several locations of signs and the "Vail Commons" sign were eliminated from the sign program at the meeting by your representative and the DRB, and marked directly on the official sign program for this site. The "Vail Commons" sign was eliminated because it would be one sign beyond what the Sign Regulations allow. Additionally, a sign program is not a "sign permit." Therefore, every sign to be installed requires an independent sign application and permit approval to ensure compliance with the approved sign program and the Sign Regulations. No approvals or permits were issued for the "Vail Commons" sign. Therefore, this sign needs to be removed as it is in violation of the Sign Regulations and the approved sign program. Jewett, who said there had been a question as to whether the sign conforms to TOV'S sign code, suggested calling up the matter within the required 1O-day waiting period so as not to impede or delay the applicant's progress. Although Jewett's motion died for lack of a second, Town Manager Bob McLaurin said the staff would research the matter and take appropriate action. For more information, contact Dominic Mauriello at 479-21 50. --lnclusionary Zoni ng Presentation Chuck Ogilby, a volunteer from the VailTomorrow Atfordable Housing Team, presented examples of inclusionary zoning that have been approved in whisiler, snowmass Village, Crested Butte, Telluride, Aspen and in other ski resorts. He asked the Council to move fonruard in adopting similar legislation within the Town of Vail to be applied to commercial projects. As proposed, ogitby suggested using a formula similar to the snowmass Village ordinance that would house 62 percent of a project's employees on site. A second tier would provide the balance of the 62 percent figure within the town's boundaries. A third (and least desirable) option would provide a cash-in-lieu formula (more) MEDIA ADVISORY {j**"*r r"" Vail Council Highlights/April 7, 1998/Addl similar to the town's parking pay-in-lieu formula. Ogilby said the inclusionary zoning concept should be considered as a funding-and siting-source for housing during the Common Ground public involvement process. Because of the increased possibilities within Lionshead and other commercial areas, Ogliby said the increased possibilities for additional housing in Vail are "phenomenal." And, he said the concept would take the pressure off the possibility of using some of the town's open space parcels for the construction of affordable housing. Reaction by the Council was cautiously favorable. Councilman Michael Arnett said the proposed pay-in-lieu component could be helpful in generating the funding needed to pursue the possibility of adding housing to the top deck of the parking structures, while Councilman Michael Jewett expressed concerns about equitable employee-employer relationships among those who would reside on- site. Mayor Rob Ford said the Town Council may well be moving in the direction of inculsionary zoning or an employee generation ordinance, depending upon the outcome of the Common Ground process. Ford said the controlling factor in the discussions in Vail and throughout the county will be the amount of available land for affordable housing. Ogilby said if the Town of Vail took the lead in such an etfort, Eagle County would likely follow close behind. Up to 16 public and private construction projects are planned for the area between mid-April and mid- September, including the renovation of Slifer Plaza, installation of heated stairways at the Vail Village Parking structure and the Seibert Gircle streetscape projea.
