WHEREAS: Such Declarant has constructed on said premises a building consisting of two townhouses known as Parcel A and Parcel B, which townhouse units are connected by a common wall; WHEREAS: Declarant has divided such lot into two separate parcels as follows: Parcel A, containing the portion for such building known as the West Unit and Parcel B, containing the portion of such building known as the East Unit. Both parcels of which are more particularly described as Parcel A and Parcel B, a resubdivision of Lot 12, Vail Heights, Filing 1, Vail, Eagle County, Colorado. WHEREAS, Declarant wishes to create easements relating to the party wall (placed equally divided on the common boundary separating Parcel A and Parcel B), the footings underlying such party wall and the roof above such party wall (such wall, footings and roof being hereinafter desigrrated as the "Party Wall"); and WHEREAS, Declarant wishes to provide for certain restrictions and easements which relate to both parcels and will run with the land and be binding upon and inure to the benefit ofthe Declarant, their successors and assigns forever. NOW, THEREFORE, in consideration of these premises, the Declarant hereby provides the following easements and restrictions which shall hereafter run with the land and be binding upon and inure to the benefit ofthe Declarant, their successors and assigns forever: 1. The subject property is hereby divided into two parcels as follows: Parcel A (West Parcel) ParcelB(East Parcel) 2. Each parcel shall constitute a separate fee simple estate containing certain easements and rights-of-way appurtenant thereto. 3. The above described parcels and improvements thereon may be conveyed and described for all purposes as Parcel A, a Resubdivision of Lot 12,Yail Heights, Filing l, and Parcel B, a Resubdivision of Lot l2,Yail Heights, Filing l. 4. The said Party Wall dividing Parcel A and Parcel B is hereby declared to be a Party Wall and shall be construed as a Party Wall between such units under the laws of the State of Colorado except as specificaliy provided herein. 5. Each owner shall have a perpetual reciprocal easement in and to that part ofthe subject property owned by the other owner and on which the Party Wall is located, for party wall purposes, including maintenance, repair, and inspection; neither owner shall alter or change the Party Wall in any manner, interior decoration excepted, and the Party Wall shall always remain in the same location as when erected. NOT 6. The costs of maintaining the Party Wall shall be bom equally by both owrers. Maintenance of extemal appearance and of roofs shall be undertaken with the unanimous consent ofboth owners and at the propodional expense ofboth owners, unless the owners unanimously agree to the contrary. Said proportion shall be determined by each owner's portion of the square footage of the entire maintained or repaired area. 7. In the event of damage or destruction of said wall from any cause, other than the negligence of either party thereto, the then owrers shall, at joint expense, repair or rebuild said wall, and each party, their successors and assigns, shall have the right to the full use of said wall so repaired and rebuilt. If either party's negligence shall cause damage to or destruction of said wall, such negligent party shall bear the entire cost of repair and reconstruction. If either party shall neglect or refuse to pay his share of such costs, the other party may have such wall repaired or restored and shall be entitled to have a mechanic's lien on the premises of the party so failing to pay, for the amount of such defaulting party's share of the repair or replacement cost, with interest at the rate of lSYo per anrulm, costs and reasonable attorney's fees. 8. Either party shall have the right to break through the Party Wall for the purpose ofrepairing or restoring sewage, water, utilities, etc., subject to the obligation to restore said wall to its previous structural condition at his own expense and the payment to the adjoining owner of any damage negligently caused hereby. 9. No owner shall make or suffer any structural or design change (including color change) of any type or nature whatsoever to the exterior of any improvement on the property without obtaining the prior written consent of the other owner, which consent shall not be unreasonably wittrheld or delayed. Should either owner fail or refuse to pay his proportionate share of the cost of any decoration or structural change as such proportion is determined in paragraph 6 above, t}te other owner may pay for said cost and shall be entitled to have a mechanic's lien on the premises of the party so failing to pay, for the amount of such defaulting party's share of the repair or replacement cost, with interest at the rate of lSYo per annum, costs and reasonable attomey's fees. 10. In the event of destruction or damage to either dwelling unit or any portion thereof on the property, the dwelling so destroyed shall be restored at the joint proportional expense ofboth parties as determined in paragraph 6 above, according to a uniform architectural plan and finish. If it is determined that the negligence of either owner was the cause of said damage or destruction, such negligent party shall bear the entire cost of repair or reconstruction. If the owner of the damaged improvements does not commence repair or reconstruction within thirty (30) days from the date that the damage occlus, the other owner may do so provided, however, that such repair or reconstruction shall not be undertaken without prior notice to any holder ofthe first deed of trust encumbering the improvements damaged or destroyed, and, further, provided that such beneficiary of said deed of trust may, by reasonable notice, refuse to consent to such repair or replacement. Should any owrer fail or refuse to pay his proportionate share of the cost of repair or replacement, the other owner may make payments and shall be entitled to have a mechanic's lien on the premises of the parfy so failing to pay for the amount of such defaulting party's share of the repair or replacement cost, with interest at the rate of lSYo per armum, costs, and reasonable attomey's fees. Each owner shall obtain and maintain at all times insurance against loss or damage by fire and such other hazards as are generally covered in the area under standard extended coverage provisions for at least the full insurable replacement cost of the improvements on the subject property owned thereby. Proof of such insurance shall be supplied by each owner upon the reasonable request ofthe other owner. The insurance shall provide that it cannot be canceled by either the insured or the insurance company until written notice has been sent to the other owner. Each owner may obtain whatever additional insurance he so desires. Each owner may, at any time two years or longer after the most recent appraisal, demand of the other owner an appraisal of the improvements for insurance pu{poses, or at the option of the other owner, a comparative market analysis from a qualified real estate broker, and shall not be required to sharc the cost of the L 8-710 P-207 t0/gt/t996 04:04p pG 2 oF 4 :'-, !,it.(I 60 618 6 appraisal ifthe demanding party is intending to use the appraisal to facilitate the sale of his property. 12. The owners of each unit shall be individually responsible for the upkeep of the appearance ofthe yard and other outside facilities located on their respective parcels. However, the owners from time to time mutually undertake such landscaping and general outdoor improvements as they mutually and unanimously deem proper for the harmonious improvement of both parcels in a common theme. The owner of one parcel shall not unreasonably damage the value of the other parcel such as by shoddy upkeep outside, and both owners shall make reasonable efforts to preserve a harmonious common appearance of the building and the grounds. In the event the owner of one parcel shall not reasonably undertake to keep up the general appearance ofhis parcel, the other parcel owner may enter upon said parcel for the purpose of preserving the upkeep of said parcel and may hold the other owner liable for the reasonable costs and expenses incurred in such upkeep. The owner entering upon the other's parcel to maintain the upkeep and general appearance of said parcel shall be entitled to have a mechanic's lien on the premises of the other party for the amount of the reasonable cost of said upkeep, with interest at the rate of lSYo per annum, costs and reasonable attomey's fees. 13. A mutual easement for the location, installation, maintenance, repair and removal of utility facilities (including, but not limited to, systems, lines, pipes, tanks, metering and distribution services for water, sewer, electricity, telephone, and cable television) is hereby granted, together with the right of ingress and egress therefore, on, above, over and through the subject property and the improvements constructed thereon, subject to the obligation to restore as nearly as possible said subject property and improvements. All maintenance and repair with respect to said utilities shall be accomplished at the expense of the owner requiring said maintenance and repair. If both owrers require maintenance and repair, the expense shall be bome equally by both owners. 14. Each owner shall be permitted not more than two pets (not including any pets which never leave the interior of said owner's unit) and each owner shall be completely responsible for said animals. Tenants shall not be allowed to have pets. 15. The easements and restrictions hereby created are and shall be perpetual and construed as covenants running with the land and each and every person accepting by deed or otherwise any portion of the above described premises shall be deemed to have accepted such to the benefits hereof and that any olher present or future owner by deed or otherwise is similarly bound hereby and entitled to the benefit hereof, all to the same extent as though he had signed this instrument. The undersigned, in executing and delivering deeds to the above described premises may provide, by reference, in said conveyances, that the same are subject to the terms and conditions, reservations, restrictions and covenants herein contained, and may designate the book and page ofthe records in which this instrument is recorded. 16. These easements and restrictions may be amended or revoked only upon the recording of any instrument duly executed and acknowledged by all the then record owrers of the subject premises. 17. Ifany provision ofthis instrument or any section, sentence, clause, phrase or word, or the application thereof in any circumstance, is held invalid, the validity of the remainder of this instrument and of the application of any such provision, section, sentence, clause, phrase, or word in any other circumstance shall not be affected thereby. 18. Ownership of these units may be by any number of entities, but for all purposes herein there shall be deemed to be only two "owners," the owner of Parcel A and the owner of Parcel B. Each parcel and townhouse thereupon shall be considered a separate parcel of real estate for all purposes, including, by way of illustration, real estate taxation and mechanic's lien. 20. Prospective purchasers of units shall be entitled to determine if the selling owner is in default with respect to any maintenance obligation or other obligation under these covenants by delivering a written inquiry with respect thereto to the owner of the other unit. If no response is received to such inquiry within thirty (30) days of the date of said notice, the non-selling owner shall be deemed to have waived any claim of lien or claim for damage. The existence of a recorded notice of lien, however, shall constitute notice to a prospective purchaser of a claim by an owner ofthe other unit, and shall not be affected by the foregoing request for information. 21. If any encroachment by the improvements now located on the subject property, or any minor encroachment deriving from replacement or repair thereof, exists upon the other parcel, a valid easement therefore and for maintenance thereof shall exist. 22. T\is Agreement shall not be subject to the doctrine of merger, and no merger shall result at any time from common ownership of both Parcels A and B by a common party. 23. Should either party be required to take action to enforce, by legal proceeding or otherwise, any condition, restriction, covenant, or other right or obligation imposed pursuant to this declaration, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The 58PAV offers the same high quality you demand and receive from Carrier. The cabinet is constructed from a specially selected galvanized embossed steel with a clear coating which provides prot€ction from humidity and rust. The 58PAV offers a hot surface ignition system which provides a superior and more reliable ignition system than older spark relight systems. The heat exchangers are constructed of aluminized steel and covered by a 10-year Limited Warranty. They are Carrier's patented Super-S heat exchangers that improve heat transfer and enables downsizing of this furnace to only 40 in. tall. To improve the sound level, we have incorporated a soft mount inducer assembly and a slow opening gas valve. The control board is the brain of this induced-combustion gas furnace. It offers a unique self-test feature that checks all the major functions of the furnace within 1 minute. The control board also features a 3-amp fuse that protects the transformer and control board. Another feature on the control board is a LED status indicator light to ensure top furnace performance. Dsconnect electrical power before rcmoving blower access door. b. Remove 2 screws from front of door and remove blower access door. c. Reach up behind top plale, tilt filten toward center of retum-air plenum, rcmove filters, and clean as nceded. Replace if torL d. Fumaces "*Q"r* with permanent, washable filrers. Clean fihers with tap water. Spray water through filter in opposite direction of airflow. e. Rinse and let dry. Oiling or coating of filten is not recommended or required. f. Reinstall filters. g. Replace blower access door. h. Restore electrical power to fumace. 2, Upflow Each fumace requires I or 2 filters which are installed in the blower compartment. (See Fig. 6.) To rernove filters for cleaning or replacement, proceed as follows: a. Disconnect electrical power before rcmoving access doors. b. Rernove blower and control access doors. c. Release filter retainer from clip at front of fumace casing, (See Fig. 6.) For side retum, clips may be used on either or both sides of the furnace. d. Slide filte(s) out. e. Furnaces are equipped with permanent, washable filten. Clean filters with tap water. Spray water through filter in opposile dircction of airflow. f. Rinse and let dry. Oiling or coating of fiher is not rccommended or requircd, g. Reinstall filte(s). h. Replace blower and control access doors, i. Restore electrical power to fumace. BI.OWER MOTOR AND W}IEEL For long life, economy, and high efficiency, clean accumulated dirt and grease from the blower wheel and motor annually. The foIowins steps should be performed by a qualified service techulcian Some motors have prelubricated sealed bearings and rcquire no lubrication. These motors can be identified by the abcence of oil ports on each end of the motor. For those motors with oil ports, lub,ricate motor every 5 yean if motor is used on intermitlent operation (thermostat FAN switch in AUTO position), or every 2 years if motor is in continuous operation (therrnostat FAN switch in ON position). NOTE: Remember to disconnect the electrical supply before removing access doors. Clean and lubricate as follows: l. Remove 2 scrcws from blower access door (downflodhorizontal fumace only) and remove blower access door. 2. Rernove vent pipe enclosure (downflodhorizontal fumace only) and disconnoct short piece of vent pipe ftom r€lief box. 3. Disconnect wires from auxiliary limit on blower housing (downflow/horizontal fumace only). 4. Remove conrol. 5. Dsconnect electrical leads from control. (See Fig, 6 or 7,) Note location of wircs for rcassembly. 6. Do not over-oil. c. Allow tirne for total quantity of oil to be absorbed by each bearing. d. Wipe excess oil from motor housing. e. Replace dust caps or plugs on oil ports. 12. Remove blower wheel from housing, a. Mark cutoff location to ensure proper rcassembly. b. Remove screws holding cutoff plate and remove cu3off plate from housing. c. Lift blower wheel from housing through opening. 13, Clean blower wheel and motor using a vacuum cleanet with soft brush attachment, Do not r€move or disturb balance weights (clips) on blower wheel blades. The blower whecl should noa be dropped or bent as balance will be alfecl€d. 14, Reinstall blower wheel by reversing items 12 a through c. Be surc wheel is positioned for proper rotation. 15. Reasscrnble motor and blower by rcversing items 5 through 10. If motor has gound wire, be sure it is connected 8s beforc. 15. Reinstall blower assembly in fumace. 17. Reinstall control. CoffFct blower electrical leads to control. Pleas€ note that the common wire connection is 3/16 in. and all other wirc connections are l/4 in. for assembly. DO NOT FORCE. CI.EANING HEAT EXCHANGER The following steps should be performed by a qualified service technician. NOTE: Deposis of soot and carbon indicate $e exisience of a problem which needs io be corected. Take action to conect the problem. If it becomes necessary to clean the heat exchanger because of cffbon deposits, soot, etc., proceed as follows: l. Tum off gas and electrical power to fumace. 2. Remove 2 screws from ftont of blower access door (downflodhorizontal fumace only) and r€move control and blower access doon, 3. Remove vent pipe enclosure (dovnflodhorizontal fumace only) and disconnect vent pipe from rclief box. 4. Remove 2 screws that securc relief box, (See Fig.6 or 7.) 5, Disconnect wires to the following components. a- Draft safeguard switch b. Inducer motor c. Prcssure switch d. Limit overtemperaturE switch(es) e. Gas valve f. Hot surface ignitor g. Flame-sensing electrode h. T$o wiring conneclors leading to control 6. Remove 8 screws that secure flue collector box to center panel, Be careful not to damage sealant. 7. Remove complete inducer assembly from fumace, exposing flue openings. DRAFT SAFEGUARD SWITCH FLUE @trECTOR BOX MANUAL RESET LIMIT swtTcH I/IOUNTING SCREWS Be sure the motor is properly positioned in the blower housing. The motor oil ports must be at a minimum of tl5" above the horizontal centerline of the motor after the blower assemblv has been rcinstalled in the fumace. 8. Clean cells using field-provid"a ..f* U.rh, steel spring cable, revenible electric drill, ard vacuum cleaner. a. Assemble wire brush and steel spring cable. (1.) Use ,A in. of l/4-in. diameter high-grade steel spring cable (commonly known as drain clean-out or Roto- Rooter cable). (2.) Use l/4-in. diameter wire b,rush (commonly known as 25-caliber rifle cleaning brush). NOTE: Tlre naterials needod in items (1.) and (2.) can usually be purchas€d at local hardwar€ stores. (3.) Insert twisted wirc end of brush inlo end of steel spring cable, and crimp tight with crimping tool or strike with ball-peen hammer. TIGHTNESS is very imponant. (4.) Remove metal screw fitting from wirc brush to allow ins€rtion into cable. b. Clean each heat exchanger cell. (1.) Attach variable-speed, reversible drill to end of steel spring cable (end o'pposite brush). (2.) Insert brush end of cable into upper opening of cell and slowly rotatc with drill. DO NOT force cable. Gradually insert at least 36 in. of cable into 2 upper passes of cell. (See Fig. 8.) 491252 Flg. 8---Gleanlng Heat Exchanger Cel! (3.) Inscrt brush erd of cable in lower opening of cell, and proceod to clcan 2 lower passes of cell in same manrpr as 2 upper passes. (7.) Repcar forcgoing procedurcs until each cell in frrmace has been cleancd. Remove residue frorn each cell using vacuum clcrner. Clean bunrer assembly using vacuum cleaner wilh soft brush attachncnt. (10.) Reinsoll cell inlet plates md bunrer assembty. Crre must bc excrcised to ccnter the htrners in the cell openings, FIg. Hosltlon of lgnitor to Bumer 9. Cbeck for gs leaks. -+ ELECTRJCAL CONTROIS AND WTRI}O a There may be more than I elccrrical supply to the unit. Check accessories and cooling unit for additional electrical supplics. The electrical ground and polarity for ll5-v wiring must bc maintained properly. Refer io Fig. lo for field wiring information and to Fig. 12 for unit wiring infcrnation. NOTE: If tlrc polarity is not cor€ct, lhe STATUS LED on lhc control oenter will flash rapidly and prcvent the fumace from operating. The control systcm dso rcquircs an earth ground for proper operation of the contr,ol bosd and flame-sensing electrode. The 24v circuit contains an automotive-typc, 3-amp fuse located on tlre control board. (See Fig. I l.) Any dfuect shorts of the 24v wiring during installation, service, or maintenance will cause this fuse to blow. If fuse replacement is requircd, use ONLY a fusc of identical sizc. With power to the unit disconnected, check all electrical conncc- tions for tightness, Tighten all screws on electrical connections. If any smoky c bumed connections are found, disass€mble thc connection, clean all pars, strip wire, and rcasscmble prcpedy and securely. Reconnect electrical power to the unit and observe unit throuSh I complete operating cycle. Elecrical controls arc diflicult to check without proper instnimentation; if there are any discrepancies in the op,erating cycle, conlact your dealer and request service.
