On or about April 21, 2006 the Town of Vail Design Review Board (the "Town") approved an application by the Eagle River Water & Sanitation District (the "District") to change the District's vehicle access to Lot l l, Block 16, Vail Meadows Filing 2 (the "Vehicle Access") from gravel to asphalt (the "Town Approval"). The Vehicle Access is, in part, upon and across the Soden Property and, prior to the Town Approval, was merely a nilrrow dirt road. The Town Approval and the subsequent paving work completed by the District are in violation of Mr. Soden's property rights. The District has no property rights that would allow it to pave a road across the Soden Property. In fact, there is no written agreement or easement at all documenting the District's access rights across the Soden Property. Even the nalrow dirt road that was in place prior to the paving was not located where the District's easement rights actually exist as shown on the subject plat. The Town's approval of such paving, therefore, is not justified or sanctioned by law. Mr. Soden never has and does not now consent to the Town Approval or the paving completed by the District. Furthermore, condition CONOOO7955 in the Town Approval states that the District must notify in writing all of the property owners adjacent to the Vehicle Access and provide staff Re: of documentation of the notice prior to commencing work on paving. The District never provided notice, written or otherwise, to Mr. Soden of the paving work to be done. The District cannot have provided the Town with documentation of any such notice because none exists. In addition, Mr. Soden has never agreed, in writing or otherwise, to the District changing its vehicle access to asphalt across the Soden Property. The District completed the paving without any notice or consent whatsoever from Mr. Soden, Mr. Soden hereby demands that the Town immediately revoke the Town Approval as it relates to the Vehicle Access across the Soden Property. Furthermore, Mr. Soden demands that the District, at the District's expense, immediately remove the asphalt paving from the Soden Property and restore the Soden Property to its condition as it existed prior to the paving. If we do not receive written notice within seven (7) days of the date of this letter that both of these demands will be met, we are authorized to commence legal action to prosecute Mr. Soden's riehts. First and foremost, I wish to repeat the apologies already tendered by Dennis Gelvin regarding the manner the Distlict handled the paving project. The communications and the overall dealines with Mr. Soden could have been better. While the District and its predecessors have utilized this accessway for well over 30 years, and would have an entitlement to an easement by prescription if required, the plat for this property clearly provides for a "20.0ft. roadway easement on west side of highwater line of creek. " This road is within the platted roadway easement. It is our position that this is a platted roadway dedicated to the public, and able to be paved as most roadways are paved. The Town of Vail staff, not the Design Review Board, approved the subject application for paving within the platted access easement for the facility. lf you believe that the District has paved outside of said easement, please provide the Town with reasonable documentation to substantiate your claim. Unfortunately, we cannot enforce the unsubstantiated complaint of a single property owner who has provided us with no documentation whatsoever, excepting your letter as referenced above. Further, your assertion that there is "no written agreement or easement at all documenting the District's access rights across the Soden's Property" is erroneous. We have evidence, including a plat of Mr. Soden's property recorded on October 23, 1991 ("Final Plat, A Resubdivision of Lot 8, Block 1, Gore Creek Subdivision"), which depicts and describes the easement, and explicitly dedicates to the public and defines the terms of the easement in the Certificate of Dedication and Ownership. Next, with regard to the condition of approval you claim was not satisfied, the condition was not a request for permission to pave and did not require any consent from your client. Instead, the condition was a courtesy to notify adjacent owners of the work to be done. Two ofthose lots are owned by the Town of Vail and we deemed the action of the Design Review Board to acknowledge notice to the Town. The other two lots are Lot 8A and Lot 9 of Gore Creek Subdivision. The owner of Lot 9 is the Mark J. Heiman Trust. A copy of our letter notifying the Trust of the project is enclosed. Lot 8A is owned by Scott and Catherine Soden. The District employee who prepared the notices made an error and notified the owner of Lot 88, Jackass Acres LLC, of the project instead of the owner of Lot 8A. A copy of our letter notifying Jackass Acres LLC is enclosed. No notice was required to Jackass Acres LLC, because the roadway was already paved across its property. It is clear from these documents that the District truly made a good faith effort to comply with the condition to notifu adjacent owners of the project and we believed we had done so prior to paving. It is unfortunate that we notified the wrong property owner, but we did not know that at the time the roadway was paved. We regret that Mr. Soden was not notified, but it is clear from the record that the failure to notify him was the result of an honest mistake by a District employee. We proceeded with the project in the belief we had complied with the notice condition. We request that you find the District is in substantial compliance with the conditions of its DRB approval and no code enforcement action is required. On or about April 21, 2006 the Town of Vail Design Review Board (the "Town") approved an application by the Eagle River Water & Sanitation District (the "District") to change the District's vehicle access to Lot 11, Block 16, Vail Meadows Filing 2 (the "Vehicle Access") from gravel to asphalt (the "Town Approval"). The Vehicle Access is, in part, upon and across the Soden Property and, prior to the Town Approval, was merely a narrow dirt road. The Town Approval and the subsequent paving work compieted by the District are in violation of Mr. Soden's property rights. The District has no property rights that would allow it to pave a road across the Soden Property. In fact, there is no written agreement or easement at all documenting the District's access rights across the Soden Property. Even the narow dirt road that was in place prior to the paving was not located where the District's easement rights actually exist as shown on the subject plat. The Town's approval of such paving, therefore, is not justified or sanctioned by law. Mr. Soden never has and does not now consent to the Town Approval or the paving completed by the District. Clearly, the Disbict and its predecessors have utilized tbis accessway to water intake, rearrnent and pumping faciliries for well over the I8-year period required of a prescriptive easement. In fact I do not believe that panicular issue is in dispwe. 2. Either by coincidcnce or by design, this access easement appears to run the same course as tbe narratively described roadway easement in the 1969 plar"'- for rhis area. On rhis plat, there is granted a "20.0ft. roadway easement on west side of highwarcr llne of teek." Exactly where the bigh water line is, or was in 1969, is questionable. It appears ro me that this access road probably actually lies within this roadway easemeil. 3. As ro all of the above, there may be no real dispute, Mr. Soden is of the belief that you made a verbal commitnent some seven years ago not to pave tbis roadway. You not only have no recollection of that, but have recitEd a number of reasons why you would nol have made such a commiEnent. While I am not in favor of iguoring any such commitnent simply because it was nor in wriring, it does nol appear that this verbal commimrent was actually made.
