ITe have inspected the landswhj-ch are not encumbered by the highway easement. If you wiIl refer to the second paragraph of the appraisalcontract dated llarch 2, you will note that the appraisal isgoing to assume "that it is the position of the Town of VaiIthat this land which has been annexed and zoned greembelt andnatural open space district is environmentally sensitive andshould not be encroached upon by any man made structure". Onparcel II there are three excellent building sites which I amafraid an unbiased person would think could qulte properly bedeveloped. As raw land building sites, they would probablyseI1 for $150,O00 each. This assumes that the o1d right of wayfor US 6 can be used for access to the sites. It also assumesthat the land passes percolation tests. On the Spraddle Creek Parcel-, I regret to say that thereare two magnificant building sites, which I suspect ean easilybe developed with water wel1s and leaching fields. Access tothem would be off of the Forest Service Road going up SpraddleCreek. These building sites would probably have a value of $5OO,O0O each. After analyzing the county''s zoning phitosophy, I betievethat the development of these parcels as outlined above wouldprobably be acceptable if the land were not already annexed tothe Town of Vail. As f see the appraisal problem, it rvoulclappear that a" prudent buyer purchasing the land from the ForestService would i-nitially eome to the Town of Vail and ask forzoning as outlined above. If this were declined and a lawsuitfiled, i-t appears to me that a court would rule in his favor. I wanted to expose your office to this problem beforeproceeding further with this appraisal as I expect the valuesmentioned are much greater than we were all hoping. TNC can thus hold thesetracts untll the Forest service can purchase them. They also can offerflnanclal arrangenents more attractlve to the seller than the governmentcan.
