covenants on January 9, Lg7O, in Book 2L6 aE Page 762 of the
records of the county clerk and Recorder of Eagle county, colorado,
for all lands embraced within the plat of Vail Village' Ninth
Filingi and,
WHEREAS,theundersignedpetitionersownmorethansixty-six
and two-thirds (66 2/32) percent of the total combined surface area
of VaiI Village, Ninth Filing; and,
WHEREAS,theundersignedpetitionerswishtoamendsaid
Protective Covenants to allow certain land usesi
NowTHEREFoRE,Section2.loftheProtectiveCovenantsof
vail vitlage, Ninth Filing, is hereby amended to read as follows:
"2.]ThenumberedLotslthrough12bothinclusive
shall be used only for private residences each
to contain not more than two separate living
units. "
ExcePtashereinspecified,allrestrictions.covenants'
and conditions contained in the Protective covenants for vail
Village, Ninth Filing, shall remain in ful1 force and effect;
provided, that in the event the provisions of this Amendment
shall in any way conflict with said Protective Covenants, the
provisions of this Amendment shall control.
