If this permit requires a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Heallh Depaftment review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements, Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

NOTES:
1. If the utility verification form has signatures from each of the utility companies, and no comments
are made directly on the form, the Town will presume that there are no problems and the
development can proceed.
2. If a utility company has concerns with the proposed construction, the utility representative shall
note directly on the utility verification form that there is a problem which needs to be resolved.
The issue should then be detailed in an attached letter to the Town of Vail. However, please keep
in mind that it is the responsibility of the utility company and the applicant to resolve identified
problems.
3. These verifications do not relieve the contractor of the responsibility to obtain a Public Way Permit
from the Department of Public Works at the Town of Vail. Utility locations must be obtained before
digging in any public right-of-way or easement within the Town of Vail. A buildino permit is not a

Re: Follow up to field meeting regarding building renovalion, deck addition, and tree
removal
Ms. Wheatley:
This leiler is to confirm the conclusions of our field meeting discussion on August 16,
2002 in regards to the comments found in the August 15h letter. For ease the
comments from the August 15h letter are found bellow with the results of out discussion
in bold.
. The proposal includes the removal of I existing trees (6 evergreens, 2 aspens),
Statf found the removal of the tree to be acceplable with one exception. Staff
recommends that of the two fir lrees located on the southwest corner the tree
which is located further south should be removed. Due to the trees close
proximity to each other the removal of the tree which is further north would leave
the remaining tree with a large hole facing Alpine Drive. Although staff supports
the removal of the trees we would request that you plant three, 1-2" caliper
aspens on lhe north side of the sidewalk along the northern property line, six 2'
caliper along the hill at the rear of the structure, and three 1-2" caliper in the front
of the struclure on the hill between the parking area and the sidewalk 1o replace
the trees being removed. In addition, the planting ol shrubs along the foundation
and at the edges of the new deck would be requested. lt was agreed that
replacement trees and shrubs would be planted on the site in the locations
listed above. Some of the trees would possibly be planted in groups. The
species of aspen will be selected at your discretion. Pending information
from you the large fir on the southwest corner will not be removed until
staff's concerns have been addressed.. What is to become of the sidewalk located on the south side of the structure
which will be covered by the new deck installation? lt is likely the sidewalk will
remain under the proposed deck and will be covered with eilher mulqh or
stone.. The hand rails leading from the parking area lo the structure shall be repaired
and repainted. This will be repaired to match the north hand rail.

. All rotten wood on the structure shall be replaced same for same. All rotten
wood will be replaced same for same.. The pickets and rail on the new decks should match that of the existing decks
and shutters. The rails and pickets on the new decks will match those found
on the existing decks.. No enclosed storage areas shall be constructed beneath the decks. Minimum
storage areas are acceptable, however they should be no larger than that
which is there currently. The existing storage areas are approximately four
leet by four feet.. The existing light fixtures on the rear of the building shall be replaced with full
cut-off fixtures which meet the Town Code. Cut-sheels for the proposed fixtures
must be submitted. Upon selection of a lull cut-off light fixture please
submit cut sheets from the manufacture to our offices for approval.. The existing trash enclosure located at the north end of the parking lot shall be
painted to match the trim on the building. The existing trash enclosure will
remain the cleaned and repainted the current color (natural brown).. Roof vents must be painted to match the color of the roof material. All rool
projections will be painted to match the roof material.o A wood "belly band" trim should be added at the same height of the proposed
decking on all elevations where no decking is proposed. The band should be
painted to match lhe trim and deck color. Below the band a darker color which
matches the two existing colors should be employed to help reduce the mass of
the building. An example of this lechnique is located north of the site at the
corner of West Gore Creek Drive and Matterhorn Drive. A band of a synthetic
material wood-like material or wood will be applied to the exlerior with the
area below the decks and the added band being of a darker color. Color
samples shall be provided to staff for prior approval.. Staff was uncertain as to what the removal of the berm entailed under the
decking. Staff requests that the area remain and be covered with mulch. Prior
to any changes being done under the decking a precise plan shall be
submitted to staft for review. Staff expressed concern over removing the
berm on the southwest corner due to the remaining larger evergreen tree.
Please review these comments and if you have any questions regarding this letter
please contact me al 479-2148. Please submit the required items at your earliest
convenience in order to receive the permil more quickly. Town staff appreciates your
desire to upgrade and improve your property and welcome to lhe community.

The Town of Vail has reviewed your application and performed a sile visit in order to
ascertain the extent of the proposal. Staff has identified several items which will need to
be addressed prior to approval of the application. The following list delails staff's
findings and questions.

APPROVAL PROCESS, REVIEW CRITERIA
Upon receivlng two coples of a complete subnittal along wlth
palment of the appropriate fee, the zonlng administrator shall
route one copy of the site nap to the town englneer for hisreview. The zonLng adnlnistrator shall then conduct this reviewconcurrently. The town engJ.neer shall review the eubnittal andreturn comments and notificatlons to the zonJ.ng adnlnletrator who
shaLl transnlt the approval , dlsapproval or aPproval wlth
nodifications of the plat wlthln fourteen days to the appllcant.
The zoning adrnlnistrator shalt sign the plat if approved or
reguire nodlflcatl"onE on the plat for approval or deny approval
due to lnconslstencies wlth the orlglnally aPproved plan orfallure to nake other regulred nodlfications of the plat.
FILING AND RECORDING
The zoning adnlnistrator shall be the flnal- signature required on
the plat so that the Departruent of connunity Development will be
responsible for prornptly record{ng the approved plat with the
Eagle County Clerk and Recorder. Fees for recording shall bepald by the appllcant. The conmunLty Development Department wlllretain one nylar copy of the plat for thelr records and wlll
record the remaining nylar copy.

If this application requires a separate review by any local, State or
Federal agency other than the Town of Vai1, the aPplication fee shall be
increased by $200.00. Examples of such review, may include, but are note
limited to: Colorado Department of gighway Access Permits' Army Corps of
Engineels 404. etc.
The applicant shall be responsible for paying any publishing fees which
are in excess of 50* of the application fee. If, at the applicant'srequest' any matter'is postponed for hearing, causing the matter to be
re-published, then, the entire fee for such re-publication shall be paid
by the applicant.
Applicatlons deened by the Cormnunity Development DeparLment to.have
significant design. land use or other issues which may have a significant
impact on the comnunity may require review by consultants other than town
staff. Shoul,d a determination be made by the town staff that an outside
consultant is needed to review any applicatj"on, the Community Development
may hire an outside consultant, it shall estimate the amount of money
necessaxy to pay him or her and this ar1ount shall be forwarded to the
Town by the applicant at the time he files his application with the
Conmunity Development Department. Upon completion of the review of the
application by the consultant, ary of the funds forwarded by theapplicant for payment of the consultant which have not been paid to the
consultant shall be returned to the appLicant. Expenses incurred by the
Town in excess of the amount forwarded by the applicant shall be paid to
the Town by the applicant within 30 days of notification by the Town.

Dear Mr. Post:
I am writing in response to your request to subdivide the existing townhomes on the above lot.
The lot is located in a Primary/Secondary zone district and is presently occupied by a triplex
building. The property is classified as a pre-existing nonconforming building according to the
Town of Vail Zoning Code. Under existing zoning, one primary unit and one permanently
restricted employee unit would be permitted. At the time of annexation of this property, the
Town accepted the property and the existing nonconforming structure, However, since the
property was not subdivided previous to the annexation, any subdivision of this property must
be in conformance with the Town's subdivision regulations.
Under Section 18.13.080 of the Vail Municipal Code, alllots with less than 15,000 sq. ft. of lot
size are allowed a primary unit and a restricted second unit. Since Lot 5 appears to be under
this minimum for subdivision purposes, the Town would be unable to allow the subdivision of
the property. A variance from the minimum lot size requirement may be applied for should
you decide to suMivide the lot. The lot size will need to be verified should you decide to
proceed furfier.

Dear Iarry:
During our recent telephone conversation, we discussed the
possible suraivision of the above described Lot ("Ipt 5") and the
Lhree residences thereon into three separately conveyable
townhouses. This letter is written at your request to have ne put
in writlng ny opinion as to why I donrt believe a zoning variance
is reguired prior to such subdivision.
I agree that the subdivision of Iot 5 must be in confor:nance
with the-Toltnrs subdivision regulations. Section L7.22.01O of the
Townrs subdlvision regulations reguires that the Zoning
Adninistrator make sure that the iurprovenents are consistent with
the zoning code. At the time of annexation of Lot 5 into the Town
of Vail, -l,t was zoned as a pre-existing nonconforning triplex
wlthin a Prinary/Secondary zone. By definition, as.a pertnitted
non-confor:rning ule, the triplex is presently a pennitted use by
right under the zoning code ippLicabte to Lot 5 and no variance or
ant other zoning aLtion iJ requlred to make the existing
improvements on f,ot S conform to the Town of VaiI zoning code.
Pursuant to Section 18.13.080 (A) (10), the Town of Vail
Planning Departnent has raised the issue that because Lot 5 is less
than 15-, ood square feet and the - Prinary/Sec_onda_ry_ zoninS- -lt9y19therefore not allow a secondary unit to be subdivided and sold that
such Section rnust also prohibit the subdivision and sale of three

that the three units on t-ot 5 are per:rnitted units that, because of
their pre-existing nonconformance status, are no nore subject to
the l5rooo square foot requirenent than they are to the GRFA

Regardless of the legal arguments, there is no danage to tle
Town of VaiI or the publlc by permitting the subdivision of I,ot 5.

In respect to your question concerning the condominiunizationof this triplex, the staff,s position is that the owner maysubnit an applieation for condominiunization of this projectwhich rneets all our subrnittal regulrernents. If, during thereview process of the condorniniunization reguest, the stafffinds lnforrnation that the project was not originally approvedas a triplex, the condominiunization for 3 units would bedenied. The staff is not willing to state that a
condorniniunization of the triplex would be automaticallygranted. The botton line is that as a staff we do not feel itis appropriate to indicate any tlpe of approval for theproposed condoniniunization until an application has actuallybeen filed by the ovrner.
Attached to this letter is an application for thecondominiunization process. If I can be of any further help,please feel free to give me a call.

I have been unable to find any inforrnation on Lot 5, VaiIVillage West Filing #1 relating to whether or not this property
was legally built as a triplex. Attached to this letter is aletter from Jim Curnutte from the Eagle County Conmunity
Development Departnent. He has been unabl-e to locate any
inforrnation on the property. To the best of my knowledge thereis no information on this lot as to whether the units werelegally constructed. Therefore, there is no j.nformation
indicating that the dwelling units are necessarily illegal .
Hordever, in the future if infornation is nade available tbatindicates the illegality of any dwelling unit, staff wouldclearly consider the project an illegal non-conforming use.
I am sorry that it took so long to get you this information.
However, f felt that I had better try to check into all

According to one of the tenants of Unit. #1, identified as Roland
Constable, a.k.a. "RolJ-y" (P.o. Box 2613, Vail-, Colorado, Colorado
Drivers Li-cense #C165735, nB 08/28/54, SSN 560-94-6183) the fi-re
rvas first ldentified by two nrembers of Heritage Cablevision, specifically,
Jack Wifson and l.4ark Guzinski, rvho were repcrtedly working behind the
property, noticed smoke coming out of the ea,res. According to Jack
Wj-1son they viewed a large f j-re in the fire box from the exterior of
the house and not iced snnke; comino frorn the north and south ends of
the buildfig. Jack Wilson report..:Iy advised Mark Guzinski to ger-
on his company radio and nc'-lfy LI-..' home office and repor'.. Lhc s:rucltrre
fire at the above address.
When questioning Roland Constable I was advised he had buift a fire at
approximately 10:30 a.m. that morlrilg. When I inguired as to the
nature of the f j-re he advised me tlut he was burn ing a Chrlstrnas tree
and l"X 4" pine bookshelves. He advised ne that it was easier to
burn the nraterial than to pay to have the naterial removed by the
trash conpany. He advised that he was not aware of the fire until
notified by the witnesses from Heritage Cablevision, He afso stated
that he was in the upstairs bedroom and was not arr'a.re of the structllre

Olcservat ion of the fi-re box jndicated the f j-re box was a lhulnran Fireplace
corrpany, Model #L36A-L3RA-L36LA, Fireplace I'Ilnber A568544(ttIJ), Majestic
Conpany, Huntirgton, Indiana.
Observation of the fjre box itself ildicated a large bed of coal-s
approxjmately 18* to 24" thick jn the back of the box tapering dovn to
approxjmately 6" in the front of the box extending fron side to side.
Red coal-s were visible in the box.
Reviewing the fjre dannge, it appears deepest area of char was imrediately
iI front of and belovr the fire box where the hearth extens ion woufd have
joined the box itself. The fire did extend dor/rl approxirnately 6" to the
base of the floor joists, to ttle left and right of the joist for a space
of approxirnately 4 ft., and sone extens ion back underneath the floor for
one ltud space, Fire extension b,ehind the box did involve the entire chase
from the floor level of the mid-unit r,rp to and including the roof housjllg
itself. Depth of cl1ar ranged frorn total destruction of a 2"X 4" irnnediately
jll front of and belovr the fjre box to approxirnatety L" at the top of the
r60f. It should be noted clearances on the firebox are listed as 0" to
the sides, rear and bottcrn of the box. Fireplace was equj-pped with LJL
Listed thimble and triple wa11 f1u pipe. Clearances to f1u pipe hdicate
there was nonjlal conpliance wi-th the 2" separation distance. Hctr,'rever,
there does not appear to be any heat ignition poilt adj acent to or il.t
proxjmity to thJilu o. the thi,oble. Electrical wi-ri5g j3 the shaft
inaicatei heat from an external source as evidenced by the pattern of
damage to the insulation on electrical wirjrg.
Ttrere i-s no indication of flanrnable liquids or accelerants jn the vicinity
of the fire box itself. There is no baseboard hot water or electric
heat in proximity to the apparent point of ignition. Tlpre is no other
indication of any other source of ignition.
Fire damage did extend at the floor of the thi-rd level into the floor
joists for a very l-jmited space - approxi:nately 4" - and did extend up
the vert ical stud wall space. Ventil-ation hofes were punched in the
wa1ls of Units f, 2 and 3 in order to assess fire extensron.
The fire box itsel.f was reportedly installed jrr f972 and does show
evidence of usage. The fire brick located in the back of the box was
cracked i-tr several locat ions and the walls in the ilrteri-or of the fire
box did atrpear to be bent irt several of the fireplaces in the conplex '
The extent of damage in the firebox did not appear to be excessive
considerjng the amount of tine the fireplace tras been used and the t jme
si-nce it was built.

Apparently there was only one other tenant hcne at the tine of the fjre,
one steve l(raegel (P.O. Box 3318, Vait). His first notification of the
fjre was reportedly frqn the gentlellen frqn cable T.V. and the tenant
jn unj-t #I. ocher tenants reportedly residing at the corplex in unit #1
was Julie Dean (enployed att he Hong Kong cafe) and one Marla F:.itzlan.
Tenant of unit #2, Ronard l4alTnon (P.o. Box 865, Vail). He reportedly
resided in the looer Unit #2. The tenant of the upper Unit #2 was one
Barbara Blake.

At approxjnately 10:00 a.m. June 17th, 1985 I let with Jo Ledgerwood,
Field Clajms Representative, Farnersr Insurance (P.O. Box 17, Bond'
CO 80423) and Sigi l(rauss. I did receive written perrni"ssion, voluntary
consent to search, from Sigi l(rauss.
Entry was made into the unit by Firefighters Tcrn Talbot, Michael Hoffman
and myself. Also jrr our presence was one David Kipp fron l'lajestic
Fi.:replace Corpany, District Sales Manager (7799 W. Caley Dr., Littleton,
CO 80123, 973-2552r. Also Cary lturrain, Tcrun of Vail Building DepartlrEnt
was present. Review was rnade of darnage in all units. In addj-tion,
inspection of fireplaces jl other units was made. Corparison between
the darnaged fJreplace and fireplaces undarnaged by the fi.re jndicate
' saIIE hearth extension appears to be elevated approximtely 3/4" above
' the front edge of the box. I requested data and literature frorn
Mijestic Fireplace Corpany indicating manufacturer reconnended spec-
ifications but I was advised by l4r. Kipp that the lrethod in which the
hearth was attached to the front of the fi-re box was not in confornnnce
with rnanufacturer recqnrended specifications. Evidence of deterioratirg
grout in other f i-replaces was evident.
