WIIEIIIAS, the 'fown of valI retalned claycomb Englneerlng Associates, rnc. to do a drainage and slope stabirity analysls of the }Ilghland Meadows and valr vlllage lyest subdivlslon, and lIIIEtlEAs, claycomb Engineering Assoclates, Inc. has completed said report and recommends therein certain amendments to ordinance #16, Serles oI 1982, and I{IIEREAS, the Town Council has concluded that said amendments SHOULD be made for the benefit of the health, safety and welfare of the lnhabitants of the Torvn of Vall; NOW, TIIEREFORE, BE IT ORDAINED By THE TOI\'N COUNCTL OF THE TOWN oF VAIL, COLOnAIIO, TUAT: Section 1. Ordinance #16, Series of L982, Sectl-on 1is hereby amended to read as follows: 1. A11 appllcations for bulldlng permits for any bulld.lngs or structures or for any cuts and fills for any lots located in the Highland Meadows Fillng 1, Itlghland Meadows Flllng 2, Vall Village lYest FlIinB 1, and Vail Village ltest Flllng 2, and HIGHLAND PARK subdlvislons, shall be accompanled by an extremely detailed geotechnlcal solls investlgation, WHICH SttALL BE PERFORMED DURING ASSUMED THE SPRTNG Or TIIE YEAR OR UNDER/FULLY SATURATED SOrLS CONDTTTON, whlch shall set forth existing ground water condltlons, depth of bed rock, slope stability.condltlons, and design parameters for foundations and subsurface dralnage requirements. A11 foundation deslgns must wlthstand lateral loads as determlned by saidlgeotechnical lnvestigatlon, OR HAVE THE ABILITY TO FLOAT WITH SUCU LATERAL LOADS. SUBDRAINS SHALL BE REQUIRED FOR ALL BUILDINGS OR STRUCTURES IN SAID SUBDIVISIONS AND NO CERTIFICATE OF OCCUPANCY SHALL BE ISSUED FOR ANY SUCH BUILDING OR STRUCTURE UNLESS SUBDRAINS HAVE BEEN INSTALLED. ' '^; o -2- A11 such geotechnicar investigations must be done by a lrcensed professional engineer, quarlfied in geological and soils evaluatlon and all soil sampres for such geotechnical investlgatrons must be obtained from an area which rn the footprint of the proposed burlding or structure. A11 bulldlng perrnlt appllcations shall be submitLed wlth plans of the proposed structure-or building containing a written certifi_ cation by the individual who performed the requlred geotechnical survey that satd plans are in accordanee with his recommendations . Sectlon 2. The Town counctr speclficarry flnds and states that it rs the opinion of tbe Town council that an emergency exi.sts and. that thrs ordinance ls lmmediately necessary for the protection of the publlc healLh, safety and welfare and the provisions of this ordlnance shall take full force and effect upon adoption in accordance wlth the Charter of the Town of Vail as an emergency measure. Sectlon 3 If any part, section, subsectlon, sentence, clause or phrase of thls ordlnance ls for any reason held to be invarid, such decision shall not affect the validlty of the remainlng portlons of tbls ordinance; and the Town council hereby declares that it would have passed thls ordinance and each part, sectlon, subsectlon, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sectLon, subsectlon, sentences, clauses or phrases be declared 1nvalld.
