Applicant: SitzmarkCondominiumAssociationPlanner: Brent Wilson il. DESCRIPTION OF THE REQUEST The Sitzmark Condominium Association, represented by Bob Fritch, is proposing to add a dormer to an existing multi{amily residential unit at the Sitzmark Lodge. The building was constructed prior to the adoption of the "Commercial Core l" zoning in Vail Village and il currently exceeds the allowable building height. Therelore, additions of gross residential floor area (GRFA) on the upper levels that increase building height require lhe granting of a variance. REVIEWNG BOARD ROLES Order of Review: Generally, applications will be reviewed first by the PEC for impacts of the proposed variance and then by the DRB for compliance ot proposed buildings and site planning.. Planning and Environmental Gommission: Action: The PEC is responsible for final approval/denial of a variance. The PEC is responsible for evaluating a proposalfor: 1. The relationship ot the requested variance to other existing or potential uses and structures in the vicinity. 2. The degree to which relief from the strict or literal interpretation and enforcement of a specified regulalion is necessary lo achieve compatibility and uniformily of treatment among sites in the vicinity, or to attain the objectives of this Title without grant of special privilege. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. -1- 4. Such other factors and criteria as the Commission deems applicable to the proposeo vaflance. Design Review Board:Action: The DRB has NO review authority on a variance, but must review any accompanying DRB application. The DRB is responsible for evaluating the DRB proposal for: -Architectural compatibility with other structures, the land and surroundings -Fitting buildings into landscape -Configuration of building and grading of a site which respects the topography -Removal/Preservation of trees and native vegelation -Adequate provision lor snow storage on-site -Acceptabilily of building materials and colors -Acceptabilily of roof elements, eaves, overhangs, and olher building forms -Provision of landscape and drainage -Provision of fencing, walls, and accessory structures -Circulalion and access to a sile including parking, and site distances -Location and design of satellile dishes -Provision of outdoor lighting -The design of parks Staff: The staff is responsible for ensuring that all submittal requirements are provided and plans conform to the technical requirements of the Zoning Regulations. The staff also advises the applicant as to compliance with the design guidelines. Staff provides a slaff memo containing background on the property and provides a staff evaluation of the project with respect to the required criteria and findings, and a recommendation on approval, approval with conditions, or denial. Staff also facilitates the review process. Town Council: Actions of DRB or PEC maybe appealed to the Town Council or by the Town Council. Town Council evaluates whether or not the PEC or DRB erred with approvals or denials and can uphold, uphold with modilicalions, or overturn the board's decision. III. STAFF RECOMMENDATION MAJOR EXTERIOR ALTERATION The Department of Community Developmenl recommends denial of the applicant's request for a major CCl exterior alteralion to allow for a dormer addition, subject to the following findings: 1. That the proposal does nol substantially comply with the Vail Village Urban Design Guide Plan and the Vail Village Design Considerations, with specific reference 1o the building height objectives oullined in the Vail Village Design Considerations. -2- tv. BUILDING HEIGHT VARIANCE The Department of Community Development recommends denial of the applicant's requesl for a variance from Section 12-7P'-12 (height), to allow for a dormer addition, subject to the following findings: 1. That the granting of the variance would constitute a granf of special privilege inconsistent with the limitations on other properties classilied in the same districl. MAJOR EXTERIOR ALTERATION * REVIEW CRITERIA The review criteria for a request of this nature (additions of >100 square feet of floor area) are established by the Vail Town Code. The emphasis of this review is on lhe proposal's compatibility with the zoning code, the Town of Vail Streetscape Master Plan, lhe Vail Village Urban Design Guide Plan, the Vail Village Design Considerations and the Vail Comprehensive Plan. i Compliance with the Town of Vail Zoninq Code COMMERCIAL CORE IZONE DISTRICT Pursuanl to Section 18.24.010 of the Town of Vail Municipal Code, the purpose of the Commercial Core 1 Zone District is, "To provide sites and maintain the unique character of the Vail Village commercial area, with its mixture of lodges and commercial establishments in a predominantly pedestrian environment. The Commercial Core 1 Zone District is intended to ensure adequate light, air, open space, and other amenities appropriate to the permifted Wpes of buildings and uses. The district regulations in accordance with the Vail Village Urban Design Guide Plan and Design Considerations prescribe site development standards that arc intended to ensure the maintenance and preservation of the tightly clustered arrangements of buildings fronting on pedestrian ways and public greenways, and to ensure continuation of the building scale and architectural qualities that distinguish the Village." A major exterior alteration involves any addition of greater than 100 square feet of floor area within lhe CC1 zone district. The following development standards apply lo this reouest: PERMITTED AND CONDITIONAL USES: ABOVE SEGOND FLOOR Permitted Uses: Lodges. Multiple-family residential dwellings. Conditional Uses: Retail stores and establishments Eating and drinking establishments Professional offices, business offices, and studios. Banks and financial institutions. Personal services and repair shops, including the following: Theaters. -3- B. Type lllemployee housing unit (EHU) Type lV employee housing unit (EHU) SETBACKS No required setbacks, except as may be established pursuant 1o the Vail Village Urban Design Guide Plan and Design Consideralions. HEIGHT Building height regulations in the CC1 zone district are addressed specifically in the Vail Village Design Consideralions. The plan requires lhat 60% of the building may be built to a height of 33 feel or less while 40o/" ot the building may be built to a height of up to 43 feet. Currently,lhe Sitzmark Lodge exceeds ailowable height per both ratios. Staff believes this proposal would exacerbate the existing inconsistency between the Sitzmark Lodge and the building height guidelines for Vail Village. Therefore, staff believes lhis proposal is inconsistent with the objectives for building height outlined in the Vail Village Design Considerations. Allowable Height: Up to 43 feet Existing Height (Max.): 57.1 feet Proposed Dormer Height: 52.5 feet DENSITY CONTROL The CC1 regulations allow/require a maximum GRFA ratio of 80% and a maximum density of 25 units/acre. This application involves the utilization of approximately 256 square feet of "available" GRFA- The building is in conformance with the requirements lor density (both GRFA and units/acre). SITE COVERAGE The code allows a site coverage of B0% of lot area. This proposal will not add any additional sile coverage. The existing building conforms to site coverage restrictions for the CC1 zone district. LANDSCAPING AND SITE DEVELOPMENT Landscape objectives are outlined in the Vail Village Urban Design Guide Plan. However, this proposal will not impact those objectives. PARKING AND LOADING This proposal will not trigger the need for any additional parking or loading at this site. Compliance with the Vail Villaoe Urban Desiqn Guide Plan Staff believes this proposal is consistent with the "Gore Creek Drive/Bridge Street Sub- Area" objectives outlined in the Vail Village Urban Design Guide Plan. Compliance with the Urban Desiqn Considerations for Vail Villaoe and the Exterior Alteration Criteria. c. -4- '1 . Urban desion considerations. a. Pedestrianization b. Traffic penetration c. Accent elementsf. Landscape elements g. Service Staff resoonse - The Vail Village Urban Design Considerations state that 'Tor any single building a varied but simple composition of roof planes is preferred to either a single or a complex arrangement of many roofs." Staff believes this proposal complies with this element of the design guide plan. The Town of Vail Design Review Board, at its June 21"r meeting, found the proposal to be in compliance with the Town's guidelines for roof elemenls. Staff does not believe this proposal will impact any ol the other objectives outlined in the Vail Village Urban Design Considerations. D. Compliance with the Town of Vail Streetscape Master Plan. Upon review ol the Town of Vail Streetscape Master Plan, staff has determined that no recommended improvements or opportunities are directly related to the applicant's proposal. -5- E. Comoliance with the Vail Comprehensive Plan Vail Village Masler Plan The Vail Village Master Plan has been adopted as an element of lhe Vail Comprehensive Plan. The Vail Village Master Plan is intended 1o guide lhe Town in developing land use laws and policies for coordinating development by the public and private sectors in Vail Village and in implementing communily goals for public improvements. Most importantly, the Vail Village Master Plan shall serve as a guide to the staff, review boards, and Town Council in analyzing luture proposals for development in Vail Village and in legislating effective ordinances 1o deal with such development. For the citizens and guests of Vail, the Master Plan provides a clearly stated set of goals and objeclives outlining how the Village will grow in the fulure. Upon review of the Vail Village Masler Plan, the slaff believes the following goals, objectives and policies are relevant to the applicanl's request: Goal #1 Encourage high quality redevelopment while preserving the unique architectural scale of the Village in order to sustain its sense of communaty and identity. 1.1 Obiective: lmplement a consistent Development Review Process to reinforce the characler of the Village. 1.1.1 Policv: Development and improvement projects approved in the Village shall be consistent with the goals, objectives, policies and design considerations as oullined in the Vail Village Master Plan and Urban Design Guide Plan. 1.2 Obiective: Encourage the upgrading and redevelopmenl of residential and commercial facilities. 1.2.1 Policv: Addilional development may be allowed as idenlified by the Action Plan and as is consistent with the Vail Village Master Plan and Urban Design Guide Plan. VI. CRITERIA AND FINDINGS FOR A VARIANCE REQUEST A. Consideration of Factors Reqardinq Variance Requests: 1. The relationship ol the requested variance to other existing or potential uses and slructures in the vicinity. The exisling Sitzmark Lodge building, although non-conforming with regard to building height, is surrounded by buildings thal are as large or larger in scale. The Design Review Board found the proposed addition to be acceptable in terms of bulk and mass. Staff believes the proposed roof bump-out may help to break up some of the existing roof plane on the building. The use of the subject property (multi{amily residential) is consistent with the uses outlined for Vail Village and the Commercial Core I Zone District. 3. The degree to which relief from the strict and literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and unilormity ol treatment among sites in the vicinity or to attain the objectives of this title without a grant of special privilege. The "Special Privileoe" and "Hardship" lssues - The Planning and Environmental Commission has consistently held thal non-conforming properlies constructed legally prior to the adoption of zoning experience a hardship when more stringent regulalions render a building non-conforming (Maynor 1/10100 variance, for example). However, all properties within Vail Village are subject to the height provisions in the Vail Village Master Plan and the Vail Village Urban Design Guide Plan and Design Considerations. Staff believes any proposals for additional height should conform to the standards that are applied throughout the CC1 zone district. Therefore, staff does not believe this proposal meets the above-referenced criteria. Section 12-18-5 of the Vail Town Code states that "structures or site improvements which do not conform to requirements for setbacks, distances between buildings, height, building bulk control, or site coverage, may be enlarged; provided that the enlargement does not further increase the discrepancy between the lolal structure and applicable building bulk control or site coverage standards; and provided lhat the addition fully conforms with setbacks, distances between buildings, and height standards applicable to the addition." The intent behind this clause is to encourage the elimination of non- conforming properties through large-scale redevelopment. The effect of the requested variance on light and air, distribution of population, transportation and tralfic facilities, public facilities and utilities, and public safety. Staff does not believe this proposal will impact any of the above-listed facilities. New proposed building elements will be lower than the existing roof ridge of the building and will be set back a minimum ol 34 feel from property lines and 56 feet from the street edge. Such other factors and criteria as the Commission deems applicable to the proposed variance. Since this proposal is located in Vail Village, it is subject to the criteria and guidelines described in the Vail Master Plan and its assorted Vail Village elements. As mentioned previously, staff believes that the proposal does not substanlially comply with the Vail Village Urban Design Guide Plan and the Vail Village Design Considerations, with specific reference to the building height objectives outlined in the Vail Village Design Considerations The Plannino and Environmental Commission shall make the followino lindinos before orantino a variance: 1. That the granting of lhe variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of the variance will not be delrimental to the public health, safety or welfare, or materially inlurious 10 properties or improvements in the vicinity. 4. B. 3. That the variance is warranted for one or more of the following reasons: a. The strict literal interprelation or enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title. b. There are exceptions or extraordinary circumstances or condilions applicable lo the same site of the variance that do not apply generally to other properties in the same zone. c. The strict interpretation or enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district. o*noJULobzooo Sitzrnanlr.lndge SITZMARK AT VAIL REQUEST FOR A DORMER ADDITION The following statements address the nature of the variance requested and the relationship ofthe requested variance to other existing structures in the vicinity. There are only two buildings adjacent to the Sitzmark in the same zoning district -Gore Creek Plaza and the Lodge at Vail. Gore Creek Plaza" to the east, is the same height as the Sitzmark. About ten years ago considerable arnount of their roofwas raised, up to their ridgeline. The Lodge atVail exceeds the current zoning and is higher than the proposed dormer on the Sitanark. The ridge line of the dormer is two and a half feet below the existing Sitzmark ridgeline. There is no effect on light and air, distribution of population, transportation, traffic facilities, utilities, and public safety. There is no effect on Vail's Comprehensive Plan. This application is made under the dormer addition provision. The impact is only positive with respect to the neighbors. The view from the Gore Creek Plaza penthouse living room window is now a very large gravel roof with numerous pipes and ventilator outlets (see picture #1). With the dormer addition, their view will improve dramatically (see picture #2). The Lodge at Vail, Village Center, and RivaNodh Condominiums will have a smail, but positive, impact by breaking up the roofline. The Summers Lodge to the west will not see the dormer addition. It is the feeling of the applicant that the addition of the dormer is in keeping with the objectives of the dormer addition provision in that it will improve the appearance of the building to the public and the adjacent buildings. The smali height addition requested makes the total height of the Sitanark less than the building next door and is in keeping with the height of the adjacent buildings. Speciflcally, elevations of the roof ridge and eave on which your dormer is proposed will need to be surveyed. In addition, a spot elevation below the midpoint of the proposed dormer at the eave of the existing roof will need to be surveyed. The grades from the site plan you provided will be used to determine existing grade in all other locations on the building and will need to be superimposed onto a new site plan. On this new site plan based on the survey we are requiring, you will need to indicate the proposed elevations of the dormer. This should give us enough information to go through the variance process. More information may be required should any difficulties arise as part of the review process. In addition, the proposal could have fire and building code implications that will need further review by the Building Department. Once a formal application has been submitted to the Community Development Department, we will review the proposal for these issues. A construction traffic control/staging plan must be prepared on a separate sheet of paper, An approved site plan may also be used. This plan will expire on November lst and will need to be resubmitted for consideration for approval through the winter. Be aware that your resubmission for winter may be denied depending on the location of construction. Submit completed application to the Public Work's office for review. If required, locates will be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in the morning, but may require up to 48 hours to perform. The Public Work's Construction Inspector will review the application and approve or deny the permit. You will be contacted as to the status and any requirements that may be needed. Most permits are released within 48 hours of being received, but please allow up to one (1) week to process. C"org, Ruther, SenioiPlanner, Town of Vail,75 South Frontage Road, Vail; 479'2140' BACKGROUND: On 07113/00, I was requested by Sergeant Susan Douglas to contact Com-Dev Personnel to conduct follow-up invistigation ."giding activities ai the Noel Shop in Vail Village, which is owned by Mr. Erich Baumann. I went with Town Planner Mr. Brent Wilson, same related that a code enforcement officer was required because the Noel Shop was and has been in violation of three Town of Vail Municipal Codes. The violations are detailed as followed: 1 . Town of Vail Code 12- I 1-3B, Construction out of Conformance - deck was not built as per |2-78-|S,Unauthorized outdoor Activity . the illegal roasting and vending ll-5-2c,Unauthorized Signage - Sandwich Board Sign' on07/14/00,Mr. wilson and I took photos of the front area of the Noel Shop' as wcll as tht . . illegal deck and nut roastin! operations. Also there was a wooden partition or wall that was movable and was there to delineate between the deck and where the mLting of the nuts or food were prepared, that was in violation of Tovm Ordinances. Bauman was informed by Cerda that he was not allowed to sell or cook his nuts outside his business unless it was under a special event and he had permission from the special event coordinator to sell his nuts' OBSERVATION/INVESTIGATION : on 07115/00 at approximately 1200 hours, I saw Bauman cooking and selling his nuts outside of his store. There was no special event in Vail Village on 07l15i00. I contacted Bauman in his ,to.", u, Vail Code Enforcement Officer Jim Goff had told me that Bauman had received permission from the VVTCB (Vail Valley Tourism and Convention Bureau) to sell his nuts under a special events permit. I contacted Bauman and asked him whom he had spoken with at vvTcB- Bauman indicated that it was not the vvTCB but the wF (vail valley Foundation)' Bauman indicated that he spoke to someone on their cellular telephone. I asked if ire knew their name' He flung his hand at me jn a gesture to indicate that I did not need to know this information and said, 'ol'm not going to tell !ou." I informed Bauman that I felt that he was misinformed and I wanted to find out who gave irim misleading information, as I was trying to help him, as he was not supposed to be selling nuts on this date. I-explained to Bauman that there *as no special event in the village and that he was not allowed to sell his nuts, but yet if he }rad received infonnation liom one of those organizations' I would work with him regarding the selling of his nuts' Bauman then began to raise his voice at me inside of the Noel thog"an! stated that the Natzi's had already cited him yesterday into court for selling his nuts on July 4th.
