Planner: Bill Gibson SUMMARY The applicant, Donna Giordano, represented by VAG, Inc., is requesting final review of a conditional use permit, pursuant to Section 12-6D-3, Conditional Uses, Vail Town Code, to allow a Type ll Employee Housing Unit (EHU), located at 11O7 and 1109 VailValley Drive/Lot 7 and part of Lot 8, Block 6, Vail Village Filing 7. Based upon Staffs review of the criteria outlined in Section Vlll of this memorandum and the evidence and testimony presented, the Community Development Department recommends approval with conditions, of the requested conditional use permit subject to the findings and conditions noted in Section Vll of this memorandum. DESCRIPTION OF THE REQUEST The applicant, Donna Giordano,,represented by VAG, lnc., is requesting final review of a conditional use permit, pursuant to Section 12-6D-3, Conditional Uses, Vail Town Code, to allow a Type ll Employee Housing Unit (EHU), located at 1107 and 1109 Vail Valley Drive/Lot 7 and part of Lot 8, Block 6, Vail Village Filing 7. The applicant is proposing to construct a new single family residence accompanied by a 401 square foot Type ll EHU with 246 square foot, single car EHU garage. The total area dedicated to the Type ll EHU and garage would be 647 square feet. A vicinity map (Attachment A), the applicant's reguest (Attachment B), and architectural plans (Attachment C) have been attached for reference. BACKGROUND On Jufy 18, 2007 , the Design Review Board approved the plans for a new single-family residence with a Type ll EHU, contingent upon the applicant obtaining Planning and Environmental Commission approval of a Conditional Use Permit for the EHU ilt. lv.APPLICABLE PLANNING DOCUMENTS Title 12, Zoning Regulations, Vail Town Code ARTICLE 1 2-6E: TWO-FAMILY PRIMARY/SECONDARY (P/S) RESIDENCE (in part) 12-6E-1: P,JRPOSE: The two-family pimary/secondary residential distict is intended to provide sites for single-family residential uses or twofamily residential uses lh which one unit is a larger primary rcsidence and the second unit is a smaller caretaker apartment, together with such public facilities as may appropriately be located in the same zone distict. The two-family primary/secondary residential district is intended to ensurc adequate light, air, privacy and open space for each dwelling, commensurate with single-family and twofamily occupancy, and to maintain the desirable residential qualities of such sifes by establishing appropiate site d ev el opm e nt st a nd a rd s. CHAPTER 12-13, EMPLOYEE HOUSING: (in part) 12-13-1: PURPOSE: The Town's economy is largely touist based and the health of this economy is premised on exemplary seruice for Vail's guesfs. Vail's ability to provide such service is dependent upon a strong, high quality and consistently available work force. To achieve such a work force, the community must work to provide qualfi living and working conditions. Availability and affordability of housing plays a citical rcle in creating quality living and working conditions for the community's work force. The Town recognizes a permanent, year-tound population plays an important role in sustaining a healthy, viable community. Fufther, the Town recognizes its role in conjunction with the private sector in ensuring housing is available. The Town Council may pursue additional incentives administratively to encourage the development of employee housing unifs. Ihese incentives may include, but are not limited to, cash vouchers, fee waivers, tax abatement and in' kind seruices to owners and creators of employee housing units. The Town or the Town's designee may maintain a registry and create lrsfs of all deed restricted housing units created in the Town fo asstsf employers and those seeking housing. 1?-13-4: EHU Requirements by TyPe. The proposed Type ll EHU is located within the Two-Family Primary/Secondary Residential District. Therefore, this proposal is subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 12-16, Vail Town Code. A. Consideration of Factors Reqardinq Conditional Use Permits: 1. Retationship and impact of the use on the development objectives of the Town. When the Town Council adopted lhe Town of Vail Affordable Housing Study on November 20, 1990, it recognized a need to increase the supply of locals/employee housing units. The Town encourages EHUs as a means of providing quali$ living conditions and expanding the supply of employee housing for both year-round and seasonal local residents. The proposed unit will have a positive impact on the Town's rental housing needs. 2. The effect of the use on light and air, distribution of population' transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff believes that there will be an insignificant impact from the proposed Type ll EHU on light, air, population, transportation, utilities, schools or parks' 3. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access' maneuverability, and removal of snow from the street and parking areas. Two additional vehicles are anticipated in association with this EHU, and the applicant is proposing to accommodate this anticipated parking demand. Staff believes that this proposal will have an insignificant impact to the above- referenced criteria. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. The EHU will be located within a proposed new single-family residence. Staff believes that the Design Review process will ensure that the proposed EHU will not significantly impact the scale and bulk of this project in relation to 4 5. surrounding uses, and that the proposed EHU will be consistent with the development standards applicable to this property. The proposed EHU meets the Town's requirements for zoning, ownership/transference, GRFA, garage crediUstorage, and density. a. Zonino districts oermitted bv riqht or bv conditional use A Type ll EHU is a conditional use in the Single-Family Residential, Two Family Residential, Primary/Secondary Residential, and Agriculture & Open Space zone districts. The subject proper$ is zoned Two-Family Primary/Secondary Residential. b. Ownership/Transference n tipe ll EHU shall not be sold or transferred separately from the unit it is associated with. The applicant is not proposing to sell or transfer the EHU separately from the primary dwelling unit. c. Additional GRFA The EHU is entitled to a 550 sq. ft. GRFA deduction' The applicant is proposing to utilize 401 sq. ft. of that deduction. d. Garaqe GrediUStoraqe Requirement n SOO sq.tt. garage area GRFA deduction is allowed for the EHU. lf the applicant choosesnot to construct a garage for the EHU, then a 75 sq. ft. storage area is required. The applicant is proposing to construct a 246 sq.ft. garage for the EHU. e. Parkinq The parking requirements for EHUs are subject to the regulations of Chapter 12-10, Vail Town Code. This EHU is proposed to be 401 sq' ft. in size, therefore two parking space are required. The applicant is proposing to provide one enclosed and one unenclosed parking space. f. Minimum/Maximum GRFA of an EHU Type ll EHUs are allowed with a minimum of 300 sq. ft. of Gross Residential Fioor Area (GRFA) and a maximum of 1,200 sq.ft. of GRFA. The proposed EHU will be 401 sq. ft. in size. g. Densitv The applicant is proposing to construct a single-family dwelling unit and one Type ll EHU on this site. Pursuant to Section 12-13-4, Vail Town Code, a Type ll EHU will not count as density and is allowed as a ihird dwelling unit on a property in the Two-Family Primary/Secondary Residential district. VIII. STAFFRECOMMENDATION The Community Development Department recommends approval with conditions of a request for a final review of a conditional use permit, pursuant to Section 12-6D-3, Conditional Uses, Vail Town Code, located al1107 and 1109 Vail Valley Drive/Lots 7 and 8, Block 6, VailVillage Filing 7, and setting forth details in regard thereto and setting forth details in regard thereto. Staffs recommendation is based upon the review of the criteria in Section Vll of this memorandum and the evidence and testimony presented. It is our intent that this letter will detail and clariff what we believe is the intent of this request. The Owner's and design team associated with the Giordano Residence endeavor to place restrictions on the use of an apartnent located ion their Property for the benefit of the Owner and the Town. In doing so, we will dedicate a Type II EHU as part of the newly desiped home. This use will pose no adverse effect on the light and air, tansportation facilities, utilities, schools parks and recreation facilities or other public facilities. Likewise, this use will have no inqract on traffic or congestion, pedestrian safety and convenience, flow and contol, access, maneuverability or removal of snow. The incorporation of this EHU will be in context with the surrounding neighborhood and will not irpact the overall scale and bulk of the new home. The following is a summary of the comments from that review: 1. The employee housing unit requires Planning and Environmental Commission approval of a Conditional Use Permit and the unit will be subject to a Type ll EHU deed resttiction. Final design review approval can not be issued until a Conditional Use Permit application is submifted and approval is obtained.2. The plans must be corrected to comply with the maximum GRFA limit of 6,559 sq. ft. The submitted lower level GRFA calculations are not accurate. The lowesl level GRFA is calculated as follows: 3,092 total sq. ft., minus the 600 sq. ft. garage deduction, minus the 350 sq. ft. EHU deduction, minus the 300 sq. ft. EHU garage deduction, equals 1,842 sq. ft. The basement deduction is applied to this remaining area. 1,842 sq. ft. multiplied by O.a4 equals 81 1 sq. ft. of GRFA on the lower level (not 1 10 sq. ft.). 3. Submit redlined plans showing the landscape area calculations. 4. Submit redlined plans showing the site coverage calculations. 5. Submit stamped engineering drawings for retaining walls with a height greater than four feet and all combination retaining walls.6. Submit building cross-section drawings. 7. An exterior color and materials sample board must be submitted prior to the Design Review Board hearing. 8. Site Plan:. The site plan must be printed to scale.. Label all property and setback lines.. Please be aware that all chimney shrouds must be UL listed. 12. Exterior Lighting:o No more than one non-exempt exterior light is allowed per 1,000 sq. ft. of lot size. Therefore, the lighting plan must be correcled to have no more than 15 non-exempt exterior lights..
