Planner: Bill Gibson PEC Fee Paid: $650.00 TO: FROM; DATE: SUBJECT: MEMORANDUM Planning and Environmental Commission Community Development Department August 23,2004 A request for a conditional use permit, pursuant to Section 12-6H-3, Conditional Uses; High Density Multiple Family, Vail Town Code, to allow for a public utility and public services use, located at 501 North Frontage Road (Solar Vail Condominiums/ Lot 8, Block 2, Vail Potato Patch Filing 1, and setting forth details in regard to. Applicant: Verizon Wireless, represented by Kelly Harrison, Closser ConsultingPlanner: Clare Sloan I. SUMMARY The applicant, Verizon Wireless, represented by Kelly Harrison, is requesting a conditional use permit pursuant to Section 12-16-2, Conditional Use Permit of the Vail Town Code. The conditional use is requested to allow the applicant to modify the location existing cellular equipment and to add equipment with screening on the Solar Vail building located at 501 North Frontage Road / Lot 8, Block 2, Vail Potato Patch (Attachment A). Based upon Staffs review of the criteria in Section Vlll of this memorandum and the evidence and testimony presented, the Community Development Department recommends approval of this request subject to the findings and conditions noted in Section lX of this memorandum. II. DESCRIPTION OF REQUEST The subject property is zoned High Density Multiple-Family (HDMF) district, which lists "public utilities and public services" as a conditional use under Section 12-6H-3, Conditional Uses of the Vail Town Code. Conditional Use Permits have been previously granted for cellular equipment on the Solar Vail Condominiums located at 501 N. Frontage Road. The applicant is proposing to enlarge the false chimney on the west building elevation, to add a new chimney to the east elevation, and to change the location and height of existing whip antennas. The false chimneys, which will be partially constructed of RF-transparent material, will each house four panel antennas. A copy of the proposed plans for the roof top equipment and chimneys are attached for reference as well as photographic simulations of the proposed changes (Attachments C and D). The Design Review Board favorably received the appearance of the building modifications during conceptual review gn June 16,2004 and the proposal is scheduled for final review on September 1,2004. ilt.BACKGROUND This property is zoned High Density Multiple-Family district and was annexed into the Town by Ordinance 8 of 1969 which became effective on August 23, 1969. On October 8, 1990, the Planning and Environmental Commission approved a conditional use permit for U.S. West to install satellite dishes on the east and west sides of the building which were hidden behind false chimneys on both sides running the height of the building and the construction of a mechanical buiHing on the east side of the building. This approval allowed for the installation of the first cellular facility on the building. On May'l.1, 1992, the Planning and environmental Commission approved a conditional use permlt and variances for U.S. West to expand its previously approved facility. The variances were granted to allow additional satellite dishes on the site and to allow for them to exceed the maximum height for mounting satellite dishes. On August 28, 1995, the Planning and Environmental Commission approved a conditional use permit to allow for a second cellular phone facility to be located on the Solar Vail building roof which was operated by OneComm Corporation. OneComm's equipment is located on the western end of the building and is now owned by Nextel. On August 25, 1997, the Planning and Environmental Commission approved a conditional use permit to allow for the installation of a third cellular facility on the Solar Vail site to Western Wireless PCS. On October 27, 2003, the Planning and Environmental Commission approved a conditional use permit for the replacement and upgrading of cellular equipment for Nextel (previously owned by OneComm). On June 16, 2004, the Design Review Board conceptually reviewed the proposed cellular equipment. IV. ROLES OF REVIEWING BODIES Order ot Review; Generally, applications will be reviewed first by the Planning and Environmental Commission for acceptability of use and then by the Design Review Board for compliance of proposed buildings and site planning. Planning and Environmental Commission: Action: The Planning and Environmental Commission is responsible for final approvaUdenial/approval with conditions of Conditional U se Permits. The Planning and Environmental Commission is responsible for evaluating a proposal for: 1. Relationship and impact of the use on development objectives of the Town. 2. Effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs. 3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the streets and parking areas. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to sunounding uses. 5. Such other factors and criteria as the Commission deems applicable to the proposed use. 6. The environmental impact report concerning the proposed use, if an environmental impact report is required by Chapter 12 of this Title. The Design Review Board is responsible for evaluating the proposal for: Architectural compatibility with other structures, the land and surroundings Fitting buildings into landscape Configuration of building and grading of a site which respects the topography Removal/Preservation of trees and native vegetation Adequate provision for snow storage on-site Acceptability of building materials and colors Acceptability of roof elements, eaves, overhangs, and other building forms Provision of landscape and drainage Provision of fencing, walls, and accessory structures Circulation and access to a site including parking, and site distances Location and design of satellite dishes Provision of outdoor lighting The design of parks Town Gouncil: Actions of Design Review Board or Planning and Environmental Commission may be appealed to the Town Council or by the Town Council. Town Council evaluates whether or not the Planning and Environmental Commission or Design Review Board erred with approvals or denials and can uphold, uphold with modifications, or overturn the board's decision. Staff: The staff is responsible for ensuring that all submittal requirements are provided and plans conform to the technical requirements of the Zoning Regulations. The staff also advises the applicant as to compliance with the design guidelines. Staff provides a staff memo containing background on the property and provides a staff evaluation of the project with respect to the required criteria and findings, and a recommendation on approval, approval with conditions, or denial. Staff also facilitates the review process. V. APPLIGABLE PLANNING DOCUMENTS TOWN OF VAIL ZONING REGULATIONS 12-6H: High Density Multiple-Family Zone District 12-6H-1: Purpose: The high density multiple-family district is intended to provide sites for multiple-family dwellings af densilies to a maximum of twenty five (25) dwelling units per acre, together with such public and semipublic facilities and lodges, private recreation facilities and related visitor oriented uses as may appropriately be located in the same distict. The high density multiple-family distict is intended to ensure adequate light, air, open space, and other amenities commensurate with high density apaftment, condominium and Iodge uses, and to maintain the desirable residential and resort qualities of the district by establishing appropriate site development standards. Ceftain nonresidential uses are permifted as conditional uses, which relate to the nature of Vail as a winter and summer recreation and vacation community and, where permifted, are intended to blend harmoniously with the residential character of the district. 12-6H-3: Conditional Uses: The following conditional uses sha// be permifted in the HDMF distict, subject to rssuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Bed and breakfasf as fufther regulated by section 12-1+18 of this title. Type lll employee housing units (EHU) as provided in chapter 13 of this title. 12-6H-7: Height: For a flat roof or mansard roof, the height of buildings shall not exceed forty five feet (45'). For a sloping roof, the height of buildings sha// not exceed forty eight feet (48'). 12-16: Gonditional Use Permits 1 2-1 6-1 : Purpose; Limitations: In order to provide the flexibility necessary fo achieve the objectives of this title, specified uses are permitted in certain dlsfrlcfs subject to the granting of a conditional use permit. Eecause of their unusual or special characteristics, conditional uses require review so that they may be located properly with respect to the purposes of tf,,'s title and with respecf to their effects on sunounding properties. The review process prescnbed in this chapter is intended to assure compatibility and harmonious development between conditional uses and sunounding propefties in the Town at large. Uses /isfed as conditional uses in the various dr.sfnbts may be permifted subject to such conditions and limitations as the Town may prescibe to insure that the location and operation of the conditional uses will be in accordance with the development objectives of the Town and will not be detrimental to other uses or properties. Where conditions cannot be devised, to achieve these objectives, applications for conditional use permits shall be denied. 12-16-5: Planning and Environmental Commission Action: Possible Range Of Action: Within thirty (30) days of the application for a public heaing on a conditional use permit, the planning and environmental commission shall act on the application. The commission may approve the application as submifted or may approve the application subject to such modifications or conditions as ff deems necessary to accomplish the purposes of this title, or the commission may deny the application. A conditional use permit may be revocable, may be granted for a limited time peiod, or may be granted subject to such other conditions as the commission may prescribe. Conditions may include, but shall not be limited to, requiring special setDackg open spaces, fences or walls, landscaping or screening, and street dedication and improvement; regulation of vehicular access and parking, signs, illumination, and hours and methods of operation; control of potential nuisances; prescription of standards for maintenance of buildings and grounds; and presciption of development schedules. Variances: A conditional use permit shall not grant variances, but action on a variance may be considered concunently with a conditional use permit application on the same sffe. Variances shall be granted in accordance with the procedure prescribed in chapter 17 of this title. 12-16-8: Permit Approval and Effect: Approval of a conditional use permit shatt tapse and become void if a buitding permit is not obtained and construction not commenced and diligently pursued toward completion or the use for which the approval has been granted has not commenced within tvvo (2) years from when the approval becomes final. CRITERIA AND FINDINGS The review criteria for a request of this nature are established by the Town Code. The proposed use is located within the High Density Multiple-Family zone district. Therefore, this proposal is subject to the issuance of a conditional use permit in accordance with the provisions of Chapter 12-16, Vail Town Code. A. Consideration of Factors Reqardinq Conditional Use Permits: 1. Relationship and impact of the use on the development objectives of the Town- Staff believes that the proposed use is compatible with the existing condominium use, and is generally consistent with the purpose of this zone district provided that the cellular transmitting and receiving equipment screened. The false chimneys are architectural features consistent with the residential complex, which will lessen the visual impact of the panel antennas (Attachment E). I The condominium building has been subject to numerous Conditional Use Permits relating to cellular equipment. Although screening is proposed with this proposal, the cumulative impacts of the future eouipment could adversely affect the residential character of the site. tx. 2. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff believes there will not be a negative impact on the above- referenced issues. 3. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking areas. Staff believes there will be little to no impact on the criteria listed above based on the location of the equipment and the manner in which they are to be screened. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses, Staff believes the proposed chimneys, which will enclose four panel antennas, has been designed in a way to compliment the existing Solar Vail building. The proposed chimneys should have little or no negative effect on surrounding properties and uses. B. The Planninq and Environmental Commission shall make the followinq findinos before qrantinq a conditional use permit: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the High Density Multiple-Family zone district. 2. That the proposed location of the use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. That the proposed use will comply with each of the applicable provisions of the conditional use permit section of the zoning code. STAFF RECOMMENDATION The Community Development Department recommends approval of a conditional use permit, to allow for a the location and height change of existing whip antennas and the addition of new screened cellular equipment, located at the 501 North Frontage Road (Solar Vail Condominiums/ Lot 8, Block 2, Vail Potato Patch 1't Filing. Staffs recommendation is based upon the review of the criteria in Section Vlll of this memorandum and the evidence and testimony presented, subject to the following findings: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the High Density Multiple-Family zone district. 2. I received a letter on 6116104 from Clare Sloan of the Town of Vail stating that the following violations must be cured before my application to modin the existing Verizon Wireless cell site can move any further within the Planning Department. As of today I have received one of three required approvals. 1). Flood lights. Nextel's zoning approval was conditioned upon Nextel replacing the flood lights, but the work was never completed. The Town has faxed me a document listing Town-approved lighting fixtures that I can fax to you for review. 2). Outdoor storage. The letter also stated that the outdoor storage of furniture and flower boxes must be removed from the required parking for the condominiums. I would like to get these items taken care of as soon as possible so my zoning application will not be held up any further.
