The purpose of a pre-application meeting is to identify any criUcal issues pertaining to the applicanff proposal and to determine the appropriate development review process for an application. In many cases, the pre.applicationi meeting helps to expedite the development review process as critical issues are idenUfied and dealt with in the preliminary stages. A complete applicaUon form and all accompanying material must be accepted by the Community Development Department prior to application deadlines. A schedule of DRB meetings and associated application deadlines may be found on the World Wide Web at www.vailqov.com For a new residential development the application deadline is typically 3.5 weeks prior to a Design Review Board hearing. Review Criteria The proposal will be reviewed for compliance with the Design Guidelines as set forth in Tltle t2, (Toning Regulations) and Tltle 14 (Development Standards) of the Town of Vail Municipal Code. Recuirements for properties located in hazard areas If a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rocKall, debris flow, floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific geological investigation. If a site-specific geological investigation determines that the subject property is located in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the hazard repoft prior to the issuance of a building permit. Applicants are suongly encouraged to consult with Community Development stafi prior to submitting a DRB application to determine the relatonship of the property to all mapped hazards. Page 9 of r2lO2lOTl1z Desion Review Board Meetino Reouirements For new construction and additions, the applicant must stake and tape the project site to indicate property lines, proposed buildings and building corners. All trees to be removed must be taped. The applicant must ensure that staking done during the winter is not buried by snow, All site tapings and staking must be completed prior to the day of the DRB meeting. The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants who fail to appear before the Design Review Board on their scheduled meeting date and who have not asked in advance that discussion on their item be postponed, will have their items removed from the DRB agenda until such time as the item has been republished. If the DRB approves the application with conditions or modifications, all conditions of approval must be resolved prior to the issuance of a building permit. Staff Approval The Administrator (a member of the planning staff) may review and approve Design Review applications, approve with certain modifications, deny the application, or refer the application to the Design Review Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision is subject to final approval by the DRB. Additional Review and Fees If this application requires a separate review by any local, state or Federal agency other than the Town of Vail, the application fee shall be increased by $200.00. Examples of such review, may include, but are not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc. The applicant shall be responsible for paying any publishing fees in excess of 50o/o of the application fee. If, at the applicant's request, any matter is postponed for hearing, causing the matter to be re-published, then the entire fee for such re-publication shall be paid by the applicant. Applications deemed by the Community Development Department to have design, land use or other issues, which may have a significant impact on the community, may require review by external consultants in addition to Town staff. Should a determination be made by Town staff that an external consultant is needed, the Community Development Department may hire the consultant. The Department shall estimate the amount of money necessary to pay the consultant and this amount shall be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay expenses incurred by the Town in excess of the amount forwarded by the application to the Town within 30 days of notification by the Town. Any. excess funds will be returned to the applicant upon review completion. As you requested, I inspected and evaluated the two Colorado spruce trees located on the southeast comer of Building A at the Seasons in Vail, Colorado. During our April 29 phone conversation, you expressd conoem about the fees and howthe are preventing snourfrqn meltir€ on the roof and causing damage to the structure. You also told me that the homeovners are concemed that the trees have grown into the parking lot and have blocked the sidevrralk. You requested that t inspecn the bees and offer recommendatbns to albuv snov to shed from the roof and provide sidewalk aocess- The trees are both Golorado spruce trees (Picea pungens). Tree #1, the westem most tree is 20.5 inctres in diameter, measured at4.5 feet above the ground and 55 feet tall- This tee has a branch spread of 28 feet and a live cro,vn ratio of 900/0. Tree#2, the eastem most tree is 15.8 incfres in diarneter and 45 feet tall. The tree has crown spread of 18 feet and a tive crown ratio of 90016- Both trees have spruce scales on the lower foliage. The infestation is light and is not a serious problem at this time. The snow is building-up on the roof near the trees because the trees are blocking the southem sun in the winter months. You installed heat tape but this did not solve the problem and the roof sustained significant damage this past winter. The other problenr created by the trees is that the crorn has grovvn over the sidewalk and into the parking lot The trees have been pruned to provide parking but stifl block the siderralk. ln the winter this creates a safety hazard since the pedestrians have to rlralk onto the parking lotto access most of the parking spaces. The Design Review Board denied the proposal for several reasons: 1) The problems associated with the existence of the trees (the impediment of pedestrian mobility, the lack of views for the residents on the southeast side of the building, and the buildup of snow and ice on the roof during the winter months) were deemed insufficient in justifying the removal of the trees: 2) The re-vegetation plan proposing sod, potentilla bushes, and an unspecified numberof aspen trees is an insufficient substitute for the beautiful spruce trees that currently exist. The Minutes from the last Board Meeting were unanimously approved. Discussed were radon and hiring of Leading eagte tein. Vail Home Rentals proposed spending $11,000 to get the problem solved. Further recommended by Vail Home Rentals that they do the repairs and touch-up after the radon company completed its job. On a motion from Fred, ail Home Rentals is to hire LET for their bid of $11,000 and Vail Home Rentals would do all other items on a time and materials basis. This estimate was $7,000. The job is to be completed as soon as possible. Linn seconded the motion and it carried unanimously. There was a motion made to get the gutter work done on E Building at the proposed price o $2,743. This was one of several bids. The motion further stated that the work on the D Building electrical panel be done for the price of $4,47O. The motion was duly seconded by Linn and unanimously passed' (Talk to Fred Wyman before proceeding on the G Building panel that was approved for a cost of $7,500. This was unanimously approved). Fred Wyman told Larry Barnes that the stairs should not have taken so long to complete. He said the same about ihe radon mitigation. Diana Donovan has indicated that he condominium association in the area is interested in contributing some money towards making some improvements to Chalet Road. I imagine some money from the Town of Vail would also be necessary. She has told me that the association is willing to contribute approximately $10,000.00. At this time, I have nothing in writing from the condominium association. However, it sounds like hey are interested in participating. Diana would like to meet with someone who could give her a general estimate of what the landscape improvements and changes to the road might cost. I am wondering if it would be possible for someone from Public Works to meet with Diana on the site lo go over some of the improvements they are considering. These improvements were originally proposed when the Golden Peak ski base area was going to be redeveloped by Vail Associates. Please let me know how you feel about this issue. lt seems like a meeting with Diana is in order. lf you leel that a planner should also attend the meeting, one of the ComDev planners would be happy to attend.
