WW lhvvru ilsw''tt fi'r AtAw,7-2^ SLIBJECT: PEC notifrcation of staff approval for Minor Amendment to SDD Y22 - 365 Vail Valley DriveA,ot K, Block 5-A, Vail Village 5th Filing, Garden of the Gods, to change the approved suwey for the p'rojecr The staff recently approved a rcquest for a Minor Amendment to the Garden of the Gods, Special Development District 1f22, to change the approved survey for the projecr The staff felt that this amendment was neressary becausc there were two differcnt surveys for the property done by two different suneyon that indicated different line lengths for the east and west property lines. Neither surveyor feels that their survey is incorrect. This amendment will change the recognized to the latest survey done for the project by Robillard and Associates. The Town requires that an Improvement Location Certilicate (I.L.C.), which locates the building foundation and property lines, be submitted for all new construction. Upon review of the I.L.C. for the project completed by Robillard and Associates, a line length discrepancy between the original survey and the I.L.C., for the east and west properry lines, was discovered. The result is a 6" to 12" discrepancy between the proposed and existing setbacks from the property lines. In relationship to the north and west setback, the building is located as proposed- The PEC proposal located the northwest building corner 2 feet from the west property line and the north elevation 4 feet from the north propety line. Thcse disunces are correct on thc IJ,.C. Other minor (no more than 12") discrepancies occur in other areas on the propeny. The total size of the building is the same. The form shown on the II.C. differs from the site plan because the complete foundation is represented, including elements which are below grade. The ridge location should be corrcct because the building is in the proposed location as related to the preexisting building and existing curb lines. On the amended I.L.C. dated August 8, 1991, the top of the ridge beam was indicated at 219.2 fent. There will be an additional .4 feet added for roofing material for a total height of 219.6 which is the maximum ridge height allowed to not encroach into view corridor #5 as indicated by Eagle Valley Surveying. At this time the LL.C. document has not been received, the ridge height information was relayed by the architect Any ridge height error which may occur would not be generated by this survey discrepancy. Certification will be required showing that the ridge line is not in the view corridor when the roof is completed. Under Section 18.40.020 (B) of the Town's Municipal Code, the saff may approve minor amendments to Special Development Disuicts. After speaking with Pam Hopkins, she indicated that Robillard and Associates felt that there was no error in their survey. I am unsure of the source of the differences. However, I find it necessary to require that the source of the discrepancy be addressed immediately, and have notified the building department to not schedule any inspections after Wednesday, July 17 until the source is identified and rectified. Since the location of the ridge is dictated by the view coridor, the original approval was given based on a specific location and height of the ridge as it related to the view corridor. I find it necessary to require that the view conidor be verified and certified at the time that the ridge beam is installed in addition to the required l.L.C. Once the source of the survey discrepancies are found, it may be necessary to complete a minor SDD amendment if the final location of the buiding ditfers by more than one foot from the approved drawings for the project. On Snowdon and Hopkins' site pJ-an, ldated, 2/1'4/91') we called for the NW building corner to be 2'-0" from the west propertY line. The ILc confirms the building is 2'-Q" away. The north side of the building was called out to be 4' from the north property line which curves. The ILC measured from the NE building corner 4.8' to the propert.y fine. This .8' diffei:cnr:e is due to the curve of the of the property line. We believe the building i-s just where it should be and LhaL thtl critical ridge is where it is shown on Snowdon and Hopkine' site p1an. 2. The SE corner of the building was not tied down on the Snowdon and Hopkins'site plan (because it was nol critical to the approvals at the tirne). It does scale on tire print at about 2' more than what the ILC 6tates. The ILC was done by Robil-Lard and Associates and Snowdon and Hopkins used a topo print by Eagle VaIley Surveying. Both f irms have r:e,riervecl tlteir calculations and sr:end by their work. As we discussed, the Town should adopt the Robillard ILC as a clarification survey to the Snowdon and Hopkins site p1an. A minor amendrnent to the SDD may be required, but only as a clarification, not a change. The building is where it is supposed to be. Because the building is the correct size and in the correct Iocation, the discrepancy in the prints, when scaLed, is of no reLevance. If you have any questions please let me know.
