Also we would like to change the locations and total number of poles at the entrance. We are requesting to reduce the total number of poles from six poles to four poles, which would make the new location above the entrance of the Vail Village parking structure, please refer to photos. BACKGROUND AND DESCRIPTION OF THE REQUEST The applicant is proposing the establishment of a video game arcade within an existing vacant office space on the fourth level of the Vail Transportation Center (TRC). The TRC is zoned'General Use" and 'major arcades'(more than 4 video games) are an allowed conditional use within the zone district. The applicant's proposal involves lhe placement of 6 video games at this location. The property is owned by the Town of Vail and leased through the Vail Transportation Department. II. REVIEWNG BOARD ROLES.CONDITIONAL USE PERMIT Order of Review: Generally, applications will be reviewed fhst by the PEC for acceptability of use and then by the DRB for compliance of proposed buildings and site planning. Planning and Environmental Commission: Action: The PEC ls responsible for final approval/denial of CUP. The PEC is responsible for evaluating a proposal for: 1. Relationship and impact of the use on development objectives of the Town. 2. Effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs. 3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the streets and parking areas. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to sunounding uses. 5. Such other factors and criteria as the Commission deems applicable to the proposed use. 6. The environmental impact report concerning the proposed use, if an environmental impact report is required by Chapter 12 of this Title. Conformance with development standards of zone district - Lot area - Setbacks - Building Height - Density - GRFA - Site coverage - Landscape area - Parking and loading - Mitigation of development impacts Desiqn Review Board: Action: The DRB has NO review authority on a CUP, but must review any accompanying DRB application. Staff: The staff is responsible for ensuring that all submittal requirements are provided and plans conform to the technical requirements of the Zoning Regulations. The staff also advises the applicant as to compliance with the design guidelines. Staff provides a staff memo containing background on the property and provides a staff evaluation of the project with respect to lhe required criteria and findings, and a recommendation on approval, approval with conditions, or denial. Staff also facilitates the review process. Town Gouncil: Actions of DRB or PEC maybe appealed to the Town Council or by the Town Council. STAFF RECOMMENDATION The Community Development Department recommends that the Planning and Environmenlal Commission approve the applicant's request for a conditional use permit to allow for the establishment of a major arcade at the Vail Transportation Center, based on the following findings: 1 . That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the district in which the site is located. 2. That the proposed location of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. tv. The Vail Land Use Plan places a "Semi-Public/Village Master Plan'designation on this property. This designation includes "...municipal facilities and other public institutions which are located throughout the community to serve the needs of residents." If yes was answered to any of the questions then a "Public Way" is required. You can pick up an application at either Community Development, located at 75 South Frontage Road or Public Works, located at 1309 Vail Valley Drive. Notice sign offs for utility companies. All utilities must field verify (locate) respective utilities prior to signing application. Some utility companies require up to 48 hours notice to schedule a locate. A construction traffic controVstaging plan must be prepared on a separate sheet of paper. An approved site plan may also be used. This plan will show locations of all traffic control devices (signs, cones, etc.) and the work zone, (area of Construction, Staging, etc.). This plan will expire on November I st and will need to be resubmitted for approval through the winter. Sketch of work being perficrmed must be submitted indicating dimensions (length, width and depth of work). This may be drawn on the traffrc control plan or a site plan forthejob. Submit completed application to the Public Work's office for review. If required, locates will be scheduled for the Town of Vail Electricians and Irrigation crew. The locates take place in the rnoming, but may require up to 48 hours to perform. The Public Work's Construction Inspectcir will review the application and approve or disapprove the permit. You will be contacted as to the status and any requirements that may be needed. Most permits are released within 48 hours of being received, but please allow up to one (l) week to process. As soon as the permit is processed, a copy will be faxed to Community Development allowing the "Building Permit" to be released. Please do not confuse the "Public Way Permit" with a "Building Permit" which is to do work on a project itself. NOTE: The above process is for work in a public way ONLY.
