Schrnidt, ?his letter is in response to your letter dated January 24, 1990 addressed to Karen Morter of the Vail Chanber of Commerce. It has been turned over to me to review for compliance with our building codes. I conducted an inspection on February 28, 1990 of the fanily suite at the Gasthof Gramsharnmer Hotel in Vail , Colorado. My findings are as follows: 1,. The elevator provides service up to the fourth floor. Although this is inconvenient, it is not a code violation. 2. The windows that are I ft. above the floor are allowed as long as they are operable from the inside. 3. In your letter you stated that a hotel such as this in New York would be illegal . Colorado uses the L988 Unifonn Building Code. the Uniform Building Code only requires that sleeping rooms below the fourth story have egress windows. This is found in Section L2O4. Two exits are required for levels above the first floor. This unit is in compliance with Appendix Chapter 1, Section lLL (a). There is a ladder on the floor by the dining table that would take you into the corridor that connects to the Znd stairway and out of the building. -1- a I t Page 2 Gasthof Gramshamner Hotel I also reconnended to the owner, Pepi Gramshammer, that an exitgraphic be pJ.aced on the entry door that will inform occupants of the ladder that is to be used if the nain exit is blocked. I also recomnended that the ladder be painted red with sign designating it as an rrEmergency Exit Ladderrr. I hope f have answered all of your concerns. This approvalwas given with the condition that the applicanis present an alternative plan, providing an adequate amount of landscaping to compensate for the three (3) trees which were cut down. The DRB believed that the existing landscaping was attracti\re and that the Gasthot Gramshammer did not need more landscaping to improve its appearanc€. f''r in Staff's have been fl*'f -s- r1 Site Visit: Tupy Residence (1901 Chamonix Lane)q4icr\ : Prepare to discuss, , an appeal by neighbors of a PEG Tupy; Appellants: Marka Moser, Cynfiia for a front setback variance a proposed primary residence at 1901 Chamonix on August 12, 1991/the PEC voted +3 to approve the front setback request;the neighbors are now the PEC . As you are aware, the T-own - council did call up the Design Review Board approval of the final landscape plan. I understand you have already planned several engagements which conflict with Town Council hearing dates. Unfortunately, the Town of Vail Code requires that the Council reviews items within 30 days of the call up. As a result, this item must be scheduled for Council either August 20, September 3 or September 17, 1991. The staff is willing to coordinate one of these hearings with your schedule, as long as we can work witr these three dates. I am sure you will want to be present for the Council review, so I hope you can work with one of these dates. You may also send a representative to the meeting instead of attending yoursetf, if you prefer. The representative needs to be able to respond to any issues me CounCit may have. The obviousones relate to pure landscape elements and security. Another reasron is the result of the new, high tech window fenestration and, particularly, sophisticated glazing systens. These new appli-eations are very effective in removing ultraviolet rays; they do,however, have one drawback, During the day, one can see outsidedue to the natural sun light, but without this illunination atnight the glass becomes reflective and dark, resulting in a very coJ.d edge to a room hrhere the wall and glass become solid eLenents.ft becomes necessary to introduce sone exterior lighting to openthe room, so to speak, soften the effect, and extend the space tothe outside. This lighting can be subtle. In all of these cases, E-eI!@, and lirnj-ted to exterior lighting can be low level , hori-a specific candle Dovirer. wittr this premise in nind, we suggest that the new guidetines bepositLve and stress the following areas: - Horizontal lighting shall be pernitted with a high restric-tion of not more than 8 feet. - Such lighting shal1 be used to accent features such as drive-ways, walks and landscape features, and trees. - The light source or rrhot spotrr rnust be screened fron view ttherever possible within the property and nust not be seenfron adjacent property owners. - Uplighting shall be discouraged. - Vertical llghting, such as on buildings and trees, shall notbe perroitted except by special approval fron the DRB. - Specific candle powerr/light intensity.and light color shouldbe addressed, i.e. L to 2 candle powei and soft white fight. - A11 installation shaLl consider the inpact in both sunmer andninter when leaves and snow may cause dLfferent and, perhaps, undesirable effects. In sunmary, we feel that exterior lighting can be a very attractivefeature and, when installed correctly, it can fit. in conpatiblywithin a neighborhood and adjacent to spaces. Itnder no circum-stances should lighting be offensive or installed in a ilIook at Dert, self serving manner. oo tr,l XF'- Y<o =oz ut<F-E .aFrd (', vz(JF -lO Jn7J LUo-.O r_lrJ2z arl< trtrI; ']'il Fh uJ-1fif.3i;b;jI Ei:]e f $t ..\l I I E s 6 lo B iIp f; sg-old$ 5PrDt FO.ftO 9s 3$ HA g$ bQ {tu sf T 9Fhl af !t >.s .-r hl-2=F-,rlu<r.2ldhl AATET $ * $ R b R o stl -_lrr+(,T' =\9 ooO :O(! o) llc{ ='o'o oo beoz I t o(L UJF af, I \ I I I I ; co) ^irn 33Ur-S 39CrU8 ,6 6C , ?'zE I o sf IJ l E. The Connercial Core I District is intended to insure adequate light, aJ-r, open space and other amenities appropriate to the pernitted tlpesof buildings and uses. The district regulations in accordance with the Vail Village urban design guide plan and design considerations prescribe site development standards that are Lntended to insure the rnaintenance and preservation of the tightly clustered arrangements of buildings frontJ-ng on pedestrianways and public green ways, and to lnsure continuation ofthe building scale and archltectural gualities thatdistinguish the Village.r' A detaited analysis of the way the proposal conplies withthe architectural standards of Vail Village and purpose section of the CcI zone distrlct is provided below. The commercial ski storage use is stipulated as an allowed use, under Section La.24.020(B)2, in basement or garden Level . III. REVTEW CRITERIA FOR THIS PROPOSAL There are three different documents which all CCI exterioralterations must be evaluated against. The first is thevait Village urban Design Guide PIan, the second is the vailVillage Design Considerations and the third is the vailVillage Master Plan. IV. COMPLIANCE WITH THE URBAN DESIGN GUfDE PLAN FOR VAfL VILI"AGE There are no specific sub-areas relevant to this proposal . CoI4PLIANCE WITH THE URBAN DESIGN CONSIDERATIONS FOR VArIJ VTLI,AGE The following design considerations are a critical elementof the urban design plan. They identify the key physical v. B. c. characteristics of the Village and provide the tools to assure that new development will be consistent with theestablished character. Tlre consideratLons include thefollowing: A.Pedestrianization: The proposal will not have any negative lmpact on thepedestrian nature of Vail Village. Vehicular Penetration: This tlpe of use should not create a greater demand fortruck access. Streetscape Framework: There are two components listed in the design consideratlons that rrork together to establj-sh the framework for the Village streets. The first ls open space, landscaping, berms, and similar elements. The second is connercial infill vla storefront expansions. This proposal addreaaes the firEt of the two components. The additlonal- landscaping ln the rebulltplanter as well as the new landscaping in the exlstingplanter north of the proposed staircase will be a focalpoint along a major pedestrian route. As such, itfulfills one of the goals of the design considerations. Street Enclosure: The proposal will not affect the street enclosure l-nthis area as there is no expanslon above grade. Theplanter that screens the staircase is too Emall toaffect a pedestrianrs feeting of enclosure at thlE location in the Village. Street Edqe: Again, the relatively Enall size of this exterioralteration wiII not signlficantly effect the appearanceof the street edge. lfhat little affect it will have however, is positive. llhe staircase and pLanter will create a jog and add to the viEual interest along Bridge Street. Low planter walls, tree plantings' and changes in ground surface texture are al1 called for in the Design ConEiderations. This proposal has all threeof these design elements and iE therefore in compliancewith the standards. D. E. Building Heiqht: Building height will be unaffected. Views and Focal- Points: The proposed expansion does not affect any adopted vlew corridors. Service and Deliverv: The proposed expanslon wl-II not affect the current service and deLLvery patterns. Sun./shade: The proposal will not cast any shadows longer than whatthe existing structure does. Architecture/Landscaoe Considerations : The Design Considerations call for a mix of deciduouE and evergreen species for year-round continuity andinterest. The Design Considerations also call for asphalt or brick for walking surfaces. The staircaseitself will be made out of concrete. llowever' the Ianding at the top of the staircase whiclr interfaceswlth Bridge Street nill be made out of stone paving. The planter walls nill be constructed out of stonesthat will match the existing stonework. Staff believesthat the application conplies with the landscape standards specified l-n the Design Considerations. VI. Vail L,ionshead Third Flling.Applicant: Vait/Beaver Creek Televlsion Network Jill Kannerer explained the reguest, stating the applicant wantedto expand an existing television studio located within the sunbird Iodge Ln Lionshead (in the ccII zone district). Televisionstations are an allowable first floor use wlthin this zonedistrict, provided a conditional use approval has been obtained. In order to neet the conditional use criteria in ccII, television stations nust have a production room/studio space vhich is visible from the street or pedestrian nall, and the television station nust be exclusively ttcablecastrrr which would require no additional antennaE. The existing station was approved in luly of 1990. An addition to the approved fl.oor plan would require an amendnent to the conditional use pernit. .fill reviewed the consideration of factors and findings and stated the staff recomnended approval of the conditionaL use perruit subject to the following conditions: I. The window covering on the window whlch pemits viewingof the north studio area frorn the Llonshead pedestrian MaLl will renain open when fllning/broadcastingactivities do not require a controlled lighting situation. 2. The $I ,443.90 parking fee shall be paid to the Town of vail prior to Town issuance of any building permits. Bill Perklns, applicant, was present to answer questions. Kathy wondered why theltaff recommended the window coverlng remain open when possible, and was told the purpose of reguiring viewing of the production roorl/studio space wa6 to generate pedestrLaninterest/activity at the nall. Diana did not feel that atelevision Etudio waE the best use for the space, but feLt that since this use was a temporary one because the building would soon be redeveloped, she could support it. Bill Perkins replied ttratif they could get a good design on the second floor, he would novethere and would only have to obtain a bueiness License. Kathy noved to approve the reguest per the staff uemo with the twoconditions stated above and made findings A, B, and C. Krlstan wanted to nake certain that the TV company did not occupythe new space until the required parking fee had been paid and abullding permit had been obtained. A request for a front vard setback variance to allow a detached garage on Lot 10. Block 4. Lionsridge Filing No. 4, 1464 Aspen Grove Lane.Applicant: Carrol P. Orrlson Andy Knudtsen explaJ-ned the request for a L9 foot setback variance. The setbaclc requirenent ls 20 feet and the applicant was reguestinga setback of 1 foot. on a site plan, Andy showed where the detached garage r'rould be constructed and where the driveway wouldbe. (Thts nas the fourth tirne the applicant had been before the PEc.) changes made to the previous applications included a reduced depth of fitl from 7 feet to 1.5 feet, reduced length of fill fron 80 feet Xo 26 feet, reduced slope of drive fron 118 to 7.7t, and slope of filL around drLveway no longer exceeded 2:1. The changes had been nade possJ-ble by shlfting the driveway to the north and tlghtenLng the turning radius of each of the two cutrres of the driveway. Andy did caution the applicant that the Town Engineer had expressed concern that because of the tlghtness of the curves, the driveway nay not accoromodate large vehicles. Andy wanted the applicant to understand that the driveway nay only function for snall cars. Andy revlewed the CrLterLa and Findings, beginning with the ConsLderation of Factors. He stated that the staff recornmended approval of the request noting that findings A, B, and C2 were net. There were four conditions of approval which must be met before a buildtng pemlt could be obtained: amount of landscaping must be increased, specifically ln area between tlre cul-de-sac and the driveway, with 6 aapen5 Junl-pers. 1. The the and 2. t{ritten approval nust beassociation for the use driveway. obtained fron the homeownerrsof their right-of-way for the 3. Guardrails approved by a registered, professional engineer must be installed along the driveway. 4. An updated rockfall study for the driveway and garage nust be obtained. The applicant, Carrol orrison, sald that he felt confident that the driveway would work. Dalton had questions about the rockfall study, and Jin about the acceptance of the conditions. Mike Perkins, architect, stated thatthe turning radius could have been J.mproved with the addition of more asphalt. He felt it was a Catch-22. Mr. orrison stated he was not concerned about the turning radius. because he could place snal-l cars in the garage. Connie moved to approve the request per the staff neno with thefour conditions. Ludi seconded the rnotion and the vote Itas 6-0. Andy showed a site plan and explained the staircase on the east would be the only part of the new construction that would bevisible. This ski storage nould be a roon at the basement level below the exterior dining deck, accessed by a new staircase locatedat the southeast corner of the building. Andy described the rernoval of landscaping and the addition of more landscaping. Andy reviewed the purpose section of Connercial Core I, the Urban Design Considerations for Vail Village, and related goals andpolicies of the Vail village Master Plan. fhe staff recommendatLon was for approval wLth two conditions: 3. 1.Ttre appllcant nust pay $?1350 for a parlcing fee as prescribed in Section 18.52.160 (B) ? of ttre Town MunLcipal code. 2. The applicant rriI1 plant the two planter beds wlth annuals or perennials so that the beds are completely covered betseen the o bushes and treeE. Sid Schultz; architect for the proJect, stated that Pepi wouldrather not plant evergreens, but would be wLlllng to put in nore aspen, which would leave more transparency in the winter. [Ie uouldalso prefer floners rather than large plants. Ludi stated that he would just as soon see aspen and leave nore openness next to the building. Dalton wondered if the etairs should be heated because they would not be in sun. Pepi repliedtlre stairs would be under a roof and since they are on the eastside, would not receive nuch snow. Kathy felt a spruce would be nLce to plant, because of the bright qtreen against the yellow wall. Pepi felt the evergreen trees would lJron up and be too close to the building. He suggested a bushinstead. Kathy replied she would give Pepi the name of a tlpe oftree that grorrs quite slowly. Diana felt somethlng should be planted in the planters so it would be vlslble in the winter time above the snolr. She alEo encouraged Pepi to put everything back in place so that the deck would notlook new. sid replied that they would probably ball up theexisting landscaping (except the aspens) and put it back in place vhen the construction was done. 'Diana also suggested continuingthe planter around the corner. Dalton noved to approve the request for the exterior alteration per the staff nemo, including the two conditions in the uemo, with thenodification that athe spruce be replaced with a very slow growing coniferous tree. REVIEW CRITERIA FOR THIS PROPOSAL There are three different docunents which alt ccl exterioralterations must be evaluated against. The first is thevail Village Urban Design Guide PIan, ttre second is the vailvillage Design Considerations and the third is the Vail ViIIage Master Plan. IV. COMPLIANCE WITH THE URBAN DESIGN GUIDE PI,AN FOR VATL VILI"AGE There are no specific sub-areas relevant to thls proposal. COMPLIANCE WITH THE IIRBN{ DESIGN CONSTDERATTONS FOR VATL VILIJAGE The following design considerations are a critical elementof the urban design p1an. They identify the key physical v. o c. characteristics of the Village and provide the tools to assure that new developnent will be eonsLstent with theestablished character. lllre considerations include the folJ.owing: A. PedestrianizatLon: The proposal sill not have any negative funpact on thepedestrian nature of Vall Village. B. Vehicular Penetration: This tlpe of use should not create a greater denand fortruck access. Streetscape Frarnework: There are two components listed in the design considerations that work together to establish the framework for the Village streets. The first is open space, landscaping, berms, and sinilar elements. Ttre second is coramercial lnfill via storefront expansions. This proposal addresses the flrst of the two components. Ttre additional Iandscaping ln the rebuiltplanter as well as the new landscaping ln the existingplanter north of the proposed staircase will be a focalpoint along a najor pedestrian route. As such, itfulfills one of the goals of the desiEn considerations. Street Enclosure: The proposal- will not affect the street enclosure inthis area as there is no expansion above grade. Theplanter that screens the staircase is too small toaffect a pedestrianrs feeling of enclosure at this Location in the Village. street Edcre: Again, the relatively snall size of thls exterloralteration will not significantly effect the appearanceof the street edge. t{hat llttle affect lt will have however, is positive. The staircase and planter will create a jog and add to the visual interest along Brldge Street. Low ptanter wallE, tree plantings, and changes in ground surface texture are all called for in the Design Consideratione. rhis proposal has all threeof these desigm eleuents and is therefore Ln conplLancewith the standards. D. E. F.Buildinq Heiqht: Building height will be unaffected. G.Views and Focal Points: The proposed expansion does not affect any adopted view corridors. Service and DeLiverv: The proposed expansion will not affect tlre currentservice and delivery patterns. Sun/shade: The proposal will not cast any shadous longer than wbat the existing structure does. Architecture/Landscape Considerations : The Design Considerations caII for a mix of deciduoue and evergreen species for year-round continuity andinterest. The Design Considerations also call for asphalt or brick for walking surfaces. The staircaseitself will be made out of concrete. However, the landing at the top of ttre stalrcase which interfaceswith Bridge Street will be nade out of stone paving. The planter walls will be constructed out of stonesthat will match the existing stonework. staff believesthat the application complies with the landscape standards specified in the Design Considerations. VT. REI,ATED GOALS AND POLICTES OF THE VAIL VILIAGE UASTER PI,AN There are two objectives,2.4 and 3.1, which relate to the expansion. Staff also believes that theBridge Street and core Creek Drive pedestrJ-an ways wlll be enhanced by the additional landscaping. 8wo of the five illustrative plans of the Vail Villagetlaster PLan relate to the proJect. The I.and Use Plan callsfor uixed use, with which this request complies. TheCirculation Plan calle for Eridge Street to be a pedestrLanstreet. The proposal will aupport pedestrian activity onBridge Street. Ehe Open Space fllustrative Plan and theBuilding Helght Illustrative Plan are not appll-cable. STAFF RECOMMENDATTON Staff recomnends approval of the proposal because we believeit meets the policies of the Vail Village uaster Plan, theVail village Design Considerations and the Vail Village Urban Design Guide Plan. There is a small amount ofadditional mass and bulk which will be added to thebuilding; however, staff believes the inproved landscapingin the planters around tbe staircase vill nitigate the iurpact of the staircase itself and wil-1 Lmprove the overall character of Bridge Street. The Tor,rnrs plans and giuidell-nesfor the Village call for additional }andscaping as focalpoints for the pedestrian rrays through the Village, andstaff believes this fulfllls those obJectives well. Staff recorurnends approval with the condition that the applicant: 1. Pay the $7r35o.Oo parking fee as prescribed in Section L8.52.150(B)7, of, the Town of Vail Uuniclpal codei 2. The'rAustria Haus" isnecessary to the promotion of a spirit of cooperationbetween ourselves and the Austrian organizers, resorts, andthe l,r|orld Championships themselves, and thus to thesuccessful presentation of the Vail/Beaver Creek event as wel l. The ordinanceexempts the Vail Valley Foundation from the Town of Vailzonlng, design review, and sign code requireruents in order tofacilitate the Championships. The staff and Council supportedthis ordinance as it was felt that the event hras a rnajoi-comnunity undertaking that required ternporary structures, signage, street decor, and other temporary ilnprovements. Itwas felt that it was in the best interest of the cornmunity atIarge to exernpt the Vail Val1ey Foundation from our standirdreview processes. lhe ordinance established an advisory connittee to handleapprovals for tenporary inprovements. peggy Osterfoss, aPlanning Commission member, Kathy warren, chair of the DesignReview Board, and Ron Phillips, Town ltanager, serve on theAdvisory comnittee. The purpose of the group is to reviewreguests related to the World Championships in a tinely manner. Due to each individuals background, it is felt that they will make a strong effort to keep the best interests of thecommunity in rnind when making decisions. The group met on October 18th to review your request totemporarily enclose a portion of your dining deCk at the Gasthof Gramshammer. The forlowing decision was made as to howthe request should be handled: 1. The Foundation rnust endorse the proposal. Thespecial ordinance for the World Alpine Ski Championships was written specificilly to exernpt theVail Val-Iey Foundation from our standard reviewprocesses. The ordinance does not allow for privateparties to be exempted froru normal review processes, unless the request is sponsored by the VaiI ValleyFoundation and is necessary for the Charnpionships. Aletter of endorsement should be subnittea to ttreConnunity Development Department. 2. The Vail Valley Foundation should explaiJr how thetemporary deck enclosure is necessary for the WorldAlpine Ski Chanpionships. This should also beincluded in the letter to the Comrnunity DevelopmentDepartment. 3. The proposal shall be reviewed by the Design ReviewBoard at a regularly scheduled ureeting. The DesignReview Board must grant approval of the tenporary-enclosure before any construction uray begin. 4. The Vail Valley Foundation as sponsor, and you as theproperty ordner, must enter into a written agreementstating that the temporary structure shall not beerected before January Lst and shall be removedwithin 30 days after the end of the World Alpine SkiChanpionships on February L2, 1999. As you know, theTown of VaiI has very strict requirements on addingadditional square footage, particularJ.y in theVillage and Lionshead. The deck enclosure would beapproved only for a temporary enclosure for the WorldChampionships. We vould also ask that the deck bereturned to its original condition in a tinely rnannerso that construction does not irnpact our high season. 5. A deposit of an adeguate anount of noney to cover thecosts for dismantling the temporary improvementsshall be provided to the Town before constructionbegins. If the property ort/ner fails to remove thetemporary improvements, the Town of VaiI shall havethe right to enter onto the property and to removethe temporary inprovements. The Town of Vail has theright to use the deposit to remove the ternporary improvement,s. Please subnit this information as soon as possible to theconrnunity Development Departnent so that we rnay faciritate thereview of the temporary deck enclosure. If you have anyfurther questions about this process, please contact rne at 476-7000, ext. 103. There would be nopersonal carry-out or eat-in available. The staff felt thatthe proposed use was not consistent with the objectives of honeoccupation permits. The denial was based primarily on one ofthe eight criteria that determine liuritations on honeoccupations. The criteria states that the home occupation notgenerate significant vehicular traffic in excess of tbattypically generated by residential dwellings. The applicantsstated that they anticipated to generate up to 35 vehiculartrips in and out of their residence. The zoning code also lists examples of businesses that may notbe considered for horne occupations, and these includedrestaurants or any sirnilar use. Steve Schweinsberg, one of the applicants, said he had changed one part of his proposal , j-n that he would deliver the pizza uncooked. This, he felt, would enable him to combine sorne ofhis deliveries, since he would not be concerned about keepingthe pizzas hot. Thus, he could reduce the nunber of vehicletrips per day.
