It has come to our attention that the above-described property may be in violation of the Town of Vail Municipal Codes as follows: Reported Violation(s): Noise generated at this location is often above the allowed limit. The view from this location is directly into adjoining dwelling units. Section 12-14-13 (RESTAURANTS, BARS OR SIMILAR USES) of the Town Code states, in part, that: In districts where restaurants, bars, or similar uses are allowed, they shall be subject to the following requirements: A. Noise generated by the use may not at any time exceed fifty (50) decibels outside the enclosing walls or ceilings of the use. B. Dwelling units in the same structure or in structures adjoining restaurants, bars, or similar uses shall have the right to privacy and the restaurant, bar, or similar use shall be designed in such a way that view from the use is not directly into adjoining dwelling unit or units. Windows may be treated with appropriate covering.
