The amount of the security shall be based used upon the cost of the work required to ensure compliance with the permit's items and conditions. The security, with interest at the rate currently earned by the town, less any deductions, shall be released upon the town's determination that the Permittee has successfully completed all work rec�uired by the permit. If the Permittee does not successfully complete all required work or violates any requirement of the permit, the town may take corrective measures and charge the cost of such to the Permittee. Such costs shall include the actual cost of any work deemed necessary by the town plus administrative and inspection costs and penalties pursuant to the town's stornzwater quality enforcement policy. In determining the cost of work, a 15% administrative fee shall be assessed. If the total of such costs exceeds the security, the Permittee shall be responsible for payment of the remaining balance within thirty (30) calendar days of receipt of an accounting of such from the town. It is the Permittee's responsibility to request a release of the Performance Security. Please note that eligibility for a full release is determined by adequate permanent stormwater quality control features, including established vegetation. In most cases, a minimum of one year from the date of seeding is necessary to determine vegetation establishment. SITE DESCRIPTION The Lodge @ Lionshead, Phase I & I1, are vacation condominiums, on Lot 7, Block 1, Vail/Lionshead First Filing, located at 380 E Lionshead Circle, south of the Lionshead Parking Structure,within the Town of Vail, Eagle County, Colorado. The property is situated on a 1.369 acre lot. To the south of the property are the bike path and Gore Creek. On the north side of the condominium buildings are the access driveway, the parking lot and the main entry, while on the back of the buildings are the swimming pool and the fenced-in, landscaped, backyard. The topography of the site is moderate. Drainage is to the south. a. Construction Activity The construction activity will consist of the following: • Brand New Exterior Facade & Roofs • All New Common Areas • Expanded Entry, Renovated Lobby & Reception Desk • New Outdoor Pool, Hot Tubs & Renovated Fitness Center • All New Heated Parking Areas, Driveways & Walkways • Replacement of All Unit Windows, Sliding Doors & Front Doors • Landscaping Enhancements • New Ski Lockers • Fire Suppression System & Safety Code Upgrades In conjunction with the above described activities, a new perimeter drain around all of the new foundations, roof gutters, downspouts, and drainage structures consisting of a trench drain, oil and sand interceptor, and two dry wells for collection of the discharge from the roof drains and from some of the perimeter drains will also be constructed. b. Proposed Construction Schedule 1. An expected construction schedule: a. Expected Construction Start Date - April 9, 2007 b. Expected Work Completion Date - December 3 l, 2007. -3- 2. According to the Evans Chafee Construction Group Staging Plan, dated March 12, 2007, the construction fence will be installed first along the property lines of the project, except on the south side of the property, where the existing fence will remain during construction as a construction fence, and will be relocated in accordance with the permit documents. 3. Construct silt fence at the limits of construction. 4. Begin site construction. 5. Stabilize disturbed areas. 6. Remove sediment controls. c. Estimated Site Areas Total Site Area= 1.369 acres Total Disturbed Area = 1.21 acres (within limits of disturbance)-0.45 acres (buildings) = 0.75 acres d. Description of Existing Vegetation Existing vegetation consists of turf lawn, mature aspen, cottonwood and spruce trees, and seasonal planting beds consisting of perennial material. f. Location of Other Potential Pollution Sources Construction equipment fueling will be done during construction, wherever the construction activity is taking place at the time, by mobile fuel trucks. Material laydown, dumpsters, and portable toilets will be located in the two staging areas shown on the above-named staging plan. One staging area is located on the driveway/parking lot area and the other on the south side of the buildings, between the buildings, pool area and the existing fence. -4- There will be no fertilizers or chemicals left exposed to the elements. There will be no dedicated concrete batch plants or dedicated asphalt plants on site. The contractor will not discharge concrete wash water into Gore Creek or into the Town of Vail storm sewer system. g. Receiving Waters The site drains to Gore Creek. h. Non-stormwater Components of the Discharge There will be no non-stormwater components discharge. 3. LOCATION AND DESCRIPTION OF APPROPRIATE CONTROL MEASURES (BMPs) a. Before Clearing and Grading Begins Construct a silt fence at the limits of construction. b. During All Phases of Construction Silt fences will be used to filter sediments from disturbed areas that are in sheet flow. Disturbed areas will be kept to the minimum area possible. The portion of Lionshead Circle adjacent to the construction site will be kept free of debris, dust and mud. Sweeping, and washing of the roadway, when necessary, will be part of the daily operations on the construction site. Sediment will not be allowed to overtop the silt fences. Stockpiles of topsoil or other excavated material stored for re use, or road base material, will have proper sediment controls such as a silt fence, surrounding them. All new drainage structures (trench drain, catch basins, oil& sand interceptor) will be protected during construction from being clogged by runoff sediment. Hay bales, filter fabric or other BMP's found appropriate at the time will be used to protect the structures. -5- Construction equipment fueling will be done during construction, wherever the construction activity is taking place at the time. Care should be taken to avoid spills during maintenance and fueling and any accidental spills will be cleaned up promptly and completely. The contractor will prepare a plan that immediately mitigates all problems associated with any potential spills. Fertilizers or chemicals will be stored in a trailer or laid on and covered with a waterproof material. The contractor is responsible for not tracking soil off-site. c. Post-Construction/Final Stabilization A landscaping plan is part of the permit documents for the site. The re vegetation will take place after the construction activities have been completed. The proposed vegetation will consist of new sod, native planting beds, new trees consisting of aspen, spruce and fir, shrubbery (red twig dogwood, high alpine honey suckle), and selectively placed junipers. The proposed vegetation will equal or exceed the vegetation cover of the site. Final stabilization is reached when all soil disturbing activities at the site have been completed, and uniform vegetative cover has been established with a density at least 70 percent of pre-disturbance levels or equivalent, permanent, physical erosion reduction methods have been employed. In most cases, a minimum of one year from the date of seeding is necessary to determine vegetation establishment. The new drainage structures will be maintained continuously. After every storm event all of the structures will be inspected, and at least once a year(or more often if needed) they will be cleaned. 5. INSPECTION AND MAINTENANCE PROCEDURES a. Inspections i. Inspections shall be performed every l4 days, or following a stormwater event. . , -6- ii. Complete an inspection report(form provided by the Town of Vail) for each inspection performed iii. Keep inspection reports on site. b. Maintenance i. Perform maintenance and repairs as soon as possible on items or areas identified in the inspection report. ii. Perform maintenance as indicated in the manufacturer's specifications, or other sources determined to be acceptable. Silt fences shall be periodically maintained. Remove sediment accumulated behind the silt fence when it has reached half the exposed fabric height. Damaged silt fences should be promptly repaired. Remove silt fences after they have served their usefulness. 6. RETENTION OF RECORDS Keep inspection reports on site. An efficient record-keeping system is a helpful tool in managing inspection and maintenance reports. It is recommended that a log book be maintained for inspection reports, maintenance records, spill responses, weather conditions, training, correspondence, etc. 7. SEDIMENT CONTROL DETAILS a.
