The stormwater discharge pernut is required when one acre or more of land is disturbed. Since the area of disturbance is less than an acre,we do not feel that we need a Colorado Dept of Health (WQCD)stormwater discharge permit However,VRDC felt that we should submit the permit application to the State anyway,with a note that it is less than 1 acre,and let the state decide if a pern-►it is in fact needed. Based on years of groundwater monitoring at this site,groundwater is not expected to be encountered when removing the underground storage tanks,as they are above the groundwater elevation. If any water does need to be removed from the excavation,it will be pumped out(Vacuum truck),removed and disposed of properly. It will not be discharged. Therefore,VRDC has not applied for a Construction Dewatering pernut. A permit for removal of the tank is required from the Division of Oil and Public Safety and has been applied for.
