IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE ORB:
1.In addition to meeting submittal requirements,the applicant must stake the site
to indicate property lines and building corners.Trees that will be removed
should also be marked.This work must be completed before the ORB visits the
site.
2.The review process for NEW BUILDINGS will normally involve two separate meetings
of the Design Review Board,so plan on at least two meetings for their approval.
3.People who fail to appear before the Design Review Board at their scheduled
meeting and who have not asked for a postponement will be required to be
republished.

4.The following items no longer have to be presented to the Design Review Board.
They,however,have to be presented to the Zoning Administrator for approval:
a.Windows.skylights and similar exterior changes that do not alter the
existing plane of the building;and
b.Building additions that are not viewed from any other lot or public space.

the addition;and/or approval from the agent fori or manager of a condominium
association.
5.You may be required to conduct Natural Hazard Studies on your property.You should

3.Existing trees or groups of trees having trunks with diameters of 4"or more
one foot above grade.
4.Rock Dutcroppings and other significant natural features (large boulders,
intermittent streams,etc.).
5.Avalanche areas,100 year flood plain and slopes 40%or morel if applicable.
6.Ties to existing benchmark.either USGS landmark or sewer invert.
7.Locations of the following:
a.Proposed surface drainage on and off site showing size and type of
culverts.swales,etc.
b.Exact locations of all utilities to include existing sources and proposed
service lines from sources to the structure.Utilities to include:

Telephone

water
gas
electric
c.Property lines showing distances and bearings and a basis of bearing
d.Proposed driveways with percent slope and spot elevations
e.All easements

before the ORB site visit.

Photos or sketches that clearly indicate what is proposed and the location (site plan)
of proposal may be submitted in lieu of the more fonmal requirements given above.as

Rick Pylman showed the model and explained the modification to the proposal
since it was presented to the PEe on September 23 and denied.Now the 2nd and
3rd floors were stepped back although the height was the same as the first
proposal.Peterson mentioned that the height was below that which ;s allowed
in eel although there was still some impact on sun/shade and street enclosure.

Tom Braun explained the request and reviewed the memo adding that the applicant
must present a written agreement with the Town that this unit would remain an
employee unit and the agreement be recorded with the Eagle County Clerk and
Recorder.
Peterson explained that the space was already in the building,so no building
was being added.Patten mentioned that this was the type of employee housing
felt to be the most desirable:there was no expansion of the building and it
was integrated within other housing,not segregated.
Pam Hopkins wondered why enclosing a deck was considered a grant of special
privilege,but that this was not.Braun answered that this was a benefit to
the Town,and Patten responded that this was existing space that the community
felt this type of use should be promoted.

Kristan Pritz explained the request emphasizing that the main reason to go
through the testing of the protective matting was to see where additional
parking could be placed for special events such as the World Cup.Ron
Phillips,Town Manager,answered questions.Piper asked about the cost of the
matting,and Phillips responded that it cost $17,000 for 9100 square feet,but
did not know the cost of plowing and installation by the Town employees.He
said that it would be removed as soon as there was any thaw,on or about March
1.It would be open any time for anyone to use and intensive use would be
encouraged for the test.
Donovan wondered if this was the most practical place as far a bus service was
concerned and felt that 1/2 hour bus service was not enoughduring non-peak
hours.She asked if the same buses would be used as are used for the golf
course and Stan Berryman,director of Public Works.replied that the same buses
would be used.Donovan asked how people would get from the lot to Golden Peak.
She felt that people would not walk on the path once it thawed,but would walk
on the pavement.Phillips replied that the bike path could not be used because
it has been torn up and that the lot wouldn't be used once the snow melts.
Donovan replied that it was likely that the metal would hold heat.If the sad
is damaged,it cannot be replaced and used the same year and it was important
not to damage the summer business.She stated that the Town must plan a long
range parking facility.Donovan felt a first class resort must not resort to
surface parking.
Phillips replied that this test was a use question and the Council would
examine the use further.Piper asked if there would be an analysis of the use,
numbers,etc.and Phillips replied that there would bea follow up report on the
effectiveness of the matting.Donovan asked if we needed to put specific dates
on the use,and was told it was impossible to use specific dates because use
depended upon the weather.Donovan stated that she would vote for the use this
year,but may not for other years.
Briner moved and Hopkins seconded to approve the use for this ski season only.
The vote was 7-0 in favor.

I,DESCRIPTION OF USE:
The new lessee of the restaurant at the Potato Patch Club,John Heilman,would
like to expand the Potato Patch Club Restaurant to include condominium unit #44
as part of the restaurant area.Currently,condominium unit #44 is used as
storage.In the original proposal for this space,the unit was to be used as a
manager's unit.The space ;s 372 square feet which will allow 32 additional
restaurant seats to be added to the dining area.According to current Town of
Vail parking requirements.4 additional parking spaces will be required.Town
of Vail parking requirements state that one parking space shall be provided per
each 8 restaurant seats.The parking calculations are based on seating capacity
or building code occupancy standards.whichever is more restrictive.In this
case,builaing code occupancy standards are more restrictive and therefore 4
parking spaces will be necessary.
The Potato Patch Club was given an original conoitional use approval on December
13,1977.At that time,47 spaces were considered to be satisfactory for the
private club with the condition that if the parking seemed inadequate,more
spaces would be provided.Forty-seven spaces exist on the site.
In the residential cluster zone district.a private club is listed as a
conditional use.Because the conditional use is being expanded,the owner of
the restaurant must request a new conditional use to allow for the restaurant
expansion.
II,CRITERIA AND FINDINGS:
Upon review of Section 18.60.the Community Oevelooment Department recommends
approval of the conditional use oermit based uoon the following factors:
Consideration of Factors:
Relationship and impact of the use on development objectives of t~o Town.
The upgrading of the existing restaurant is considered to be a positive impact
in respect to development objectives of the Town.The conversion of unit 44 is
not a negative impact,as the space is not used as a dwelling unit even though
it was originally designated as a manager's unit.

The effect of the use on light and air,distribution of population.
transportation facilities.utilities,schools.parks and recreation facilities
and other public facilities needs.
No impact.
Effect uoon traffic with particular reference to congestion.automotive and
pedest~;an safety and convenience.traffic flow and control,access.
maneuverability,and removal of snow from the street and oarking areas.
The new addition will require 4 new parking spaces.By restrip;ng the existing
parking spaces and providing compact spaces,the owner will meet the additional
parking requirement generated by this proposal.Twelve spaces may be compact
spaces.The additional parking is to be located on the south side of the tennis
courts.Staff believes that the restaurant expansion will have no impact on the
other concerns under this criteria.
Effect upon the character of the area in which the proposed use is to be
located.including the scale and bulk of the proposed use in relation to
surrounding uses.
The proposal will have very little effect on the scale and bulk of the existing
building.as it is an interior expansion.The owner is not proposing any
changes to the exterior of the building at this time.Any trees or shrubs that
are lost due to the additional parking will be replaced.
RELATED POLICIES IN VAIL'S COflMUNITY ACTION PLAN

III.Such other factors and criteria as the commission deems applicable to the
proposed use.

V.FINDINGS
The Community Development Department recommends approval of the conditional use
permit be based on the following findings:
That the proposed locat1on of the use is in accord with the purposes of this
ordinance and the purposes of the district in which the site is located.
That the proposed location of the use and the conditions under which it would
be operated or maintained would not be detriment1l to the Dubl;c health,
safety,or welfare or mater1ally injurious to properties or improvements in
the Vicinity.
That the proposed use would comply with each of the applicable provisions of
this ordinance.

Staff recommends approval of the restaurant expansion as ~he propos~d
location of the use is in accord with the purposes of this ordinance and
district.The proposed conditional use will not be detrimental to the
public health,safety or materially injurious to properties or
improvements in the vicinity.It is felt that the proposed use complies
with each of the applicable provisions of this ordinance.The
environmental health officer has also reviewed the proposal and has no
problem with the request.For these reasons,the staff recommends
approval of the proposal contingent upon the applicant providing the
parking at the same time that the building permit ;s requested for the
restaurant space.
The applicant may provide a letter of credit to cover the construction ot
the parking and landscaping if the weather makes it difficult to complete
outdoor improvements at the time a building permit is requested.

believe it will benefit the owners and our neighbors
in the irnmediate·North Frontage Road community.

Kristan Pritz made the staff presentation.She presented background,the
description of the proposed use,and criteria involved in the evaluation of a
conditional use permit.The staff recommendation was for approval.It was
stated that the proposal provided a short term solution to the Town's lack of
parking.Due to the fact that the land used for parking would be disturbed for
two years anyway,it was felt that the proposal would not negatively impact the
site.Staff did point out that the proposal would only be appropriate for two
years.
Joe Macy.representing Vail Associates,spoke on behalf of the proposal.He
stated that this was to be a short term solution creating 110 -120 parking
spaces.

Duane Piper opened the floor for public discussion.Alice Cartwright,golf
course property owner,registered her reservations regarding the proposal.She
was concerned about the additional traffic and slipperiness of the road for
drivers trying to enter and exit the lot.lou Meskimen asked several questions
regarding project design.Jay Peterson felt that the area was not meant to be a
parking lot and that it would not remain a short term solution.He stated that
once on a site,you do not get rid of parking because the Town has such a great
need for parking.Edie Hudson,the manager of the Wren.was concerned about the
road design and the impact on the Wren condos.Pritz also stated that she had
received one call from Louie Pintowski who was against the proposal and one
letter from Monie Beal who was also against the proposal.Piper read into the
record a letter from Marka Moser stating her reservations regarding the project.
PEC comments:
Tom Briner:He asked about the number of spaces in the Golden Peak conversion.
Macy replied that there were 120 spaces converted from employee to public fee
parking.Briner wondered where VA had assumed those employees would park.Macy
answered that they were to be assimilated into other lots such as Chalet Road,
the soccer field,and the golf course.Briner was leery of the short term claim
and felt that there would be problems with day skiers trying to use the lot if
there would not be a permanent parking attendent.He also felt that the parking
had the potential to impact the Nature Center,micro climate along the creek,as
well as views from the Wren and Vail Valley Drive into the park.
Jim Viele:He also shared the concern of the lot being used as a long term
parking area.However,he pointed out that the area to be used for parking is
currently disturbed and therefore he saw little impact if the use would only be
short term.He did state that if the solution was for more than two years,he
would have reservations about the long term use.
Diana Donovan:Diana stated that she did not see how the proposal met the
approval criteria for a conditional use permit.She felt that it would be
difficult to draw the line on short term/long term use.She stated that Vail
Associates had agreed to lose employee parking at Golden Peak.She pointed out
that the parking on Chalet Road that VA utilized was actually on All Seasons'
property and was lost when the All Seasons I condo association decided to upgrade
and landscape their parking area.She stated that during the Ford Park study
process there were strong community voices stating that there were to be no cars
in the parks.She also felt that there would be negative impacts on cross
country skiers due to the parking.She pointed out that the amphitheatre was
planned to open in the fall of 1986 which seemed to be a conflict with the two
year time frame for the parking.She was concerned that the area around the
amphitheatre not be left without landscaping in 1987 if the amphitheatre was
actually to be opened in the fall of 1986.She felt there seemed to be no
control over who would be parking at the lot,and felt that Vail Associates
should be looking at long range solutions to their parking problems.Donovan
stated that every other employer/business is required to provide parking.She
questioned why Vail Associates did not have the same obligations.She felt the
club house was a good alternative and perhaps the Beaver Creek transit bus could
be used to provide additional bus service to employees using the club house lot.
She felt that the parking would conflict with the alpine garden.She stated
that originally in the Park master plan the road was thoroughly discussed and
purposely designed with a curve.She felt that a road 20 feet wide would have a

negative impact upon the park.She stated that the curve worked for the number
of vehicles in the summer seasonal use that was required for the amphitheatre.
She also felt that the drop·off from the road down to the creek was very
dangerous for drivers.She emphasized that the traffic from the parking lot
would create congestion on the Frontage Road.She stated concern about
pedestrians walking from Manor Vail to the lot in the dark.She summed up her
comments by stating that she felt that to approve the request would be a grant
of special privilege.
Sid Schultz:Sid asked about the number of parking spaces VA owned in
Lionshead.Macy stated that there were 120 spaces in the North Day lot and that
this proposal was merely making up for the loss of employee parking due to the
Golden Peak conversion.Shultz stated that he felt that VA should be
responsible for providing parking like other employers/businesses,and should
look at long term solutions.He stated that the proposal was a short term band
aid solution.
Pam Hopkins:Pam asked at what level the Town Council had discussed this
project.Staff responded that as land owners,the Council had given their
approval to allow the application to proceed through the conditional use process
at Planning Commission.She suggested that perhaps the 520.000 for the road
could instead pay for a bus driver to handle the route from the golf clubhouse
lot to the mountain.She asked Joe Macy why the golf clubhouse lot was not
used.Joe stated that it was inconvenient for the employees.She was also
concerned with the possibility of drivers sliding into Gore Creek,mud during
nice winter weather.and other traffic concerns.She pointed out that if by
chance this is not a big snow year,the lot will become very muddy.
Duane Piper:Duane asked Joe Macy when VA would like to begin work on the lot.
Macy stated that construction would take approximately 10 days and that they
would like to begin as soon as possible.VA hoped,if the request was approved,
that they could use the lot by Christmas,1985.Duane asked if there was
lighting on the Manor Vail bridge.Staff responded that there was no lighting.
It was stated that if the road was constructed,construction may be possible for
the amphitheatre throughout the winter.This construction would involve
bringing in fill for the amphitheatre.Duane asked if the Manor Vail parking
lease would continue if this proposal was approved.Joe responded that they did
have a lease agreement with Manor Vail for 30 spaces and that the 30 spaces are
allocated per department according to numbers in each department.Duane felt
that the parking task force recommendations and the Vail Associates·decision to
allow parking at Golden Peak were good decisions,but that to turn around and
request to use public property to make up that need was questionable.He
questioned the actual benefits to the Town.He felt that the loss of the curve
in the road was a problem.however he felt that the revegetation plan was a
definite plus.Duane suggested that perhaps the land for parking could be
leased from the Town and the money would then be used to develop the lower bench
according to the master plan.He also felt that more control at the entry would
help the proposal and that perhaps the lot should only be used for VA people to
make it easier to distinguish employees from day skiers.Macy responded that
the proposed lot really would be a benefit to the entire community and not just
Vail Associates,as it would help out with our short term parking needs.Duane
stated that it is probable that we were looking for short term solutions through
out 1989 World Championships.Joe again expressed VA's concern over long term
parking solutions.Duane also agreed that parking was very important but that
we need to take great care in the solutions that we come up with.

Alice Cartwright mentioned again that really all VA needed to do was get a bus
from the clubhouse to Golden Peak and that would help out greatly with parking.
Diana mentioned again her concern about the steepness of the road's drop off to
the creek and traffic congestion.She felt that employees need to accept
parking away from the base of the mountain.
Donovan moved and Schultz seconded to deny the request based on the fact that it
did not meet criteria for a conditional use permit.The vote was 5 in favor of
denial and 1 (Viele)against.

I.DESCRIPTION OF USE:
The new lessee of the restaurant at the Potato Patch Club,John Heilman,would
like to expand the Potato Patch Club Restaurant to include condominium unit #44
as part of the restaurant area.Currently.condominium unit #44 is used as
storage.In the original proposal for this space,the unit was to be used as a
managerls unit.The space is 372 square feet which will allow 32 additional
restaurant seats to be added to the dining area.According to current Town of
Vail parking requirements.4 additional parking spaces will be required.Town
of Vail parking requirements state that one parking space shall be provided per
each 8 restaurant seats.The parking calculations are based on seating capacity
or building code occupancy standards,whichever is more restrictive.In this
case,building code occupancy standards are more restrictive and therefore 4
parking spaces will be necessary.
The Potato Patch Club was given an original conditional use approval on December
13,1977.At that time,47 spaces were considered to be satisfactory for the
private club with the condition that if the parking seemed inadequate,more
spaces would be provided.Forty-seven spaces exist on the site.
In the residential cluster zone district,a private club is listed as a
conditional use.Because the conditional use 1S being expanded,the owner of
the restaurant must request a new conditional use to allow for the restaurant
expansion.
II.CRITERIA AND FINDINGS:
Upon review of Section 18.60.the Community Development Department recommends
approval of the conditional use permit based upon the following factors:
Consideration of Factors:
Relationship and impact of the use on develooment objectives of the Town.
The upgrading of the existing restaurant is considered to be a positive impact
in respect to development objectives of the Town.The conversion of unit 44 is
not a negative impact.as the space is not used as a dwelling unit even though
it was originally designated as a manager's unit.

The new addition will require 4 new parking spaces.By restriping the existing

parking requirement generated by this proposal.Twelve spaces may be compact
spaces.The additional parking ;s to be located on the south side of the tennis
courts.Staff believes that the restaurant expansion will have no impact on the
other concerns under this criteria.
Effect upon the character of the area in which the proposed use is to be
located,including the scale and bulk of the proposed use in relation to
surrounding uses.
The proposal will have very little effect on the scale and bulk of the existing
building,as it is an interior expansion.The owner is not proposing any
changes to the exterior of the building at this time.Any trees or shrubs that
are lost due to the additional parking will be replaced.

Dear Mark:
Some time past you and I met in your office to discuss the crawl space
ventin9 problem apparent in the Type 1 buildin9s at Potato Patch Phase [.
At that time,your position was to accept ventilation adequate enough to
provide two air changes in the crawl space in a 24 hour period.
I feel that if we were required to install crawl space vents through the
exterior wall and insulation system (Dryvit system)we would run the
potential risk of freezing the water and waste piping which is exposed
in the crawl space and heated via normal heat loss through the floor.
Chapter 19 of the ASHRAE HANDBOOK OF FUNDAMENTALS,Table 1,titled "Air
Changes Taking Place Under Average Conditions in Residences,Exclusive
of Air Provided for Ventilation ll indicates that rooms with no windows
or exterior doors naturally undergo one half an air change per hour.
Thus,our crawl space would undergo 12 air changes in a 24 hour period
or 12 times your recommended goal.
Additionally,the chapter of the ASH RAE Manual concerning moisture and
ventilation indicates that a better treatment is a cover over the Eround
surface.If you feel this may be a problem source,I will recommend to
the project developer that we install a4 to 6 mill thick Polyethylene
film with the edges lapped a minimum of 2".
As the time for a Certificate of Occupancy is rapidly approachin9 I
would appreciate an expeditious reply to prevent any possible additional
delays.

I am presently developing the old Flemin@ Lumber Site
on Sandstone Road.In conjunction with ~he Forest
Service's realignment of Sandstone Road,I would like
to ask permission to landscape and vegetate the small
strip of land between our westerly property line
and the sandstone road.Presently,this parcel is
rather unattractive,and could greatly enhance the
general appearance of this particular area and the
Sandstone Road.
I have enclosed a drawlD~of our proposed plan.We
would plan to berm tbe Forest Service property and plant
both conif£rs and natural materials on the berm.I
have discussed the matter with Diana Toughtll of the
Town of Vail and she supports our request.She feels
that the landecapinr would be consistent with the
Town's overall landscaping improvements.

20,21,22,23,24,25,and 26.1btal GRFA is assessed at 15¢
per square foot (21,842.57 &luare feet X .15)resulting in a
Recreation Fee of $3276.39 for all of these units together.
The TO,m of Vail will extend a 75%Recreation Fee credit 00 the
Phase II bJ.ildings emmerated above as well as a 25%additional
credi t on Phase I buildings when the faciIi ties are installed
and operating.
