("VA'). These wells are to be used as part of an environmentally friendly geothermal air conditioning system for the Tivoli. VA in very interested in accommodating the Tivoli's request and we'll work towards entering into an encroachment agreement with them as soon as our review is complete and the appropriate document drafted and executed. Please consider this as a letter of intent to work with the Tivoli on the execution of an agteement and allow them to proceed with their project. Notwithstanding the irrovisions of this letter, VA's agreement to accommodate Tivoli's request is with the understanding that Tivoli's owner agrees to enter into said encroachment agreement with VA, as evidenced by the countersignature on this letter. If this permit is for installation of an exterior hot tirb or spa on any existing deck or elevated platform, a structural engineer must review the existing condition and veriff that it will suppoft the added concentrated load. If this is a remodel in a multi-family building with a homeowners association, a letter of permission from the association is required.
