o All new aonstruction witfiin tfie Town of Vail is considered b be of unusually tight oonstrucdon,
thus all oombustion air is required to be drawn ftom outside the structure for medranical
eguipment.
Town of Vail Fircolace Ordinance
In September of 1991, the Vail Town Council adophd an ordinane which restricts b aonstruction and
use of open heardr fireplaes within municipal boundaries. Since that time the ordinance has
undetgone numetous changes and rcvisions, striving for compromise, yet effiectiveness in addressing
the air quality issue. Therefiote tlre following cribria has been adotrd:
r Constnrction of open hearth wood burning ftreplaces is no longer permitted within Town of Vail
municipal bounda ri,es.
Dwellino Units - Each new dwelling unit may ontain:
One (1) EPA Phase II ertified solid fuel burning dwice and no morc than two (2) gas appllanoes
(B vent)
OR
TUro (2) gas log fireplaces and no more llran two (2) gas appliance fireplaes (B bent).
Restricted Dwellinq Units - Each nenr restric&d dwelling unit may oontain:
One (1) gas log fireplace and not morc than ohe (1) gas appliance fircplace.
Accommodatiod Units - Each new accommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fircplace.

unit, the ombined unit may r€tain one woodbuming fircplae (if one already exists) and no morc
than 2 gas appliane ft:eplaces, or may cgnyelt up b two existing fireplaes b gas.
If during the ourse of a remodel an existing woodburning fircplae is altercd or moved, the unit
must then comply with all prcvisions of the ordinance. That is, the fireplace must be convefbd to
natural gas or rFplaced by an EPA Phase II certified unit
