At the time ofannexation,this property was rezoned from Eagle County's Residential Suburban Medium (RSM)zoning district to the Town ofVail's Two-Family Primary/Secondary Residential (PS)zoning district.The existing Vail Sky High Condominiums do not conform to the Town ofVail's development standards.Since the condos were constructed prior to being regulated by the Town,they are allowed to continue as a legal non-conforming structure and use. According to our records,the Vail Sky High Condominiums exceed the maximum gross residential floor area allowed for this site (please note: these records were accurate as of 1981,and do not necessarily represent current conditions). Chapter 18:NONCONFORMING SITES,USES, STRUCTURES AND SITE IMPROVEMENTS, states:"Structures which do not conform to density controls may be enlarged, only ifthe total gross residential floor area of the enlarged structure does not exceed the total gross residential floor area ofthe preexisting non- conforming structure."Based upon this section of the code,you will not be able to add additional GRFA to your unit.However,you do have the opportunity to apply to the Planning and Environmental Commission for a GRFA variance to allow for the expansion ofyour unit.A similar type of variance request was requested for Unit 9 at the Vail Sky High Condominiums in 198I.At that time,the Planning and Environmental Commission determined that there was no hardship to warrant a variance and the request was denied by a vote of 4-1. Ifyes was answered to any of the questions then a "Public Way" is required.You can pick up an application at either Community Development,located at 75 South Frontage Road or Public Works,located at 1309 Vail Valley Drive. 2.Notice sign offs for utility companies.All utilities must field verify (locate) respective utilities prior to signing application. Some utility companies require up to 48 hours notice to schedule a locate. 3.A construction traffic control/staging plan must be prepared on a separate sheet of paper.An approved site plan may also be used.This plan will show locations of all traffic control devices (signs, cones,etc.)and the work zone, (area of Construction,Staging, etc.).This plan will expire on November 1st and will need to be resubmitted for approval through the winter. 4. Sketch ofwork being performed must be submitted indicating dimensions (length, width and depth ofwork). This may be drawn on the traffic control plan or a site plan for the job. 5.Submit completed application to the Public Work's office for review.Ifrequired, locates will be scheduled for the Town of Vail Electricians and Irrigation crew . The locates take place in the morning,but may require up to 48 hours to perform. 6.The Public Work 's Construction Inspector will review the application and approve or disapprove the permit. February 10,1999 Ms.Kerry Lawson Vail Sky High Condominiums 2448 Garmish Vail,Colorado 81658 Dear Kerry, On January 29,I met you at the property to examine the exterior stair structures at either end of the building.You also provided me with a report stamped by Steven Lewis of Engineering Designworks,lnc.,dated August 19,1997,in which he made some recommendations for the same stair structures,(attached). Observations There had clearly been some work done on the stairs since the report by Lewis. Specifically,the foundation under the posts appears to be complete,although it is obviously not possible to determine at this point if the reinforcing was done correctly, and according to Engineering Desigriworks'details.I did note,however,that the 5/16"steel plate that connects the post·to the concrete pier was not built according to Detail S,as there are only 2 bolts visible at each post instead of 3 bolts.Also,as you pointed out to me,the posts on the eastern stair had been cut about 3 feet above the piers, and the lower portion was replaced.This left a connection that clearly was not resisting the lateral motion well. The Engineering Designworks report also suggested the replacement of the existing 2x6 cross bracing with 6x6 cross bracing.This had not been done. Other factors which I observed,and which I believe contribute to the insecure feel ing at the upper landing of the stair are the following: • The railings as they exist are approximately 36"high,and they are in disrepair. • The stringers,or the sloped support beams for the stair,are connected to the posts inconsistently,and in some places not at all. •Many of the connections throughout the stair construction are loosening up over time. • Each stair tread consists of a single 2x12 supported at each end,without an intermediate support. Recommendations •Provide a steel connection at the joint in the posts above the concrete piers on th e eastern stair,which is similar to that in Detail B by Engineering Designworks. Provide three bolts above and below the joint,and place the plates on the north and south sides of the posts. •Provide 6x6 cross bracing at each intermediate landing,according to the specifications by Engineering Designworks. • Replace railings with 42"high railings at landings.A design which incorporates angled members from post to post could help with overa ll cross bracing of the structure. • Replace stringers,bolting them directly to the structural 6x6 posts.An additional option is to add an intermediate stringer at each flight. I believe that the first three of these ideas will make a substantial difference in making the stairs feel secure.The last suggestion involves a great deal of reconstruction,and you might not find it worth the effort.An easier alternative would be to inspect each of the stringer/post connections and to reinforce them with lag bolts. Observations There had clearly been some work done on the stairs since the report by Lewis. Specifically,the foundation under the posts appears to be complete,although it is obviously not possible to determine at this point if the reinforcing was done correctly, and according to Engineering Designworks'details.I did note,however,that the 5/16"steel plate that connects the post to the concrete pier was not built according to Detail B, as there are only 2 bolts visible at each post instead of 3 bolts.Also,as you pointed out to me,the posts on the eastern stair had been cut about 3 feet above the piers,and the lower portion was replaced.This left a con nection that clearly was not resisting the lateral motion well. The Engineering Designworks report also suggested the replacement of the existing 2x6 cross bracing with 6x6 cross bracing.This had not been done. Other factors which I observed,and which I believe contribute to the insecure feeling at the upper landing of the stair are the following: •The railings as they exist are approximately 36"high,and they are in disrepair. •The stringers,or the sloped support beams for the stair,are connected to the posts inconsistently,and in some places not at all. •Many of the connections throughout the sta ir construction are loosening up over time. • Each stair tread consists of a single 2x12 supported at each end ,without an intermediate support. Recommendations •• •Provide a steel connection at the joint in the posts above the concrete piers on the eastern stair,which is similar to that in Detail B by Engineering Designworks. Provide three bolts above and below the joint,and place the plates on the north and south sides of the posts. •Provide 6x6 cross bracing at each intermediate landing,according to the specifications by Engineering Designworks. • Replace railings with 42"high railings at landings.A design which incorporates angled members from post to post could help with overall cross bracing ·of the structure. • Replace stringers,bolting them directly to the structural 6x6 posts.An additional option is to add an intermediate stringer at each flight. I believe that the first three of these ideas will make a substantial difference in making the stairs feel secure.The last suggestion involves a great deal of reconstruction,and you might not find it worth the effort.An easier alternative would be to inspect each of the stringer/post connections and to reinforce them with lag bolts. VIII.CONCEPTUAL DESIGN REVIEW A.Submittal requirements:The owner or authorized agent of any project requiring design approval as prescribed by this chapter may submit plans for conceptual review by the Design Review Board to the Department of Community Development.The conceptual review is intended to give the applicant a basic understanding of the compatibility of their proposal with the Town's Design Guidelines.This procedure is recommended primarily for applications more complex than single- family and two-family residences.However,developers of single-family and two-family projects shall not be excluded from the opportunity to request a conceptual design review.Complete applications must be submitted 10 working days prior to a scheduled DRB meeting. Peter Pat ten gave the background and l isted corrections to the memo .They were that the lot s i ze should be twice as l arge.or 20,908 sq ft.Dick Brewer introduced himself and his representative,Ray Storey.Ray explained the Brewers'position,stating that the development was now primarily f or empl oyees , and were l ess exp ensive units -~difficult to sell now because of financing.He a dded that the porch was already defined,and that it had 4 of the 6 sur faces ,and t hat no more space would be added,that the entrance would be improved. Dick Ryan stated that for the 2-1/2 years that he had been in the Plannin$ offices,there had been much t alk of trying to improve this part of the Village and .much talk of making the alleyway a viable walkway.He felt that the project was a tremendous improvement to the Village. Gordon Pierce,architect for the project,showed slides and talked about scheduling the construction.He stated that after Labor Day,the plan.was to take out the trash,equipment and partitions that weren't ne eded.He added that the contractor felt that he could meet the planned schedule.Discussion followed with concern expressed that the project not look half finished through wint er,and maybe using a finish material on the exterior if work was stopped part way through. The northwest corner of the building was discussed,some members feeling that the building should not be extended out at that point.John Donovan also objected to the extension.Others felt that a small projection might be better than a flat wall in that area. Gordon spoke of lowering the alley 2 or 3 feet to make it lighter and airier, and possibly to have glass looking into Pistachio's restaurant. The proposal discussed at this point did not include the alley or the extension at the northwest corner of the building,and these two items were to be continued for 2 weeks . Dan moved and Roger seconded to approve the exterior alteration and modification to the Casino Building as stated in the memo with two add itional conditions : 1.That the finished facade be compl et ed before Christmas or the applicant do :1 t reat ment .simil rrr t o t hc unfi.ni shed commercial space at the Gondcla bui l :'i.ng, 2. Dick Ry an presented the memo and stated that this was a s ignificant proposal f or Vail.He a dded that the Urban Desi gn Guide Pl an discusses including more common sp ac eand en courages a new entry concept into the mall from t he east,and this proposal f ul fills some major objectives of the UDGP and was an improvement to the community. Much discussion about parking followed.Gerry f elt that parking was a major i ssue in t his proposal,and that the loss of pa rking did not justify the propos al. Dick fel t that thi s IWS the purpose of the 1100 s pace parking structure,that i t wasvpl anned knowing there would be more demand l ater.Gerry predicted that the parkin g structure was not going to be bi g enough, and sooner or l ater more parking was going t o be needed. • ••~EC -4-8/31/81 Bill Ruoff showed plans and a model.Dick added that the staff's biggest concern was that Lionshead become more successful,and that something significant needed to be done there. Jay Peterson stated that every project included a compromise.He added that they couldn't make a good entrance and solve Vail's parking problem.Lionshead has difficulty in this area,needs commercial space here,and that the parking problem wouldn't be worsened,he felt.Gerry felt that one problem would be solved while creating another with the parking.Dick felt that they didn't want to see parking used by people who come to the commercial area.that these people should be parking in the parking structure and that this would also reduce congestion. Dan stated that both parking structures were designed for expansion later. Dinah Chapman,president of the Lionshead Association of Businesses stated that in June Bill Ruoff had presented his plan to about 30 members of the association, and that parking was mentioned,and no complaints were received.She added that with the present situation.the alley was usually blocked and parking illegally used.The people at this meeting were ecstatic over the proposal. Gerry felt that the Lionshead parking structure would soon be too crowded to park there.Roger suggested that the other members voice their opinions. Duane said that he was in favor of the proposal,Dan said that he was also in favor,Jim felt that it was a vast improvement to the situation there,and Roger stated that he had been working in Lionshead for the past 6 years,trying to breathe some life into the commercial aspect,and that this appears to address the most serious problem and recommended approval,He added that when the parking problem becomes more serious,the planning commission would address it and solve it.a:t.tl)at t ime, Jim moved and Roger seconded to recommend approval of the amendment to the Urban Design Guide Plan to the To\m Council.The vote was 4~1 in favor (Gerry against). The plot involved was down-zoned from high-density to primary-secondary when the Town of Vail annexed West Vail.Prior to the annexation,the GLA allowable on the plot for a high-density dwelling was 12,000 square feet.As it exists,the total GLA of the building is only 8,595 square feet-- about two-thirds of what was allowable under the previous zoning ordinance.So while the property was one-third underbuilt under the previous county zoning,it is now overbuilt with reference to the Town of Vail density restrictions.
