Background On This Request. The applicant initially came before the Design Review Board at their November 7th meeting, The concensus of the Board at that time was that the awning design was being forced" onto the elevation and was incompatible with the architecture of the building. The applicant requested a tabling and no vote was taken on the request. A revised application was submitted to the Board, at their December 8th meeting. This second application was what was ultimately den.i_ed by the Board and is being appealed to the Counci:l. Findings of the Design Review Board.. The formal reason cited in this denial was that the proposed awning was incompatible with the existing architecture of the building, The specific section cited from the. Resign Review guidelines was 18.,50,150 A. l: "Structures shall be compatible with existi:ng structures, their surroundings and with Vail's environment. I;t is not to be inferred that buildings must look alike to be compatible. Compatibility can be achieved through the proper consideration of scale, proportions, site planning, landscaping, materials, and colors, and compliance with the guidelines herein contained," 0 Other comments made by the Board that referred to more specific problems with this design included: 1. The treatment of the awning around the windows is contradictory. 2. There is a problem with the dual form of the awning curving around the window while sloping away from the building. 3. Limited space between the decks and the windows does not allow for an awning to be constructed comfortably. 4. Any awning projecting away from the building will detract from the architectural features of the building. With the exception of three elements of this proposal, the Design Review Board gave final approval to the Golden Peak Base Facility on June 20, 1984. is Vail Associates has since gone through a number of design changes for this project. They have before you today for final consideration of their proposed plan. The three outstanding issues from the Design Review Board's last review include: 1. Terrace seating on the courts adjacent to the structure. 2. The new Chalet Road tennis court. 3. The use of split face block for retaining walls. CHANGES TO PREVIOUS SUBMITTAL. There are a number of significant changes that have been made in the design of this facility. These include the following: 1. The Chalet Road tennis court is no longer an element of this proposal. In lieu of this court, Vail Associates will construct two tennis courts located south of the proposed facility. An alternative plan for the Chalet Road area will be presented to you today. 2. The bleachers proposed for the west end of the facility have been eliminated from this plan. Temporary bleachers will be installed for specific events. In addition, the design of the terraced seating has been re -worked and will be reviewed today. 3. The bus turnaround.area has been.slightly re -designed. This results in the elimination of the Race City Parking. 4. The proposed water feature on the east end of the structure has been eliminated. Hydrologic conditions have necessitated this change that will result in the stream being culverted with landscaping installed in the area that was originally proposed to be a stream feature. 5. In addition to the above mentioned changes, there have been a number of minor changes to the design of the building. The attached list from Snowden Hopkins Architects outlines each of these changes. 6. While not a change in design, for your review today is a final landscape plan for the site. This is the first opportunity the Design Review Board has actually had to review in detail the landscaping for this proposal. CONDITIONS OF APPROVAL There are a number of conditions relative to this application that would have to be met prior to the issuance of the building permit. The staff would recommend the following conditions would be placed.on this approval: 1. Vail Associates complete the annexation process of this site. 2. The final subdivision plats be recorded. is 3. Vail Associates agree to a revocable right of way permit for improvements made in Town of Vail right of way. 0 n Golden Peak Ski Base Facility 1/15/85 Changes to Exterior since DRB Approval of 6/20/8+ North Elevation 1. Large dormer of Unit 6 roof pitch is now 6:12 from 8:12. Alow better headroom. 2. 3 new chimney elements on east side for kitchen exhaust and trash flue vents. 3. Kitchen louvers added to wall at kitchen. 5. Column spacing changed at 2nd floor. 6. Canopy may or may not be at retail - part of signage design to be detailed later. 7. Wood siding changed to stucco at large south dormer side wall. 8. Chimney relocated from West wall to ridge at large south dormer. 9. Small boiler flue added at roof ridge near grid M. 10. Backqround On This Request. This application was first presented to the Design Review Board in November of 1984. The application was tabled and brought back to the board in December, where it was ultimately denied by a 4 to 0 vote. It was the general feeling of the Board that the design of the awning was contradictory to the existing architecture of the building. Specifically, section 18.50.050 A.1 was cited from"a the Design Review Guidelines in the motion for denial. Other comments made by the Board during the review included: 1. The treatment of the awning around the window is contradictory. 2. There is a problem with dual form of the awning curving around the window while sloping away from the building. 3. Limited space between the decks and windows does not allow for an awning to be constructed comfortable. 4. An awning projecting away the building will detract from the architectural features of the building. Following denial from the Design Review Board, the applicant appealed this decision to the Town Council. Findings of the Council.� . The Town Council unanimously upheld the decision of the Design Review Board by a 7 to 0 vote at their January 15th, meeting. At that meeting, the main concern expressed by the Council was with the uncertainty as to exactly how the awning would appear. It was suggested by the Council that the applicant do further drawings, or construct a model to demonstrate how the awning will be constructed on the building. The applicant agreed to take this advice and return to the Town with a more detailed application. It is generally the policy that the same application denied by the Design Review Board cannot be resubmitted for their consideration again. With respect to this policy, Vail Sports would not be allowed to return with essentially the same proposal. However, under these circumstances the applicant has been allowed to return to Design Review Board with the same proposal as previously submitted. This acception was made because of the concern at the Council level with the level of detail demonstrated in the plans submitted. Braun fowl T5 south frontage road vail, Colorado 81657 (303) 476-7000 MEMORANDUM TO: Design Review Board FROM: Department of Community Development DATE: January 30, 1985 RE: Mariachi's Restaurant Sign Variance Request office of community development Mariachi's Restaurant is requesting a variance from Section 16.20.190 of the sign code to allow placement of an additional business identification sign with a size of 12.8 square feet. Mariachi's is located in the lower level creekside of the Kiandra Lodge east building. Due to insufficient frontage of the establishment, the maximum signage allowed under provisions of the sign code is three (3) square feet. This allowable signage is currently displayed on the awning over the entrance to the arcade that leads to the stairway of Yr_ Mariachi's Restaurant. The applicants request is to install a 12.8 square foot business identification sign at the top of the stairway that leads down to the ...,--..-.-,restaurant entrance. The applicant feels that a hardship exists due to the location of the establishment within the building. The Community Development Staff feels that the requested variance for 5� the size of the sign is not justified. While we do agree that there is i t ;Trw;r, need for an additional sign, we feel that the size is quite excessive. ti* FINDINGS Before the board acts on a variance application, the applicant must prove zphysical hardship, and the board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way, which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the particular business or enterprise to which the applicant desires to draw attention, and do not apply generally to all businesses or enterprises. B.. That such special circumstances were not created by the applicant or anyone in privy.to the applicant; C. That the granting of the variance will be in general harmony with the purposes of this title, and will not be materially detrimental to the persons residing or working.in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general; D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicant's business or use, E. Such other factors and criteria as the Design Review Board deems applicable to the proposed variance. STAFF RECOMMENDATIONS The Department of Community Development Staff recommends denial of the proposed variance. While we fee that there is a need for a sign in this . location, we feel that the requested variance in size is too much of an extreme from the provisions of the sign code. We suggest that the applicant re -submit an application for a one or two square foot sign, perhaps with an arrow to direct people towards the restaurant entrance. BACKGROUND ON THIS PROPOSAL The staff was directed'by the Town Council to.investigate the appropriateness of our existing guidelines regulating the installation of satellite dishes in the Town of Vail. This direction was prompted by the application for a satellite dish that was considered'by the Council on appeal. At that hearing, it was felt by the members of the Council that our guidelines were difficult to work with for reviewing a satellite dish application. More specifically, it was felt the guidelines were open ended, subjective, and did not provide the applicant, the Design Review Board or the Council adequate criteria with which to review an application. At the present time, the guideline: addressing satellite dishes reads as follows: Satellite dishes and similar structures shall not be allowed unless • substantially screened from view by fences, berms, or landscaping. This guideline is found in the Design Review Guidelihes.- At this time, an application for a satellite dish would be reviewed by the Design Review Board for compliance with this guideline. Since the dish appeal considered by the Council last fall, the Design Review Board has considered one application for a dish installation. That installation, located in the Potato Patch subdivision, was approved by the Design Review Board. AN EVALUATION OF OUR EXISTING GUIDELINE In evaluating the appropriateness of our existing guideline, the first step taken by the staff was to look at regulations implemented in other communities as well as to do onsight visits of satellite dish installations. .Over 20 communities have been contacted concerning their regulations and site visits were made throughout Eagle County, Denver, Boulder, and Aurora. -Two factors became very evident as a result of this research. First of all, the quality of installations in communities without regulations would be generally considered quite poor. Secondly, there are many similarities in the elements addressed by communities who have enacted regulations. These areas addressed by these regulations include height, size, location (i.e. setbacks and easements), approval process required and aesthetic control (i.e. screening, architectural integration). In our last work session, the staff proposed to the Council that any revision to our . existing guidelines address these five elements. Additional comments from the Council concerning the installation of dishes in the Village and Lionshead areas are also being considered by the staff. Satellite 2/19/85 -2- THE PURPOSE OF REGULATING SATELLITE DISH INSTALLATIONS Residential satellite dish installations have increased dramatically over the last few years. Industry projections indicate that the number of ,residential installations will double in the next year. In response to this, local governments have enacted legislation regulating installation of these dishes. There are a number of reasons for these installations being regulated. These include: 1. Safety The foremost consideration with respect to safety and the public welfare relates to where and how a dish is installed. These aspects are generally addressed by requiring a building permit before an installation is made. 2. Zoninq Considerations The most common factors addressed under zoning considerations would be height, location, and number of dishes on any given lot. . 3. Aesthetic Control Some degree of aesthetic control is included in approximately half of the ordinances surveyed by the staff. The most common means for addressing aesthetic control is through screening the dish. Materials used for screening include berms, landscape materials, buildings, and fences. Other considerations for minimizing the visual impacts of the dishes are the material of the dish and the color of the dish. While not discounting the importance of zoning and safety considerations, the most important concern in preparing this revised ordinance is with respect to aesthetic control. Generally speaking, it will be the intent of this ordinance to regulate the installation of dishes so as to mitigate their visual impact to the highest degree possible. In order to understand the type of installation the staff would like to see result from this new ordinance, it is important to recognize what factors contribute to whether a dish installation is done well or not. In looking at different installations, it becomes.very apparent as to what factors affect .the visbal,,impact of a dish. These factors include: 1. Size An 8 foot diameter dish will generally not have the impacts . of a 15 foot diameter dish. This consideration is fairly obvious. -3- Satellite 2/29/85 2. Color. Most dishes can be painted with any latex paint. The color of a dish can greatly affect its visibility with respect to the sites and environment in which it is placed. 3. Materials There are basically three materials used in the construction of dishes. These are stainless steel, mesh, and fiberglass type of shell. Each of these have different qualities relative to the degree of visibility. 4. Location. The location of the dish greatly affects its degree of visibility. Rear yard installations will generally be less visible from public right-of-ways than front yard installations. However, rear yard.installations may be more offensive to adjacent property owners. 5. He� ight. As is the case with the location of a dish, the height of a dish greatly influences its visibility. The issue of height becomes more noticeable when considering roof top installations. 6. Degreeof Screening. Screening a dish with landscaping, berms, fences, or existing structures can do a great deal to minimize the visual impact of the dish. This is probably the key factor in miti- gating the visibility of an installation. 7. Architectural Integration. In looking at a number of dish installations, it became apparent that dishes could be installed and integrated architecturally into the design of a structure. This was particularly true with mesh type dishes. Each of these above mentioned design considerations affects the visual appearance of a dish installation. These factors will be used in reviewing dish applications for compliance with the design review section of this new ordinance. Y STRUCTURE OF THE REVISED SATTELITE DISH REGULATIONS The ordinance revisions proposed by the staff .includes two sections. The first of these would be a section added to to the Supplemental Regulations chapter of the zoning code. This section will address factors such as height, size, and the locations where dishes are allowed. The other section of this ordinance will involve a major revision to the Design Review Board Guidelines that address satellite dishes. This section will address issues such as color, materials, and screening of the dishes. This review will be similar to the process one goes through when applying to construct a new residence. In this case, an application is reviewed with respect to zoning considerations as well as Design Review Guidelines. The following are the elements each of these two sections will address. 0 -4- Satellite 2/19/85 0 SUPPLEMENTAL REGULATIONS Compliance with the following regulations will be required before a dish is reviewed by Design Review Board. If these zoning considerations cannot be met, an applicant may apply to the Planning and Environmental Commission for a variance as outlined in Section 18.52 of the Municipal Code. This new section of the Supplemental Regulations chapter of the zoning code will address the following areas: 1. Definition of a Dish These regulations and guidelines shall apply to any device meeting the following definition: A dish shaped or parabolic shaped reception or transmission antennae, which is more than two feet in diameter (including dishes stored or temporarily placed for more than one day) for the reception and/or transmission of satellite signals, including television signals, AM radio signals, EM radio signals, telemetry signals, data communications signals or any other reception or transmission signals using free air space as a medium, whether for commercial or private use. 2. Number No more than one satellite dish shall be allowed on.any lot within the Town of Vail. 3. lemp_orary Installations The temporary use and/or installation of a satellite dish shall be limted to a maximum period of one day. Only three temporary installations shall be allowed per business or residence per year. 4. Height Maximum height allowed for any dish installation, when measured from the top of a dish down to existing or finished grade, whichever is more restrictive, shall not exceed 15 feet. 5. Size of the Dish The maximum size of any dish installed.shall be limited to 9 feet in diameter. b. Dish Identi_ficationZAdvertising No advertising or identification shall be allowed on any dish installed that is visible or legible from any adjacent property or public right-of-way. -5- Satellite 2/19/85 . 7. Location of the Dish Installations Dish Installations shall comply with existing setback requirements of the zone district in which the dish is installed. The installation of dishes shall be prohibited in easements.and public right-of- ways. 8. Building Permit Issuance of a building permit from the Community Development Department shall be required prior to the installation of a dish. 1, 9. Vail Villa a and Lionshead Core Areas The exterior installation of satellite dishes in the Vail Village and Lionshead core areas shall be prohibited. These prohibited areas are outlined in attachments A and B. _ , The only installations allowed in these areas shall be those totally enclosed by some type of structure. Structures"required to enclose""a dish in these areas.shall be -required to:meet all applicable zoning requirements. 10. Variances Variance requests may be made for any of these provisions. The review of these variance requests would be done by the Planning and Environmental Commission. Applications for variances would be made to the Community Development Department as outlined in Section 18.62 of the Vail Municipal Code. Once an application has satisfied the above requirements, or received a variance to them, applicants may apply for review by the Design Review ,'Board. The following guidelines shall be considered in the design review of the satellite application. DESIGN REVIEW GUIDELINES It is the intent of the Supplemental Regulations, and more particularly these design review guidelines, to minimize the visual impact of any satellite dish installation. As was mentioned earlier in this memo, mitigating the visual impact of a satellite dish can be accomplished in a number of ways. Whereas, the existing design review guideline allowed only for the screening of the dishes, these revised guidelines will allow greater flexibility in how to mitigate the impact of a dish. Generally speaking, the purpose of this is to insure that the visibility of a satellite dish from any public right-of-way or adjacent properties be reduced to the highest degree possible. This may be accomplished a number of different ways. The following guidelines shall be used by the Design Review Board in evaluating any dish application: Y. The use of mesh dishes is highly encouraged. In reviewing applications for mesh dishes, consideration will be given to dishes that are architecturally integrated in to the design of a structure. While . some degree of screening will still be required of mesh dishes, an application that is successfully integrated into the design of a structure may require a less amount of screening materials than a solid dish installation. When integrating a mesh dish with -a structure, the use of similar colors of the dish and the structure shall be required. 2. The use of neutral colors and/or earth tones is highly encouraged. Other colors and dishes with reflective surfaces shall be discouraged. Dishes may be painted to provide for a more sensitive installation relative to the environment in which the dish is proposed. 3. Solid dishes shall be screened from view from any public right-of-way or adjacent property to the highest degree possible. This may be accomplished through the use of landscape materials; fencing, existing structures, subgrade placements, or other means that both screen the dish and do not appear to be unnatural on the site. STAFF RECOMMENTATION The staff has learned a great deal over the last few months about satellite dish installations. Based on our research, the staff feels strongly that Vail needs more specific regulations addressing satellite installations. It is felt that an ordinance similar to the one outlined in this memo will provide Vail with workable guidelines for the applicant as well as resulting in installations with a minimal amount of visual impact on adjacent properties and the community as a whole. The staff would encourage your comments and suggestions concerning this presentation. Given the direction by the Council, the staff is ready to proceed with the necessary approval processes to establish this ordinance. • Robert L. The drainage plan needs to be revised. How is roof drainage handled? Where does the water go after it reaches the northwest corner of the building? I believe that you and Bill Andrews arrived at an understanding of how the drainage should be handled for the A & D Building. This will need to be reviewed thoroughly at the time of building permit review. 2. Does the roof overhang onto Town of Vail property? It was determined that the roof does overhang 1'3" over Town of Vail property. Bill Andrews did not have a problem with the roof overhang. 3. Details on the south elevation of the building as per the requirements of Steve Patterson should be submitted. Steve Patterson and Buff Arnold are still in the process of trying to work out the elevation for the south side of the building. 4. Utility sign -off sheet will be completed. Buff Arnold will work on getting the signatures for the sign -off sheet. 5. Are you going to be using existing water taps? Probably more water taps will be needed. 5. Confirm the use of the interlocking Town of Vail pavers. Town of Vail interlocking pavers will be used for the project and the pavers on the north side of the building will be heated. . -2- 7. The curb detail on page L-4 should be maintained along the building where the rock work is exposed to snow removal equipment. • The curb detail will be maintained along all of the rock work similar to the type of curb detail used in the Lionshead Mall. g. More than two weep holes are needed in the wall by the creek on the east side of the building. The architect will look at the drainage for this area more closely. 9. Are windows on the project roll-out windows? Do they impede traffic either pedestrian or vehicle. The windows are not roll-out windows. 10. Indicate the location of the canopy on the site plan, also indicate color. Are you proposing signage on three sides of the awning? The canopy will be in front of the restaurant along Bridge Street, and it will not extend any further than the planter by the doorway. The awning is completely on the owner's property. Signs will either be on two sides of the awning or only on the front of the awning. 11. The sign program should include spaces for loading and no -parking signs (which presently exist on the building) or sleeves for the signs within the paving design if the signs will not be located on the building. Building lighting will be directed into the street. 14. Confirm that tree grates are at grade. Also, will the 3/4" wrought iron guards around the trees be strong enough to withstand possible snow plow beatings, etc.? Tree grates are at grade and Buff will check into the 3/4" wrought iron. 15. Flood plain modification: An application must be made immediate) to the Planning and Environmental Commission to review the -hoc P ain modification proposal. FEMA and the Army Corp of Engineers must be informed of the flood plain modification. Final DRB approval is contingent upon the PEC approval of the modification. Buff will make an application to PEC for flood plain modification. -3- 16. An updated materials sheet is probably rir•eded. Buff agreed to fill out a new sheet to show the new landscaping and • other minor changes in the building. 17. A pedestrian easement will be provided along Mill Creek. This pedestrian easement should be written and submitted to staff as soon as possible and definitely before a building permit will be issued. This will be submitted at the time of building permit if not sooner. 18. Approval of the encroachment on Town of Vail property in the area of the east patio must be addressed. Town of Vail approval is necessary in order to construct a portion of the patio on this property. How will the patio walls be built without encroaching on existing utility lines? A revocable right-of-way agreement will be filled out for planters and any other encroachments on Town of Vail property at the time of building permit application. 20. I will take care of writing that letter and have it ready for you at the time of building permit. • F- L� TO: Planning and Environmental Commission FROM: Community Development Department DATE: March 11, 1985 SUWECT: Request for a conditional use permit to construct a base facility for a new quadruple chair lift called the Vista Bahn. Applicant: Vail Associates DESCRIPTION OF PROPOSED USE Vail Associates is proposing to construct $10 million worth Of improvements on Vail Mountain in the summer of 1985. One of the major improvements scheduled is a new quadruple chair lift from the Village base area to mid -Vail. This lift will replace existing chair lift No. 16 and increase the capacity from 1200 to 2650 people per hour. A 12% shift in the route the skiers take up the mounthe mountain will occur so that 54% of t skiers will now go out of the Village. The site is located on Tract E, Vail Village 1st Filing and is awned by Vail Associates and zoned Agricultural and Open Space. The base building for the lift is approximately 2,072 square feet and is a low --profile designed building. It is to be located immediately to the north of the existing Chair Lift 16 tension terminal. The mature stand of pine and aspen trees will be affected by the proposal for the base building. Please refer to the at hed site la and perspective drawing for a better understanding ofcthe proposal• CRITERIA AND FINDINGS Upon review of Section I8.6Q, the Community Development De artment -°recommends approval of the conditional use permit based upon the following factors: ""Consideration of Factors "Relationship and impact of the use on development objectives Y: ' of the Town ,`The upgrading and expansion of lifts and Facilities on Vail r: Mountain is crucial for the long term success of the Town of Vail. We must continue to recognize that skim s r - ...,- always will be this Town's number one industry continues and y and its reason for existence. Vail Mountain must maintain its place in the ; market as No. 1 so that we can be competitive for the shrinking skier market in the longterm. Thus, the ' proposal to construct this quad lift is one element of an overall mountain development plan containingfive e phases which will assure the continued success of Vail Mountain and this, of course, is very consistent with the development objectives of the Town of Vail. .ti, ���MK�J �J ,sa• . - The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. A. Effect U on Utilities As you can see on the enclosed site plan there exists a ten foot utility easement adjacent to the property line and the proposed base facility encroaches upon this easement. A setback variance from the 20 foot requirement in the AOS zone is required and is addessed in an attached mercorandum. There are no utilities in this easement at this time, and Vail Associates is currently in the process of obtaining app_ r� is from each utility to construct over the 6easement. B. Vail Institute Tent The construction of the quad lift base building will encroach upon the Vail Institute tent area to the extent that it will be unusable this summer. We have received verbal permission from the summer users of the tent (Vail Institute, CMC, and Rotary) that they agree to the construction and did not wish to use the tent for their events this summer anyway. Effect upon traffic witihiparticular reference to congestion, automotive and 2edestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street. axed parking areas. Parking In January a parking task force was formed consisting of members of the Town staff, Duane Piper, Dan Corcoran, Hermann Staufer, Joe Macy and Nolan Rosall. The purpose of the task force was to study the parking problems created by the installation of the new quad lift and to solve the existing shortage of parking spaces in the Village area as well. The task force was charged with making both short and long term recommendations through the Planning Commission and Town Council in an attempt to solve this parking problem. Projections done by Nolan Rosall and Vail Associates show that the quad lift alone will increase the demands for parking in the Village by approximately 230 spaces on a peak day (see attached letter from Joe Macy). On top of the 230 space shortage for the lift, we are currently 330 spaces short of meeting today's demand on the Village parking structure. Thus, the parking task force is addressing a parking shortage of the magnitude of approximately 560 spaces and is very close to making recommendations for short and long term solutions. In general, the task forces recommendation for the short term will center around re-alloction of the local and resident use of the Village Transportation Center to allow increased day skier use of the Village structure as well as converting a major portion of the Golden Peak base area parking to day skier parking rather than Vail Associates employee parking. The task force has a meeting this Friday, March 8, to finalize our short term recommendations which will be presented in more detail to the PEC this coming Monday. We feel the task force has made significant progress in the 2 months we've been addressing this problem, and we are confident that we can present viable solutions to the increased parking demand problem. B. Access The construction access to the site is proposed to be from the mountain access road located to the west of the proposed building site. The construction vehicles will cc, -,,e in on this road through Forest Service lend and access the construction site through the existing i„eadow area between the site and the road. Forest Service Epproval is recuired for this access as well as approvals for the entire Mountain improvement plan. A letter which is attached from the . Forest Service explains their upcoming approval process and control over construction activities. C. Staginq Areas Please read the accompanying letter from Vail Associates regarding the staging areas proposed for the lift construction this summer. We feel that the lift is a much needed element in an ;•�:s. overall excellent mountain plan which will signficantly upgrade the quality of the ski experience on Vail Mountain. The accom- plishment of the five -phase mountain development plan can only be a tremendously positive impact upon the viability of the community. it is absolutely essential that the Town government work very closely with Vail Associates regarding the imipacts on the Valley by making these improvements. Areas which need to be addressed include parking, bus service, increased bed base, as well as other general impacts related to increased congestion. The co=unication between Town officials and Vail Associates is very good regarding this coordination, and we intend to continue these efforts. We feel that there are four important conditions of our approval as follows: 1. Written approvals from all applicable utility companies approving construction as proposed in the 10 foot utility easement before a building permit is issued. 2. Written approvals from the users of the Vail institute tent for the summer of 1985 before a building permit is issued. 3. Vail Associates shall study the relocation of the lift base facility in an attempt to save as many of the existing trees as possible. This study will be done cooperatively with the Community Development Depart,L,ent. 4. He then discussed the effect upon the Vail Institute tent and stated that the staff had received verbal permission from the summer users of the tent to the effect that they 'agree to the construction and did not wish to use the tent this summer. Patten reviewed the memo which dealt with access, related policies in Vail's Community Action Plan, findings and the staff recommendations which included 4 conditions of approval. There was a request for a side setback of 14 feet, which had been reduced slightly by moving the structure slightly south. Joe Macy of Vail Associates stated that they had written approval from 4 of the 5 utility companies and were about to receive the 5th, all of which gave approval for construction in the 10 foot utility easement. (Mike Larson, also of Vail Associates pointed out that only roof overhangs would be ih the easement.) Macy agreed to the 4 conditions and added that VA would plant new trees to replace those cut down for construction. He stated that he was a member of the parking task force and was helping to find new parking spaces in Town. One suggestion from the task force was to make the parking at Golden Peak a pay parking lot for the public and Vail Associates would probably be able to lease parking spaces at Manor Lodge,. Macy felt that there would not be more than a 10% increase in skiers getting onto lifts from Vail Village on a "worst day scenario of 16,000 skiers." Jack Curtin, representing Mrs. Hill who owns property at One Vail Place as well as the Hill Building, stated that Mrs. Hill had no objection to construction of the new lift, and no concern if trees were sacrificed, since more trees could always be planted. Rapson expressed concern about egress of the increased number of skiers, for he said egress was already a problem. Macy said the plan was to widen and improve the Tourist Trap area. Rapson wondered if the gully above could be widened, 'and'Dave Larson of Vail Associates stated that there was a problem because it contained the Town of Vail pump station. Larry Litchliter of Vail Associates pointed out that the Vista Bahn had downloading capabilities, and downloading would be encouraged for the skiers of lower ability. Donovan was unhappy about the fact that Vail Associates would receive the money for skiers parking at the base of Golden Peak. At the present time installations are reviewed with respect to the following Design Review Guidelines: 18.54.050F.3. Satellite dish antennas and similar structures shall not be permitted unless substantially screened from view by fences, berms • or landscaping. It was the feeling of the Council that this guideline is vague, subjective, and generally inadequate for properly reviewing applications. The staff has been researching other ordinances as well as dish installations in Eagle County and the Front Range to.determine how to proceed with.-lrevising.our regulations. I have included memos and other information in this packet to give you some background on the process we have undertaken. An Internally - lit Awning is generally made out of plasticized material that is stretched over an awning frame. The lighting for the awning is located within the structure. The interior light is transmitted throught the plastic material creating a glow throughout the entire awning. Several meetings have been organized to discuss possible ways to review this type of awning. An initial disoussion was held approximately two months ago to review the different types of materials that are available in lighting, possibilities for these types of awnings. At that time the DRB determined that it would be appropriate to actually see a constructed awning in order to determine the pros and cons of this type of awning for the Town of Vail. A second meeting was held in which an -actual Internally - lit Awning was reviewed. Following that meeting the DRB had a discussion session on April 17th. At that time the following concerns were raised by both the staff and the DRB: 1. The awnings serve the same purpose as a sign. Basically the entire awning is lit up in such a way that it appears that the whole structure is a sign. Z. It is very difficult to determine the appropriate wattage given certain types of plastic material. It is difficult to gauge.the appropriate light wattage and transparency due to the ability of different colored materials to transmit different amounts of light. 3. It would be very difficult to enforce the approved amount of wattage per awning. 4. It is very difficult to determine what the awning will actually look like until it is built. This makes it difficult for the DRB to wholeheartedly support an awning proposal when there is a problem in determining what the end result will actually be. • Internally -lit Awnings #2 5. It is felt that this type of awning is basically incompatible with the town's approach to signage, lighting and materials. 6. It is felt that a small number of Internally -lit Awnings that are tastefully designed may be approp- riate in certain locations. However, great concern was expressed over the fact that if one Internally - lit Awning is allowed then they must be allowed in any.other situation. A series of Internally -lit awnings has the potential to create negative impacts on the pedestrian character of Vail's streets. Given these concerns, the staff is suggesting that the DRB avoid trying to incorporate guide lines into the existing code that would • . regulate Internally -lit Awnings. Staff believes that there are many existing references in the code that discourage the use of Internally -lit Awnings. The following list highlights sections of the code that discourage an awning of this type: DESIGN GUIDE LINES Section 18.54.050 Al Structure shall be compatible with existing structures, their surroundings, and with Vail's environment. It is not to be inferred that buildings must look alike to be compatible. Compatibility can be achieved through the proper consideration of scale, proportions, site planning, landscaping, materials, and colors in compliance with the guidd lines herein contained. Section 18.54.050 C3 Exterior wall colors should be compatible with the site and surrounding buildings. Natural colors "earth tones found within the Vail area" should be utilized. Primary colors or other bright colors should only be used as accents and then sparingly such as upon trim or railing. All exterior wall materials must be continued to finished grade thereby eliminating unfinished foundation walls. All exposed metal flashing, trim, flues, and roof top mechanical equipment shall be annodized, painted or capable of weather- ing so as to be non -reflective. • Internally -lit Awnings #3 Section 18.54.050 C11 Exterior lighting shall be designed and located in a manner to minimize impact of lighting upon living areas within a proposed project and upon adjacent structures and properties. SIGN CODE Section 16.16.010 - Harmonious with Town Scale Sign location, configuration, design, materials and colors should be harmonious with the majestic mountain setting and the alpine village scale of the town. Section 16.16.020 - Not dominatin The sign should not visually dominate the structure to which it belongs or call undue attention to itself. Section 16.16.030 - Materials • Sign materials should be predominately natural, such as rough cedar, pine or other types of wood. Stained glass may also be considered by the DRB. Plastic or other materials are discouraged. Section 16.16.040 - Architectural Harmony. The sign and its supporting structure should be in harmony architecturally with the surrounding structures. Section 16.16.050 - Colors Natural colors (earth tones), gray and white should be favoured and bright colors should be used only for accent. Section 16.16.070 - Reflective Surfaces Reflective surfaces.are not allowed. Section 16.16.080 Lighting Lighting.should be of no greater wattage than is necessary to make the sign visible at night should not unnecessarily reflect onto adjacent properties. Lighting sources shall not be directly visible to passing pedestrians or vehicles and should be concealed in such a manner that direct light does not shine through any element of a sign. V Internally -lit Awnings #4 VAIL VILLAGE DESIGN CONSIDERATIONS - ACCENT ELEMENTS A reference is made to awnings and canopys and their uses accent elements for buildings. Canvas and bright colors or stripes of two colors are encouraged. THE LIONSHEAD DESIGN CONSIDERATIONS - ACCENT ELEMENTS F1. The following points are listed to clarify the approval of May 29, 1985: 1. The roof and siding on the lift shack will be Mowhawk Grey. The lift shack roof will be metal and match the roof of the Vistabahn structure. The lift shack door will be grey metal and the windows will be smoke grey. 2. Vail Associates agreed to pay the Town of Vail to relocate the irrigation line located on the site 3. The lettering is white and uses the helvetica medium lettering style. The Mid- Va i 1 V i s to Ba hn l i f t wi 11 be a covered detachable lift with more than twice the hourly capacity of chairlift #1, and will be able to deliver people some 20 minutes faster to Mid -Vail than via chairlifts #1 and #2. The Vista Bahn/chairlift #4 detachable route will also facilitate yo-yo skiing from the summit to Vail Village and that Vail Village will become the preferred up --mountain route. Special Circumstances A practical difficulty is caused by the shape of the structure and its location. Skiers will approach the lift from several directions. Accordingly, signage will be required on three (3) sides of the lift terminal. The circumstances are unique in that the Vista Bahn lift is the only covered detachable out -of -the valley . lift and via signage, in part, needs to be differentiated from fixed grip chairlifts. The color scheme and graphics selected for the Vista Bahn will be utilized for the three other detachables to be built this summer and for additional detachables planned in the near future. The special circumstances were created by the applicant only to the extent that Vail Village was the original base of Vail Ski area. General Harmony We feel that no aspects of this proposal are detrimental to the neighborhood or to the public welfare. in fact, the new lift and associated signage will have a positive impact on our skiers and the public welfare by providing more expedient access up the mountain. We do not feel that the variance applied for is any. more than required given the circumstances. Other Factors With the advent of the detachable lifts, greater emphasis will be given to names of the lifts. This situation largely determines the square footage required for signage on the Vista Bahn." Vista Bahn -3- 6/19/85 FINDINGS AND STAFF RRSPONSRS Before the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures, or other matters on adjacent lots or within the adjacent right-of-way, which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances are unique to the particular business or enterprise to which the applicant desires to draw attention, and do notapply enerall to all businesses or enter- prises. Staff Response: Staff does feel that the Vista Bahn Express deserves special consideration due to the fact that it is a structure and use which is not addressed in the Town of Vail sign code. The Vista Bahn Express must be easily identified by many visitors to Vail who are often times very unfamiliar with the layout of the ski mountain. Staff considers the Vista Bahn Express to be a special circumstance that is unique to the business of running a ski resort. The new signage communicates effectively the name of the lift without drawing undue attention to the structure.. The proposed signage is in scale with the lift structure. Staff believes that there are special circumstances which justify allowing 32 square feet of signage for the Vista Bahn Express. B. That such special circumstances were not created b the applicant or anyone in privy to the a2 plicant: Staff Response: Some type of variance is necessary in order to allow any type of signage for the Vista Bahn Express. Staff does feel that the Vista Bahn Express is a special circumstance. However, the applicant did not decide to construct the Vista Bahn Express with the intent of obtaining excessive amounts of signage. C. That the granting of the variance will be in general harmony with the purposes of this title, and will not be materially detrimental to the persons working or residing in the vicinity, to a Jacent property, to the net hborhood, or to the public welfare ingeneral: Vista Bahn -4 6/19/85 Staff Response: The 32 square feet of signage is compatible with the intent of the sign code. STAFF RECOMMENDATION The Community Development Department recommends approval of the 32 square foot sign variance for the Vista Bahn Express. Among these is an expansion proposed for This .licked !Test located at the lower ground level of the Gondola Building. In approving this proposed expansion, the Planning Commission found that "the proposal complied with the Vail/Lionshead Urban Design Guide Plan and design consider- ations and that the proposal does not otherwise alter the character of the neighborhood." In reviewing exterior alterations in commercial core 102, it is the purview of the Planning Commission to evaluate the impacts and relationship between the proposal and the existing character of the area it is in. In the case of This Wicked hest, the Planning Commission was concerned with the footprint of the building and the roof form more so than the materials and colors to be used in this expansion. It is the responsi- bility of the Design Review Board to address these design details and the overall appropriateness of the design for a given site. The following briefly summarizes some of the design considerations outlined in the urban do design guide plan. HEIGHT AND MASSING an emphasis should be placed on creating ground floor pedestrian activity to overcome the canyon -like effect found throughout Lionshead. Expansions should generally be limited to one story. URBAN DESIGN CONSIDERATIONS as stated in the guide plan, "the challenge in Lionshead is to develop vitality, visual interest and pedestrian scale within a contemporary architectural expression". A major emphasis in any architectural improvement should be to strengthen ground floor visibility and attractiveness in order to establish a stronger sense of pedestrian scale. Where expansions take place, story height shall be defined by existing architectural expressions of floors. ROOFS flat, shaped, vaulted or domed roofs are exceptable and should be tied to the existing architectural lines of the building. Roof overhangs shall be limited from 3 to 36 inches in order to define the eave line. Appropriate materials include metal, glass or plastic. FACADES-MALLS/STRUCTURE primary materials to be encouraged in Lionsh.ead include concrete, concrete block, glass, metal stucco, and wood. Generally, the variety of major materials (and/or colors) on any bu'.lding should be limited to three or less. FACIA -TRANSPARENCY transparency is strongly encouraged on ground floors. While glass should be subdivided with joints or mullions to express individual window elements, large single pane windows are not prohibited. DECKS AND PATIOS these considerations are not applicable to this proposal. ACCENT ELEMENTS colorful accent elements consistent with the existing character of Lionshead are encouraged. LANDSCAPE ELEMENTS generally, colorful plantings are encouraged to accent pedestrian areas and highlight buildings. Curbs and retaining walls are used to define most of the planting areas in Lionshead and when used should be constructed of either concrete or stone. At our next Wednesday meeting, the Board will have an informal discussion of the sign program with the applicant, Dave Tyrell. Even though this area is presently outside of the Town's boundaries due to the de -annexation, the staff felt that it would be helpful to the applicant and the County to document the Design Review Board's opinion of the proposal. Staff has allowed for a brief discussion from 12:00 to 12:30 next Wednesday. The following list is an outline of the staff's opinion on the proposal: I. It is felt that 20 square feet for a building identifi- cation sign is more than adequate. This does allow the applicant 20 square feet on both sides of the sign. With appropriate lighting and landscaping, it is• felt that the building identification sign can easily communicate the name of the shopping mall by using the 20 square foot allowance. 2. The applicant is requesting two directories of 25 square feet each. The staff has no problem with this request. 3. Traffic control signs are normally one square foot. In this situation, staff can see the need for a somewhat larger sign. Perhaps 3 square feet would be adequate instead of the proposed 4-1/2 square feet. 4. Staff believes that the Bill Bullocks sign that is 40 square feet is too large. Twenty square feet with clear lettering would be adequate to communicate the name of the store. The 20 square feet proposed for the west elevation is within our existing sign code. Staff has no problem with this part of the proposal. 5. Staff does have a problem with allowing a 20 foot sign per business. It is felt that the size of the sign should have some relationship to the frontage of the store. Most of the stores in the West Vail Mall could actually have larger signs under the present ocde. Staff would prefer to see the applicant use some type of frontage formula to arrive at the appropriate dimensions for each sign rather than just allotting 20 square feet to each tenant. f. Staff can see some type of need for a projecting or hanging sign that would be seen by pedestrians in front ii • of the business. It is felt that 8 square feet per side of each sign is too large. It. is important to keep in mind the intent of the sign code which is to decrease sign clutter. 7. It is totally unnecessary to allow display .boxes for each tenant with street or arcade exposure. Display boxes are allowed now only for display of current menus, real estate listings or entertainment. The size is to be no greater than 3 square feet according to the existing code. Staff is strongly against allowing display boxes for every type of business. S. Staff is strongly against allowing 25% of the total window space to be covered by sale signs, specials, etc. The code allows 15% and it is felt that this is definitely enough area to allow for that type of advertising. 9. Staff would like to see the applicant address the sign program at a more detailed design level. The type of graphics, specific sign location and colors would be very helpful to understanding the proposal in more depth. 10. Staff also strongly believes that it is very inconsistent to treat West Vail so differently from the Village. Staff acknowledges that it is a somewhat different area. However, the staff does not want to start allowing so much additional signage that the intent of the sign code is completely lost. Staff also believes that residents in the area were told that they would receive the same treatment and quality development that the rest of the Town receives. The following comments were made at the meeting: 1. The board requested that you add evergreen trees on the north elevation so that in the winter time this area does not look so bleak when all the deciduous trees lose their leaves. 2. The board would like to see the specific placement of the shrubs on the south side of the building. 3. Pavers should be used for the stairway that is to the south of the bus drop-off area. 4. Some type of lighting is needed on the stairs adjacent to the bus drop-off. 5. The board suggested that beveling be used on the granite at the base of the loggia pillars. 6. Public Uorks had a list of issues that still needed to be resolved. These items included: a) A drainage plan for the north side of the building. Please add the sidewalk off of the existing pathway coming down to the Westin from the common carrier area. 0 The board felt that it would be important to provide a lane between the common carrier drop-off to the Cascade Theatre. I will schedule the landscape plan to be reviewed by the Design Review Board at their next meeting on September 18, 1985. I would like to receive the revised plan no later than September 13, 1985. During this review process both the PEC and DRS raised concerns • over the appearance of the roof of the Montaneros commercial space occupied by the Charlie's T -Shirt Shop and Lionshead Liquors. As you are aware, the Town of Vail and the Lionshead Merchant's Assocation have expended considerable time and money in the upgrading of the Lionshead Mall. Since completion of the mall project several building owners within the mall have initiated property improvement projects. An improvement to the appearance of the roof would certainly compliment these efforts in continuing to improve the mall area. I would like to request that the Montaneros Condominium Association address these concerns and consider improving the current appearance of this area. I am sure that any positive action taken by the Condominium Association would be appreciated by your neighbors as well as the Town of Vail. Emergency waterproofing necessitated an overlay of felt to protect the membrane. We have been reviewing decorative treatments to cover the felt and eliminate the boardwalk. Hopefully we will have the situation handled shortly. Now that I have your and the PEC, DRB, and TOVTC's attention, I would like to bring up a related matter. On July 30 this summer I sent Stan Berryman the enclosed letter. To date there has been some improvement, but attention has still been erratic at best. As you stated in your letter the Town and property owners in Lionshead have a substantial investment in the mall. Montaneros owners paid over $60,000.00, I believe. I'd hope that the DRB, PEC,, and TOVTC might drop by even more frequently to see how things are going over here, both from a capital improvement and operational aspect. I imagine it's been a real rollercoaster at the Town offices with the West Vail happenings.. I hope the outcome has given everyone a restoration of confidence to know that the populace does trust in the collective ability of the TOV Administration and that the overwhelming majority.of'residents want an already successful format to.continue. I'm glad you gave me a. motivational "kick" to get going on a postponed project and hope you'can accept my concern about "dusting and sweeping" throughout the mall as valid. Currently,there does not appear to be any consistent level of sweeping or trash pick-up off the mall surfaceand it looks terrible. As pretty as all of the flowers are, the cigarette butts and trashmake a poor compliment. I understand that there is a regular pick-up of the container trash and it would seem logical that .a person could have a broom and long handle dustpan with him at the -same time. Better yet, it would also seem feasible that the sweeping machines used in the parking garage could make short work of things on a twice -a -week basis. On at least: 4•-occasiofis-during-:.the summer -of 1983, I personally_.. 7 ran a Clark push sweeper over the entire mall and it took less than an hour. I hope;_that you will agree that.if it makes sense to run the large,'truck sweeper on streets used by cars.,.it surely makes sense to.keep. a ,$2,500,00T improvement clean for people. If:per.chance there is some beaurocratic glitch that prevents the garage .sweeper from beingused, I'll be glad to .loan you our push sweeper and demonstrate the proper way to operate it. For any awning the signage must stay within the allowed signage allotment. 2. For any awning that has more than two signs, the awning must be submitted to Design Review Board. The total signage for the signs must be within the total allowed signage for the storefront. TO: Design Review Board is FROM: Community Development Department DATE: December 18, 1985 RE: Overland and Express Travel Service Sign Variance Request Overland and Express Travel Service is located on the east end of the Village Center Building. According to the Town of Vail sign code formula for signage, Overland and Express is allowed to have 12.40 square feet of signage. At this time, Overland and Express has a dark green awning with Overland and Express Travel Service printed on it twice. The square footage for each sign was approved at 3.2 square feet. The applicant is requesting to locate a free standing sign in the location of the existing post at the northeast corner of the Village Center property. Gail Strauch is proposing to hang the sign from a pole or light post. The clearance will be a minimum of 8 feet. The sign is 6.68 square feet and is made of wood and copper. The staff has a polaroid picture of the sign which will be presented to the Design Review Board at the meeting. Gail Strauch, owner of Overland and Express Travel Service has submitted the following statement as to why she feels the variance is warranted: 1. There is a special circumstance which applies to my location in the Village Center. I am the only business in the project on E. Meadow Drive that does not have exposure directly on East Meadow Drive nor is my sign visible if walking east on East Meadow Drive. 2. The height of the building roof or eaves does not allow a sign to be hung from the eaves within the eight foot clearance requirement. I could not place a sign on the corner of the building to be seen from East Meadow Drive and still meet this requirement. 3. I feel I really do need signage from traffic traveling east on East Meadow Drive and that it is crucial to the success of my business in the Town of Vail to have this proper signage. 4. I feel that these circumstances are unique to my business and do not apply generally to all businesses, that these special circumstances are not created by me, that the granting of the variance will not be materially detrimental to the persons working in the vicinity , to adjacent property, to the neighborhood or the public welfare in general. As a matter of fact it will better facilitate the visitor and local alike to find my service. 5. The frontage of my business allows the awning that I have presently over my door and a sign and that the sign and awning together would not be aesthetically pleasing. FINDINGS OPBefore the Board acts on a variance application, the applicant must prove physical hardship and the Board must find that: A. There are special circumstances or conditions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right of way, which would substantially restrict the effectiveness of the sign in question: provided, however, that such special circumstances or conditions are unique to the particular business or enterprises to which the applicant desires to draw attention, and do not apply generally to all businesses or enterprises. In staff's opinion there are no special circumstances that apply to adjacent lots or adjacent right of way which substantially restrict the effectiveness of signage for the Overland & Express. In addition to Overland & Express's awning, the owner of the Village Center has also received approval from the Design Review Board for two building directory signs. One will be located in the same general area as the proposed free standing sign. The other sign will be at the west end of the Village Center Building. This directory will have one square foot of signage and a map which will show the location for Overland & Express. B. That such special circumstances were not created by the applicant or anyone in privy to the applicant. The applicant did not create any problems in order to justify a sign variance. The applicant is merely trying to maximize the exposure for her office despite the location of her business. However, staff feels that the applicant was aware of the location of the office when the space was leased. C. That the granting of the variance will be in general harmony with the purposes of this title and will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood or to the public welfare in general. The variance request is not in compliance with our sign code. Section 16.20.050 of the sign code specifically states that free standing signs are used only "to identify a business or organization being the sole business occupant within a building." To allow this business, which is in a multi tennant building, to have a free standing sign would conflict with a basic principal of the sign code. The reasoning behind this section of the sign code is to try and avoid unnecessary free standing signs for multi tennant buildings. It is felt that it is reasonable to allow a free standing sign only if the business is the sole occupant within a building. Staff also believes that the location of the sign may possibly impede pedestrian traffic somewhat on the walkway in front of the Village Center building. The project has just been completed so it is difficult to know how pedestrians will use this area. The sign also has the potential to block some of the visibility into Karats windows. D. The variance applied for does not depart from the provisions of this title any more than is required to identify the applicants business or use. W Staff believes that the awning and directory sign provide more than adequate signage for the Overland & Express office. The proposed sign is 6.68 square feet. It is also felt that this size of sign is much larger than is actually necessary to alert pedestrians that the Overland & Express office is on the east side of the Village Center building. E. Such other factors and criteria as the Design Review Board deems applicable to the proposed variance. STAFF RECOMMENDATION: The Department of Community Development recommends denial of the proposed variance. It is felt that Overland & Express does have a visibility problem for pedestrians walking east on East Meadow Drive. However, the awning and two directory signs serve to adequately assist pedestrians in finding the office. The 6.68 free standing sign is not in harmony with the purposes of the Town of Vail sign code. The sign also departs from the provisions of the Town of Vail sign code more than is necessary to identify the applicant's business or use. Staff does not feel that there is a physical hardship due to the location of the office on the east end of the building. The applicant was also aware of the location of the office when the space was leased. It is felt that to grant this variance would be a grant of special privilege as there are many businesses in Vail with unusual locations that would certainly like to have a free standing sign to draw visitors into their businesses. Some examples of businesses with similar visibility problems from main pedestrian or auto access ways include Buzz's Boots 'n Boards on the east end of the Sonnenalp, the interior shops in the Mill Creek Court Building, the Shaft Restaurant in the Enzian and the interior shops of the Vail Village Inn.
