ORDINANCE N0. 10
Series of 1967
AN ORDINANCE CREATING VAIL GENERAL
IMPROVEMENT DISTRICT, VAIL, COLORADO
AND DECLARING AN EMERGENCY.
WHEREAS, Petitions for the organization oL Vail General
Improvement District, Vail, Colorado, have been heretofore filed II
with the Town Clerk of said Town; and
WHEREAS, said Petitions have been signed by at least
a majority of the taxpaying electors of the' proposed district,
who, together with the owners of property within the district
who have signed a consent to inclusion, own property therein
having a valuation for assessment of not less t,~an one-half of
the valuation for assessment of all the real an~~ personal prop-
erty in said district; and
WHEREAS, sai d Petiti on:~ c,cmnly fully wi t_ t,_ the require-
ments of Chapter 89, Arti_cie 4, Colorado Revised Statutes 1963,
as amended; and
WHEREAS, a Bond has been filed to pay all expenses con-
nected with the proceedings in case the organization of the Dis-
trict be not effected, which Bond is hereby approved; and
WHEREAS, on the 5th day of April, 1967, the Board of
l Trustees of said Town adopted an Order authorizing Notice of

Lion to be made of the filing of the Petitions, of the purposes

~~ and boundaries of the proposed District, and of the time and
place of Hearing thereon, such Notice having been pubii5lted once

WfiEREAS, the Town Clerk has also caused a copy of the
Notice of said Hearing to be maned to each taxpaying elector of
the District at hi-s or her Last-known address, as disclosed by the
tax records of Eagle County, Colorado; and
WHEREAS, on the 1st day of May, 1967, at the place and
time set forth in the above order, a hearing was held by the Board
of Trustees relating to the question of the organization of the
District; and
WHEREAS, the Board of Trustees has determined that said
Petitions for organization were. signed by the required number of
taxpaying electors of the District owning the required assessed
valuation of real and personal property t~.lerein; and
WHEREAS, the Board of Trustees has determined, and here-
by determines, that the allegations of said Petitions are true,
and that it has jurisdiction in the premises; and
WHEREAS, the Board of Trustees has determined that the
proposed improvements in said District will confer a general
" benefit on the District and that the cost of such improvements
would not be excessive, as compared with the value of the prop-
erty within the District;
THEREFORE, BE IT ORDAINED i;Y THE BOARD OF TRUSTEES OF
THE TOWN OF VAIL, COLORADO:
1. That said District has been duly organized and
created .
2. That the corporate name of said District shall be
Va1i General Improvement District, Vail, Colorado, by which name

in all proceedings it si,.;l t hereafter be known, and said District
shall be a public or quasi-municipal suhdi..vi_sion of the State of
Colorado and a body corporate with the li,mi ted propri et<~ry powers
set forth in said Chapter 89, Article 4, Colorado Revised Statutes
1963, as amended.
3. The territory to be included in the District shall
be all that land presently incluc;cd within the corporate limits
of the Town of Vaii, Eagle County, Colorado.
4. Within thirty (30) days after the effective date of
this Ordinance, the Town Clerk shall transmit to the County
Clerk and Recorder of Eagle County, Colorado, and to the County
Assessor of said County, copies of this Ordinance to be filed in
s aid off ices .
S. That the governing body of the Town of Vail, Colorado,
shall constitute ex-officio the board of directors of Vail General
Improvement District. The presiding officer of the Town shall be
ex-officio the presiding officer, the clerk of the Town shall be
ex-officio the secretary, and the treasurer of the Town shall be
ex-officio the treasurer of the Board and of the District.
6. That if any one or more sections or parts of this
Ordinance shall be adjudged unenf orceabie or invalid, such judg-
ment shall not affect, impair or invalidate the remaining provi-
sions of this Ordinance, it being the intention that the various
provisions hereof are severable.
7. This Ordinance, immediately on its passage, shall be
recorded in the Town Book of Ordinances kept for that purpose,
authenticated by the signatures of the Mayor and Clerk and shall
be published as required by law.
8. By reason of the fact that the improvements in said

District are i_mperativPl_y needed, it is hereby declared that an
emergency exists, that this Ordinance is necessary to the immed-
iate preservation of the plih7 i_c peace, he,al:th and .~a['~.ty, and that
it shall be in full force and effective five days after publication.
ADOPTED AND APPROVED This 1st day of May, 1967.
