AN ORD3NANCE AMENDING ORDIl~TANCE NO. 4, SERIES OF
19x7, BY THE ADDITION OF A NEW ARTICLE MAKILVG IT

OR OTHER RECREATIONAL FACILITY BY MEANS OF ANY

BOGUS, SPURIOUS, SHAM, FORGED, COUNTERFEI'T' OR

POSSESSION, USE, OFFER, PRESENTATION, SALE, GIFT,
MAKING OR MANUFACTURING OF ANY UNAUTHORIZED TICKET
OR DEVICE UNLAWFUL..
BE IT ORDAIlVED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL:
Section 1. Amendr~Zent
That Ordinance No. 4, Series of 19G7, entitled "AN
ORDINANCE ESTABLISHING THAT LARCENY AND RELATED OFFENSES
SHALL BE UNLAWFUL AND PROVIDING PENAL'.~~~.r;S FOR THE VIOLATION
THEREOF. " is hereby amended by the addition of the following Article 2:
Possession, use, offer, sale, gift, making manufacture or
presentation of any false, simulated, bogus, spurious, sham,
forged, counterfeit, altered, mutilated or unauthorized ticket
or other device or false pretense to obtain the use and enjoyment
of any ski facility or service or other recreational facility.
Section 1: Obtaining or Attempting to Obtain the Use,
Benefit or Enjoyment of Skiing Services or
Facilities or Other Recreational Facility
by False Pretenses.
It shall be unlawful for any person within the Town of Vail,
knowingly, to obtain or attempt to obtain the use, benefit or enjoy-
ment of any skiing service or skiing facility or otl~.er recreational
facility by any false pretense, trick, or deceptive means, method
or device whatever,
Section 2: Possession, Use, Offer, Presentation, Sale or
Gift of False Ticket, Token, Pass, Badge, Pln
or Other Device for Obtaining the Use, Benefit
or Enjoyment of Skiing Services or Facilities

it shah be unlawful for any person within the Town of Vail,
knowingly to possess, offer, use, present, sell, give away, any false,
simulated, bogus, spurious, sham, altered, forged, counterfeit, defaced or
mutilated ticket, token, pass, badge, pin or other device which is not
genuine and authorized for obtaining the use, benefit, or enjoyment of any
skiing service or skiing facility or other recreational facility by the owner,
proprietor, lessee, licensee or operator of such skiing service or facility
or other recreational facility.
Section 3: Making, Simulating, Altering, Forging, Counter-
feiting, or Mutilating Ticket, Token, Pass,
Badge, Pin or Device for Obtaining the Use,
Benefit or Enjoyment of Skiing Services or
Facilities or Other Recreatianal Facility.

to knowingly falsify, alter, forge, counterfeit, deface or mutilate any ticket,
pass, badge, pin or other device entitling the holder thereof to the use,
benefit or enjoyment of any skiing service or skiing facility or other
recreational facility, or to make or manufacture any simulated, bogus,
spurious, or sham ticket, token, pass, badge, pin or other device purporting
to entitle the holder thereof to the use, benefit or enjoyment of any skiing
service or facility or other recreational facility.
Section 4: Definitions
(a) "Person"
When used in this Article 2, the ward "person" shall
include a natural person, partnership, association, joint venture, and
corporation, whether public, quasi-public or private, for profit or non-
profit.
{b} "Skiing Facility"
When used in this Article 2, the words "skiing facility"
shall include any ski tow, ski lift, gondola, or any related property, facility
or thing whatsoever.
(c) "Skiing Service"
When used in this Article 2, the words "skiing service"
sha11 include service and instruction offered or provided by any ski
instructor or ski school, and any service offered or provided in connection
with any skiing facility.

{d) "Recreational Facility"
When used in this Article 2, the words "recreational
facility" shall include ar~y golf course, tennis court or any recreational
property or any related property, facility or thing whatsoever.
