HomeMy WebLinkAbout1971-10 Prohibiting Livestock on Public Streets within the TOV, Providing Penalties for Violations• • • • • ORDINANCE N0. 10 SERIES OF 1971 AN ORDINANCE PROHIBITING LIVESTOCK ON PUBLIC STREETS WITHIN THE TOWN OF VAIL; PROVIDING PENALTIES FOR VIOLATIONS; AND SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the Board of Trustees for the Town of Vail has determined that it is in the public interest to restrict the use of public rights-of-way and streets within the Town of Vail in order to assure the safety and welfare of pedestrians and motor- ists using the same; and WHEREAS, the Board of Trustees has determined that cer- tain livestock should be prohibited on certain public streets or thoroughfares within the Town of Vail; NOW, THEREFORE, be it ordained by the Board of Trustees for the Town of Vail, Colorado, as follows: SECTION 1. DEFINITIONS a. "Livestock" shall mean horses, cattle, sheep, goats, pigs, and any other common farm animal. b. "Street" shall mean and include any public or private street, road, or right-of-way, highway, alley, or any other similar public or private place for the movement or parking of motor vehicles. c. "Person" shall mean any natural individual, partner- ship, copartnership, firm, company, association or corp- oration. SECTION 2. RESTRICTION AND REGULATION OF USAGE OF STREETS It shall be unlawful for any person who is the owner, or any person who may be in possession or control of any livestock to allow such livestock to use or occupy any street in those areas within the Town of Vail zoned "Commercial Core" and Commercial Core II", in accordance with the Zoning Code for the Town of Vail, otherwise known as Ordinance No. 7 (series of 1969). SECTION 3. IMPOUNDING Every police officer or other official of the Town of Vail shall have the right to impound any livestock found upon a public street within the Town of Vail in violation of this Ordinance and place such livestock in a public pound or other place of safekeeping for pur- poses of enforcing the provisions of this Ordinance. In the event it shall be necessary to impound or otherwise detain any livestock, as defined in this Ordinance, the following charges may be imposed upon the person owning or having control of such livestock: Two Dollars ($2.00) per day per animal. SECTION 4. LICENSING In the event the Board of Trustees for the Town of Vail approves the issuance of a license by an appropriate resolution, the right may be granted to persons to op- erate on public streets horse-drawn vehicles such as sleds or wagons, or otherwise permit livestock to use or occupy public streets for parades or other special events, upon such terms and conditions as may be imposed by the Board of Trustees, in which event the licensee shall be exempt from the provisions of this Ordinance. - .• • • • • SECTION 5. PENALTIES Any person found guilty of violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished for such offense by imprisonment for not more than ninety (90) days or by a fine of not more than Three Hundred Dollars ($300.00) or by both such fine and imprisonment. SECTION 6. SEVERABILITY It is the intention of the Board of Trustees that this ordinance or any part or provision thereof, shall be considered severable and if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. SECTION 7. EMERGENCY It is declared that an emergency exists and that this ordinance is necessary for the immediate preser- vation of the public peace, health, safety and general welfare, and shall be in force and effect five (5) days after publication.
