ORDINANCE NO. 8

AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT
FOR THE CONSTRUCTION OF A BUSINESS OFFICE IN A
MULTI-FAMI LY DISTRICT; THE SAME BEING A PORTION
OF LOT G, VAI L VI LLAGE SECOND FI LING, ACCORDING
TO THE RECORDED PLAT THEREOF; AND SETTING FORTH
DETAILS RELATING THERETO.
WHEREAS, the Bank of Vail, a State Banking Association, has
applied for a conditional use permit for the construction of a business
office on a portion of Lot G, Vail Village Second Filing, according to the
recorded plat thereof, this same having been previously zoned Public
Accommodations and having been re-zoned Multi-family District by
virtue of Ordinance No. 7 (Series of 1972); and
WHEREAS, the applicant has complied with all of the requirements
of Article IV, Section 2 of Ordinance No. 7 (Series of 1969) of the Town of
Vail relating to applications for conditional use permits; and
WHEREAS, the Planning Commission for the Town of Vail has
recommended that the Board of Trustees grant the conditional use permit
in order to allow the Bank of Vail to construct a business office or bank
facility on the part of Lot G, Vail Village Second Filing, according to the
recorded plat thereof; and
WHEREAS, a public hearing was duly held before the Board of
Trustees of the Town of Vail, following publication of notice of same in
accordance with Article V of Ordinance No. 7 (Series of 1969), on the
sixteenth day of May, 1972, and at said hearing the Board of Trustees
voted in favor of granting said conditional use permit;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
FOR THE TOWN OF VAIL, COLORADO:
Section 1 . A conditional use permit is hereby granted to the Bank of
Vail for the construction of a business office or bank facility on the following
described property:
A parcel of land situated in Lot G, Vail Village Second Filing,
according to the recorded plat thereof, within the Town of Vail,
County of Eagle, Colorado, described as follows:
Beginning at the Northeast corner of Lot G, thence South
0°23'00" East, 214.47 feet along the East line thereof to the
Southeast corner of said Lot; thence North 75°27'00" West,
150.00 feet along the Southerly line of said Lot; thence North
24°41'23" East, 203.46 feet to a point on the Northerly line
of said Lot, which is on the arc of a 125.00 foot radius curve;
thence Easterly on said Northerly line, 46.29 feet along the
arc of said curve to the left, whose central angle is 21°12'50"
and whose long chord bears South 79°46'35" East, 46.02 feet
to a point of tangent; thence North 89°37'00" East, 13.48 feet
along said Northerly line to the point of beginning.
Section 2. The conditional use permit shall be granted on a permanent
basis in accordance with the zoning ordinance for the Town of Vail, and the
Building Official for the Town of Vail shall issue a building permit for the con-
struction of said facility upon compliance by the applicant with all other require-
menu of the Building Code or other applicable ordinances of the Town of Vail .

Section 3. The Board of Trustees finds that this ordinance is neces-
~ sary to protect the health and welfare of the Town of Vail; that this ordinance
shall become effective upon its introduction and adoption and publication, and
that same should be published in accordance with the laws of the State of
Colorado.
