HomeMy WebLinkAbout1972- 9 Annexting to the TOV Certain Territory Situated in the SE Quarter of the SE Quarter of Section 4, the South Half of Section 3 and the NW Quarter of Section 10, Township 5 • _c • ~ ~ ~ • ORDINANCE NO. 9 Series of 1972 AN ORDINANCE ANNEXING TO THE TOWN OF VAI L CERTAIN TERRITORY SITUATED IN THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 4, THE SOUTH HALF OF SECTION 3, AND THE NORTH- WEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 5 SOUTH, RANGE 80 WEST OF THE 6TH PRINCIPAL MERIDIAN, COUNTY OF EAGLE, STATE OF COLORADO; ESTABLISHING THE ZONING FOR SAID TERRITORY AND AMENDING THE OFFICIAL ZONING MAP FOR THE TOWN OF VAIL; AND SETTING FORTH DETAILS I N RELATION THERETO. WHEREAS, a Petition for Annexation of Territory into the Town of Vail, Colorado (a municipal corporation) has been duly filed with the Town of Vail by Vail Associates, Inc. , a Colorado corporation, requesting the annexation of certain property into the Town of Vail; and WHEREAS, all of the territory described in said Petition is owned by Vail Associates, Inc. , and said Petition complies with the provisions and requirements of Chapter 139, Article 21 of C.R.S. (1963) as amended; and WHEREAS, the Board of Trustees of the Town of Vail finds that annexation of the territory herein described is necessary and desirable, and in the best interests of the Town of Vail, and that said territory should b~ annexed into the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAI L, COLORADO, THAT: Section 1 . The Following described territory, owned by Vail Associates, Inc. , a Colorado corporation, be, and the same is hereby annexed to the Town of Vail, Colorado: A parcel of land lying in the Southeast Quarter of the Southeast Quarter of Section 4, the South Half of Section 3, and the North- west Quarter of the Northwest Quarter of Section 10, Township 5 South, Range 80 West of the 6th Principal Meridian, County of Eagle, State of Colorado, and lying South of Interstate High- way No. 70 Right-of-Way described as: Beginning at the South- west Corner of said Section 3, which is the Northwest Corner of said Section 10, thence S 0°02'30" E 365.00 feet along the West line of said Section 10; thence S 47°57'09" E 417.73 feet; thence N 38°52'51" E 600.OOfeet;thence N 65°32'51" E 140.00 feet; thence S 82°07'09" E 340.00 feet; thence N 78°22'31" E 161 .38 feet to a point on the East line of said Northwest Quarter of the Northwest Quarter of Section 10; thence N 0°02' 15" W 120.00 feet along said East line to the Northeast Corner of said Northwest Quarter of the Northwest Quarter; thence S 89°23'38" E 250.00 feet along the North line of said Section 10; thence continuing , into said Section 3 N 63°01'24" E 665.00 feet; thence N 17°01'24" E 255.00 feet; thence N 58°01'24" E 380.00 feet; thence N 15° 10' 13" W 126.41 feet to a point which is S 16°20' 18" E 140.00 feet from the South line of said Interstate Highway No. 70 Right-of-Way; thence N 70°39'43" E 230.00 feet; thence S 67 °20' 17" E 300.00 feet; thence S 83 °20' 17" E 300.00 feet; thence N 8°38'29" W 414.45 feet to a point on the South line of said Interstate Highway No. 70 Right-of-Way which is also a point on the arc of a 5550.00 foot radius curve whose central angle is 5° 14'50"; thence Southwesterly ~ along said South line on the following eight courses: (1) Southwesterly 508.28 feet along the arc of said 5550.00 foot radius curve to the left whose long chord bears S 76° 17' 1 1" W 508.10 feet to a point of tangent; (2) S 73°39'42" W 375.30 feet; (3) S S2 ° 1 1'27" W 202 .20 feet; (4) S 73°39'42" W 2100.00 feet; (5) S 65°29'27" W 193.80 feet to a point on the East line of said Section 4 which is N 0°02'30" W 263.10 feet from the Southeast Corner thereof; (6) thence continuing into said Section 4 S 65°29'27" W 17.30 feet to a point on the arc of a 5910.00 foot radius curve whose central angle is 4°29'29"; (7) Southwesterly 463.28 feet along the arc of said curve to the right whose long chord bears S 75°59'25" W 463.19 feet; and (8) S 77°27'47" W 610.80 feet to a point on the South line of said Section 4; thence S 89°23'38" E 1061 .65 feet along said South line to the Southeast Corner of said Section 4 and the point of beginning, containing 48.1397 acres more or less . Section 2. The territory described in this ordinance shall be and the same is hereby zoned "Agricultural," in accordance with the Zoning Ordinance of the Town of Vail, ORDINANCE NUMBER 7 (Series of 1969), as amended, and is subject to the provisions of same and subject to the uses for such "Agricultural District" as therein set forth; and the official zoning map for the Town of Vail shall be amended to indicate the inclusion of said property and the zoning of same as herein provided. Section 3. The Board of Trustees finds that this ordinance is neces- sary to preserve and perpetuate the welfare of the Town of Vail; that this ~ ordinance shall become effective upon its adoption and publication in accordance with the laws of the State of Colorado.
