HomeMy WebLinkAbout1973- 4 Prohibiting the Accumulation of Refues, Garbage, Rubbish and Rubble, requiring containers for the storage of refuse, providing procedures for requiring compliance.~ ~ ~ ~ ~ ~ ORDINANCE N0. 4 Series of 1973 AN ORDINANCE PROHIBITING THE ACCUMULATION OF REFUSE, GARBAGE, RUBBISH AND RUBBLE; REQUIRING CONTAINERS FOR THE STORAGE OF REFUSE; PROVIDING PROCEDURES FOR REQUIRING COMPLIANCE; PROVIDING PENALTIES FOR VIOLA- TIONS THEREOF; AND SETTING FORTH MATTERS AND DETAILS IN RELATION THERETO. WHEREAS, conditions have been found within the Town of Vail which are or may be fire or health hazards, actual or potential harborages for rats, mice, rodents, vermin or other pests; and WFIEREAS, the Town Council deems that it is in the public interest to preserve and promote the health, welfare and property of the inhabitants of this community to set forth the procedures for the accumulation, storage and disposal. of refuse as hereinafter stated; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: SECTION 1. Definitions. For the purpose of each and every provision of this ordinance, the following definitions of terms shall apply: "Person" is any natural person or any partnership, corporation, association, firm, or any other group acting as a unit as well as individuals. "Refuse" includes all solid wastes, garbage and rubbish, whether combustible or noncombustible, including rubble. "Garbage" includes putrescent animal or vegetable waste resulting from the preparation, cooking and serving of food, or the storage and sale of produce. "Rubbish" includes all nonputrescent solid wastes, con- sisting of both combustible and noncombustible wastes, including but not limited to paper, ashes, cardboard, tin cans, yard clippings, wood, glass, rags, discarded clothes or wearing apparel of any kind, or any other discarded object or thing, not exceeding three feet in length. "Rubble" includes large brush wood, large and/or heavy yard trimmings, discarded fence posts, crates, motor vehicle tires, junk motor vehicle bodies or parts thereof, scrap metal, discarded furniture and all other household goods ox items, demolition materials, old lumber and any other dis- carded similar object or thing which cannot conveniently be cut into sizes of three feet in length. "Refuse Container" is a metal or non-absorbent and fire resistant container, which shall be equipped with a tightly fitting metal or non-absorbent and fire resistant cover or lid. "Refuse Storage Room" is a wholly enclosed area approved by the Town Manager or his authorized agent far the storage of refuse which does not constitute, or tend to create a fire or health hazard or any unsanitary condition. "Building Department" is the Building Department of the Town of Vail. "Town Manager" is the Town Manager of the Town of Vail, or his authorized agent. "Town" is the Town of Vail, Colorado. "Health Officer" is the Health Officer of the Town of Vail and the County of Eagle, Colorado, or his authorized agent. "Fire Chief" is the Fire Chief of the Town of Vail, or his authorized agent. "Refuse Hauler" refers to any person engaged in the business of collecting, storing and transporting of refuse in the Town of Vail, and who is licensed therefor by the Town. SECTION 2. Unlawful to Permit Refuse to Accumulate. (a) It shall be unlawful for any occupant or owner of any single-family residence to accumulate, or permit or cause to be accumulated, on the premises occupied or owned by him, any refuse, the accumulation of which constitutes, or may create, an unsanitary condition or a health or fire hazard. (b) It shall be unlawful far any owner, manager, or operator of any multiple-family residence, apartment house, condominium, boarding house, private club, ar any other like premises to accumulate or permit or cause to be accumulated on said premises any refuse, the accumulation of which constitutes, or may create an unsanitary ar unsightly condition or a health or fire hazard. (c) It shall be unlawful for any owner, operator ar manager of any commercial establishment to accumulate or permit or cause to be accumulated on said premises any refuse the accumulation of which constitutes, ar may create an unsanitary and unsightly condition or health or fire hazard. SECTION 3. Who Must Provide Refuse Containers. (a) It shall be unlawful for any occupant or owner of any single-family dwelling to fail to provide ar make avail- able at all times one or more refuse containers, as herein defined, at the said premises awned or occupied by him. (b) It shall be unlawful for any owner, manager, or operator of any multiple-family residence, apartment house, condominium, boarding house, private club or any other Like premises to fail to provide or make available at all times one or more refuse containers, as herein defined, ar refuse storage roams, as herein defined, at the said premises owned, operated or managed by him. -2- :~ ~ < ~ ~ ~ (c) Tt shall be unlawful for any owner, operator or manager of any commercial or industrial establishment to fail to provide or make available at all times one or moxe refuse containers, as herein defined, or refuse storage rooms, as herein defined, at the said premises awned, operated or managed by him. SECTTON 4. Where Refuse May be Stored. (a) A11 refuse, except rubble, shall be stored either in refuse containers, as herein defined, or in xefuse storage roams, as herein defined, at a designated place on the premises, either inside or outside, easily accessible to refuse haulers within the Town, and shall be properly concealed as to not degrade the architectural and landscaping qualities of the premises. Concealment facilities shall be approved by the Building Department. (b) Rubble need not be stared in refuse containers or refuse storage rooms, but shall not be allowed to accumulate and shall be stored in such a manner as not to constitute or create an unsanitary or unsightly condition or a health or fire hazard. (c) It shall be unlawful for any person to place garbage or any other putrescible material in any refuse con- tainer or refuse storage room unless the garbage or putrescible material is wrapped in paper or other material in such a manner as to prevent spillage or leakage. {d} The foregoing paragraphs of this section shall not prohibit any person from keeping building materials an any premises before or during the period of active construction, nor shall they be construed to prohibit any person from staring any materials used in the operation of a business which is located in an area allowing such a use to be carried on. SECTTON 5. Unlawful to Place Refuse in Certain Places. (a) Tt shall be unlawful for any person to deposit or cause to be deposited any refuse on any public street, alley, sidewalk, park, or any other public ground, except in litter receptacles. (b) Tt shall be unlawful far any person to bury or cause to be buried anywhere within the Town of Vail any garbage. (c} It shall be unlawful for any person to deposit ar cause to be deposited garbage in the Town's sewage system unless it is first shredded by an approved mechanical grinder. (d} Tt shall be unlawful fox any person in possession, charge or control of any dead animals or of any premises upon which the same may be located, to permit or allow such animal to remain thereon for a period longer than 24 hours, ar to deposit or bury, or cause to be deposited or buried, the body of any dead animal, or portion thereof, on any public street, alley, sidewalk, park, stream, or any public ground. Removal and dis- posal of dead animals shall be done in accordance with the direc- tion of the Health Officer. -~- ~~ ~ C SECTION 6, Inspection of Properties. ~ ( ~^ The Town Manager, the Health Officer, or the Fire Chief, shall have the right to enter upon and inspect any and all premises within the Town at reasonable hours during the daytime for the purpose of enforcing the provisions of this ordinance. SECTION 7. Procedure for Noncompliance Concerning Storage and Accumulation of itefuse. (a) It shall be the duty of the Town Manager, the Health Officer, or the Fire Chief, to require the owner or agent of the owner of any premises whereon is situated any unlawful accumulation or unlawful storage of refuse to remove the same within a reasonable time, which shall be no longer than three (3) days, to be fixed by the Town Manager, the Health Officer, or the Fire Chief, in his written notice to such owner or agent of the owner. Emergency situations will be given notice of not longer than one (1) day. (b) In case the owner ar agent of the owner fails to follow the requirements of such notice, the Town Manager, the Health Officer, or the Fire Ghief shall cause the same to be removed at the expense of such owner or agent of the owner.- After removal of the refuse, the Town Manager, the Health Officer, or the Fire Chief, shall issue a summons to the owner or agent of the owner to appear in municipal court. SECTION $. Penalties. Every person upon conviction of violation of this ordinance shall be fined not less than thirty-five dollars ($35.00) nor more than three hundred dollars ($300.00), plus the cost of removal of the refuse; or shall be punished by imprisonment for not mare than ten (10) days. SECTION 9. Severability of Provisions. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to he invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause ar phrase thereof, irrespective of the fact that any one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid. The Town Manager, the Health OtGcer, or the Fire Chie[, shall have the right tb enter upon and inspect any and aA premises within the Town at reasonable hours during the daytime Par the purpose of en.orcing the provisions of this ordinance. SECTION 7. Procedure for Noncom- pliance Concerning Storage and Accumulation of Refuse. (a) It shall 6e the duty of the Town Manager, the Health Officer, or the Fire Chief, to require the ownex or agent of the owner of any premises whereon is situated any unlawful accumulation or unlawful storage of refuse to remove the same within a reasonable time, which'shall be no longer than three (3) days, to be fixed by the Town Manager, the Health Officer, or the Fire Chief, in his written notice to such owner or agent of the owner. Emergency situations will be given notice of not longer than one (1) day, (b) In case the ownex ox agent of the owner fails to follow the requiremen#s of such notice, the Town Manager, the Health O}ficer, or the Fire Chief shall remove the same at the expense of such owner ox agent of the owner. After removal of the refuse by Town forces or by the Town's Trash Service, the Town Manager, the health Officer, ax the Fire Chief, is authorized to issue a summons to the owner or agent of the owner to appear its municipal court. , SECTION 8. Penalties. Every person upon conviction of violation of this ordinance shall be fined not less than thirty-five dollars ($35.00) nor more than three hundred dollars ($300.00), plus the cost oP removal oP the refuse; or shall be punished by imprisonment for not more than ten (10) days. ~ SECTION 9. Sevexability o~ Pro- visions. If any part, section, subjection, sentence, clause or phrase of this 'ordinance is for any reason held to be invalid, such decision shall not affect the valldity of the remaining portions of this ordix~'ance; and the Town Council fax the Town of Val hereby declares it would have pa ed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, irrespective of fhe tact that anY one or more parts, sections, subsections, sentences, clauses or yhrases be declared invalid. .
