ORDINANCh NO. 7 Series of 1973 AN ORDINANCE OF THE TC7~NN OF VAIL, ADOPTING AND ENACTING B'~' REFERENCE A CODIFICATION OF EXISTING ORDINANCES OF THE TOWN OF A GENERAL AND PERMANENT NATURE ENTITLED THE OFFICIAL CODE OF THE TOWN OF VAIL, Wl-ITCH PRIMARY CODE ADOPTS BY REFERENCE THE 197Q EDITION OF THE UNIFORM BUILDING CODE, VOLUME I , AND THE 1970 EDITION OF THE UNIFORM MECHANICA L CODE (DESIGNATED "UNIFORM BUI L..DING CODE," VOLUME II), COPYRIGHTED AND PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, THE 1968 EDITION OF THE NATIONAL ELECTRICAL CODE PUBLISHED BY TH E NATIONAL FIRE PROTECTION ASSOCL4TION, THE 197Q EDITION OF THE UNIFORM PLUMBING CODE PUBLISHED BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIA LS , THE 1971 EDITION OF THE UNIFORM FIRE CODE PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND THE WESTERN FIRE CHIEFS ASSOCIATION, THE 1971 EDITION OF THE MODEL TRAFFIC CODE PUBLISHED BY THE COLOR.~D O STATE DEPARTMENT OF HIGHWAYS; PROVIDING PENALTIES FOR THE VIOLATIONS OF THE PROVISIONS OF SUCH CODE; PROVIDING THAT THE PROVISIONS OF SUCH CODE SHOULD BE IN FULL FORCE AND EFFECT FROM AND AFTER MAY i , 1973; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES; PROVIDING FOR THE PREPARATION AND PUBLICATION OF ANNUAL REVISIONS FOR SUCH CODE; PROVIDING FOR THE MAINTENANCE OF AN OFFI- CIAL COPY OF SUCH CODE IN THE OFFICE OF THE TOWN CLERK; AND DECLARING UNLAWFUL CERTAIN ACTS WITH REFERENCE TO ALTERING OR TAMPERING WITH SUCH CODE, AND PROVIDING A PENA LTY THEREFOR. WHEREAS, the Town Council of the Town of Vail has determined that it is necessary and expedient that all of the ordinances of the Town of a general and permanent nature be codified, and pursuant to such determina- tion, has caused a codification of such ordinances to be prepared, which codification is designated as the "Official Code of the Town of Vail;" and WHEREAS, the Statutes of the State of Colorado provides far the adoption of such a codification by reference; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: SECTION 1 . Official Code of the Town of Vail. The "Official Code of the Town of Vail," at least three copies of which have been properly certified as true copies by the Mayor and Town Clerk, and have been and now are on file in the office of the Town Clerk, is hereby adopted and enacted by reference. The purpose of this code is to codiFy all the existing ordinances of the Town of Vail which are of a general and permanent nature . The subject matter of this code is the existing ordi nances of a general and pern'tianent nature of the Town of Vail, through December 31 , 1972. This code has been promulgated by the Town of Vail, Colorado. SECTION 2, Uniform Building Code. The 1974 Edition of the Uniform Building Code, Volume I, and the 31-" Edition of the Uniform Mechanical Code {designated "Uniform Building Caci~. ," Volume II), and amendments thereto as previously adopted by the Town cf_ Vail, at least three copies of which have been properly certified as trot ~'r~r~'~ ~. ~- ~ ~ b~c Mayor anc~ the Town Clerl~, zind }~-~ve faeen and now are on Filc sn the office of the 'i"own Cleric, is hereby adopted anc~ enacted try reference as a part of the ''Official Code of the Town of Vail ." ~T he {purpose of thtcs Code is to provide minimum standards to safeguard fife or liml3, health, property, and puti}[ic welfare by regulating and controllinc7 the desie~n, construction, quality of materials, use and occupancy, location and rrk-~in- tenance of all buildings and structures within the Town of Vail and certain equipment specifically regulated in this code. The subject matter of this code is regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, use, height, area, and maintenance of buildings ar structures in the Town of Vail, providing for the issuance of permits and collections of fees therefore, declaring and establishing Fire Districts, providing penalties for the violation thereof, and repeating all ordinances and parts of ordinances in conflict therewith. The Code was promulgated by the International Conference of Building Officials, 50 South Las Robles, Pasadena, California, 91101. SECTION 3. National Electrical Cade. The 1988 Edition of the National Electrical Code, at least three copies of which have been properly certified as true copies by the Mayor and the Town Clerk, and have been and now are on file in the office of the Town Clerk, is hereby adopted and enacted by reference as a part of the "OfFicial Code of the Town of Vail." The purpose of this code is the practi- cal safeguarding of persons and of buildings and their contents, from hazards arising from the use of electricity for light, heat, power, radio, signalling and for other purposes. The subject matter of 'this code covers the electric conductors and equipment installed within or on public and private buildings and other pre miles, including yards, carnival and parking lots, and industrial substantians and also the conductors that connect the installation to a supply of electricity, and other~outside conductors adjacent to the premises. This code was promulgated by the National Fire Protection Association, 80 Ba~tterymarch Street, Boston, Massachusetts, 02110, SECTION 4, Uniform Plumbing Code. The 1970 Edition of the Uniform Plumbing Code, at least three copies of which have been property certified as true copies by the Mayor and Town Clerk, and have been and now are on fife in the office of the Town Clerk, is hereby adopted and enacted by reference as a part of the "OfFicial Code of the Town of Vail." The purpose of this Cade is to protect the health and lives of the residents of the Town of Vail by providing rules and regulations far use of proper materials and proper methods of installation in plumbing, This code was issued and promulgated by the International Association of Plumbing and Mechanical Officials, 5032 Alhambra Avenue, Los Angeles, California, 90032. SECTION 5. Uniform Fire Cade. The 1971 Edition of the Uniform Fire Code, at least three copies of which have been properly certified as true copies by the Mayor and Town Clerk, and have been and now are on file in the office of the Town Clerk, is hereby adopted and enacted by reference as a part of the "Official Code of the Town of Vail." The purpose of this Code is to prescribe regulations governing conditions hazardous to life and property from fire ar explosion. This Code was promulgated and recommended by the International Conference of Building Officials, 50 South Los Robles, Pasadena, Ca tifornia, 91 101 , and the Western Fire Chiefs Association, Post Office Box 842, San Leandro, California, 94577. SECTION 6. Model Traffic Code for Colorado Municipalities. The 1971 Edition of the Model Traffic Corte for Colorado Municipalities, officially approved, adopted and published in 1971 as such by the State Depart- ment of Highways, Denver, Colorado, at least three copies of which have been -~- I I ~. ~ . ~ ~~,~ . ~ . ~ ~~~ ~ ~r ~ properly certified by the Nlayor and Town Clerk, and have been and now are on File in the office of the Town Clerk, is hereby adopted and enacted by reference as part: of the "Official Cade of the Town of Vail." The purpose of this Code is to prescribe traffic regulations within the Town of Val l and to establish penalties for violations of such regulations for the public safety and we !fare . SECTION 7. Penalty Provisions . The following sections of the "Official Code of the Town of Vail" contain penalty clauses, which are herewith set forth in full: (a} Section 1-'1-7 and 1--'l-8: General Penalty for violations of the Code and continuing violations. Any person violating any provision of the "OfFicial Code of the Town of Vail" shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $300.00 or by imprisonment not to exceed 90 days, or bath, unless otherwise stated by any section of this Code . Each and every day that any violation continues shall be considered a separate misdemeanor. (b) Section 205 of the Uniform Building Code, adopted by reference in Section 5-1-1 , provides as follows; It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy, or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of this Code . Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than three hundred dollars ($300, 00) or by imprison- ment far not more than ninety {90) days, or by both such fine and imprisonment , (c) Section 1 .7 of the Uniform Plumbing Code, adopted by reference in Section 5-2-4, provides as Follows: Any person, Firm or corporation violating any provision of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed three hundred dollars ($300.00) ar by imprisonment in the Vail Jail for not to exceed ninety (90) days, or by both fine and imprisonment. Each separate day or any portion thereof during which any violation of this code occurs or continues shall be deemed to consti- tute aseparate offense, and upon conviction thereoF shall be punishable as herein provided . --3 ~'~ ~ • r (d) Sections n-1-3 (e) and 9-1-5, Penalties for violation, of the Medea Traffic Cade, provide as Follows: (1) Penalty Assessment S chedu [e : The Pena [ty assessment and the nature of the violation for which said penalty assessment may be made by the arresting officer and accepted and paid by the violator under the privileges of this section shall be as herein set forth, to-wit; Speeding (1--10 mph over speed limit} $10.00 (11-15 mph over speed limit) 15.00 (16-20 mph over speed limit) 35.00 Special Hazards 15 , 00 Careless Driving 15, 00 On Wrong Side of Street or in Improper Lane 10, 00 1 mproper Passing 10.00 Failure to Yield Right of Way 10.00 Failure to Stop at Stop Sign 15.00 Improper Turning 10.00 Following Too Closely 1 O, 00 Failure to Comply with Inspection Law 5.00 improper Parking 3.00 Parking in Front of Fire Plug 5.00 Parking to Impede Normal Flow of Traffic 5.00 Improper Equipment (Horn, Muffler, Rear Vision Mirror, Windshield Wiper, Brakes, and Others) 5.00 Wrong Way on a One-way Street 10.00 The schedule defined and set forth in this section 23 hereof shall not apply to any violation of said oralinance which is tried in the municipal court. (2) it shall be unlawful for any person to violate any of the provisions of the Municipal Traffic Code as adopted and amended herein, or of any provision of this Ordinance and any such violation shall be punish- able as hereinbefore provided , Every person convicted of a violation of any provision of the Municipal Traffic Code or of any provision of this Ordinance shall be punished by a fine of not more than three hundred dollars ($300.00) or by imprisonment for not more than ninety {90) days, or by both such fine and imprisonment, {e} Section 11--11-21 , penalties for violations of Dog Ordinance. Any owner found violating any provision of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shalt be punished 'For such offense by imprisonment for not mare than ninety (90) days or by a fine of not more than three hundred dollars ($300.00), or by both such Fine and imprisonment, The Following minimum fines shall apply to violations of any provisions of this Ordi Hance: first offense - $5.00; second offense -- $7 , 50; third and subse- quent offense - $10,00. SECTION 8. Effective Date. The provisions of the "Official Code of the Town of Vail" shall be in full force and eFfect on and after the first day of May, 1973, and all ordinances of a genera! and permanent nature fina f !y adopted and passed on or before December 31 , 1972, and not contained in such code or recognized and continued ~-4- -^ -.. ~ . 'in force by reference as provided For in Section 1-1-3 of such Code are hereby repealed from and after the first day of May, 1973, except as hereinafter provided. SECTION 9 , EFFect of Repeat . The repeal provided For in the preceding section of this ordinance shall not affect any offense or act committed, or any penalty or forfeiture incurred, or any contract or right established or accruing, before the first day of May, 1973; nor shall such repeal affect any ordinance or reso- lution promising or guaranteeing the payment of money for the Town or authorizing the issue on any bonds of the Town or any evidence of the Town's indebtedness or any contract or obligation assumed by the Town; nor shah it affect the annual appropriation ordinance or the annual tax levy; nor shalt it affect any right or franchise conferred by ordinance ar resolution of the Town on any person or corporation; nor shall it affect any ordinance annex- ing territory to the Town; nor shall it affect any ordinance naming, opening or vacating streets or alleys in the Town; nor shall such repeal affect any ordinance levying ar imposing taxes nor shall such repeal affect any ordi- nance dedicating or accepting any plat or subdivision in the Town; nor shall it affect any prosecution, suit or proceeding pending, or any judgment rendered on or prior to the first day of May, 1973; nor shall it affect any ordinance finally adopted and passed after December 31 , 1972; nor shall it affect any ordinance not of a general and permanent nature; nor shall such repeal be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance. SECTION 10. Revisions. The Town of Vail shall prepare and publish revised sheets of every loose leaf page in need of revision by reason of amendment, addition or repeal. The Town Clerk shall distribute said revised loose leaf sheets for such fee as the Town Council shall direct. SECTION 1 1 . Copies on File . A copy of such code shall be kept on file in the office of the Town Clerk. It shall be the express duty of the Town Clerk to insert in their designated places all amendments or ordinances which indicate the inten- tion of the Town Council to make the same a part of such code, when the same have been printed or reprinted in page form, and to extract from such code all provisions which may from time to time be repealed by the Town Council, This copy of such code shall be available far all persons desiring to examine the same and shalt be considered the official code of the Town of Vai 1. SECTION 12. Unlawful Alteration. it shall be unlawful for any person, firm ar corporation to change or amend by additions or deletions any part or portion of such code or to insert or delete pages or portions thereof or to alter or tamper with such code in any manner whatsoever which will cause the law of the Town of Vail to be misrepresented thereby, provided, however, that such clause shall not apply to the additions, revisions and amendments to be issued by the Town of Vail. Any person, firm, ar corporation violating this section shall be subject to the penalties provided in the penalty section of the official code. SECTION 13 , Severability, If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed ~-5- this ordinance and {each part, section, subsection, sentence, clause or ' phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid .
