Application of Other E.aws. .37 ~ ._~.,,.,;e C C C C ORDINANCE N0. 9 Series of 1973 RN ORDINANCE ESTABLISHING COMPREHENSIVE SIGN REGULATIONS FOR THE TOWN OF VAIL, RND PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF SAME; REGULATING THE ERECTION, CONSTRUCTION, RESTORATIpN, ALTERATION, LOCATION, LANDSCAPING AND MAINTENANCE OF SIGNS, __-~'- S WINDOW SIGNS, FLAGS, PENNANTS, ERNI~ERS AND BUNTINGS, bISPLAY BOXES, RESIDENTIAL NAME PLATE SIGNS, SUBDIVISION ENTRANCE SIGNS, TEMPORARY SITE DEVELOPMENT SIGNS, TRAFFIC CONTROL SIGNS FOR PRIVATE PROPERTY, MURALS AND SUPER- GRAPHICS AND PERMITTING AN APPROVED SIGN PROGRAM; ESTABLISHING A DESIGN REVIEW PROCEDURE AND GUIDE- LINES; PROVIDING FOR VARIOUS ADMINISTRATIVE, REVIEW AND APPEAL PROCEpURES; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; PROVIDING FOR THE REPEAL OF OR- DiNANCE N0. 15 (SERIES OF 1967); ANp SETTING FORTH MATTERS AND DETAILS iN RELATION THERETO, WHEREAS, fihe Board of Trustees for the Town of Vaii on or about the Ilth day of September 19b7, enacted ordinance No. 15 (Series of 1967}, as a comprehensive sign ordinance for the Town of Vail, and WHEREAS, the Town Council for the Town of Vail has determined that the sign ordinance for the Town of Vail should be revised to meet the changing conditions within the Town and to provide for aesthetically pleasing signs for the Town; and WHEREAS, the Town Council has determined that it is in the interest of the public welfare to enact a new sign ordinance to provide for the public health, welfare and safety of the Town; NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF VAIL THAT: Section 1. General Provisions. I) 5hart Title and Code Re#erence. This ordinance may be cited as "the sign ordinance" for the Town of Vail, and shall be incorporated in the Index of the Municipal Code of Vail, Colorado, otherwise referred to as "Town Code of Vail". 2} Declaration of Purpose. These regulations are enacted for the purpose of C f C ~ C promoting the health, safety, morals, and general welfare of the Town of Vail, and to promote the coordinated and harmonious development of the Town in a manner that will conserve and enhance its natural environment and its established charac- ter as a resort and residential community of high quality. 3) Definitions. a) 'Administrator - A member of the Town of Vail staff appointed by the Town Manager, desig- nated to administer and enforce this ordinance. b) Arcade - A hallway, courtyard, mall or similar area enclosed within a building ar structure which is visible from the exterior of the structure or from a pedestrian walkway. c) Basement -- With reference to th i s ordinance shall mean more than 5d~ below average grade. d} Design Peview Board - A group appointed by the Town Council as dictated by the zoning ordinance which shall consist of three (3} Planning Commission members and two (2} members appointed from the community. e) Erect - Shall mean to build, construct, attach, hang, place, suspend or affix, and shall also include the painting of wall signs, murals or supergraph i cs. f) Fine Art - With reference to this ordinance shall mean sculpture, fountains or similar objects. g) Frontage, business - Shall mean the lineal dis- tance from outside to outside of a structure or portion of a structure housing a particular business or businesses directly adjacent to a major pedestrian or vehicular way. h) Grade, average - The average of the finished ground level at the mid--point of each exterior surface of a sign or a structure in the event the sign is attached to the structure. Page 2 ~ _~~ C C C ~ C i) Lighting, indirect - R light source separated from the surface and illuminating such sign surface by means of spotlights or similar fixtures. j) Lighting, pan-channeled - Indirect, concealed light source which is recessed into any element of a sign which element is attached directly to the face of such sign, l=ach element to be lighted must have an opaque surface such that the light does not shine through the element. k} Person - Shall include any person, firm, part- nership, association, corporation, company or organization of any kind. I} Plate line - The paint at which any part of the roof structure first touches or bears upon an ex- ternal wall. m} Restoration - The routine maintenance and painting of existing, approved signs, that do not change the approved design and colors in any way. n} Reflective Surface -- Any material or device which has the effect of intensifying reflected light, such as Scotchlite, D~yglo, glass beads and luminous paint. o) Sign - A surface or space, as permitted in this ordinance, whether continuous or not, which attracts the attention of; identifies a business; conveys a message to any person by means of letters, numbers, figures, or other symbols, devices, or representations. I Wall Sign - A sign attached to, painted on, or erected against the wall of a building or structure with the exposed face of the sign in a plane parallel to the face of said wall and not projecting more than nine (9) inches from the face of said wall, 2. Free-Standing Sign - A single or multi-faced sign affixed to a supporting structure, or imbedded in and extending from the ground and detached from the building. Allowable size does not include supporting structure. 3. Projecting or hanging sign ~- Any sign attached to a building and extending in whole or in part mare than nine (9) inches beyond the building fine. Allowable size does not in- clude supporting structure. Page 3 C C'' C ~ C 4. Window Sign - R sign affixed to an interior window surface or no more than six (6} in- ches from said window surface and shall not include the two (2} square feet allowed for the display of hours, credit card informafiion and similar genera[ information items. 5. Display Box - A free-standing or wall sign enclosed in glass for the express purpose of displaying menus, current entertainment or real estate listings. 6. Residential name plate sign - A sign per- mitted for the sole purpose of identifying the inhabitant residing therein, the house name or identifying the address thereof. Said sign may contain no advertising of any kind. 7. Subdivision 1=ntrance Sign - A sign permitted to identify a subdivision as defined herein in a CCI, CC2. or SD-I district only. 8. Temporary Site Development Sign - A sign permitted to identify a project under con- struction including the project name, general contractor, architect, prime real estate . agent and may include "model apartment". 9. Traffic Control Sign - A permitted sign for the purpose of identifying private parking areas and directing the flow of traffic on private property. 10. Flag - Shall mean any state or national flag..: .J . il. Banners, Pennants or Bunting - Any announce- ment device a#fixed to poles, wires or ropes for the purpose of announcing or promoting community events or activities or decorating the Town for special holidays. 12. Mural or Supergraphic - A painted scene, figure or decorative design on a wall, so as to enhance building architecture, not including written trade or place names, trade marks or IogotypE, or advertising message. 13. Sign Program - A comprehensive approach to a s i gn or group of s i gns for an entire building. Page 4 ~ ~~ r ~~ c ~ r p) Size, allowable - Allowable area of a sign shall be com- puted by using the outside dimensions of the face, in the same plane, of a one or two-sided sign and each face of a multi-sided sign. Computation of allowable sign area shall include all existing signs on the premises whether such signs be conforming or non-conforming under this ordinance. Free-standing or wall-mounted letters will be measured using the smallest geometric figure which will enclose all letters or symbols. q) Subdivision - A parcel of land divided into two or more parcels, sites or lots for which a plat has been sub- mitted and approved by the Town of Vail. r) Zane - Rs used in the ordinance shall mean a zoning dis- trict as shown on official map. Signs, other than residen- tial name plate signs, shall be prohibited in Single Family Residential, Two-Family Residential and Low- Density Multiple Family zones. Page 5 ~ ~~ c t c ~ c Section 2, Desicin Review Guidelines. 1} Sign location, configuration, design, materials and colors should be harmonious with the majestic mountain setting and the alpine village scale of the Town, 2) Sign should not visually dominate the structure to which it belongs or call undue attention to itself. 3) Sign materials should be predominantly natural such as rough cedar, pine or other types of wood. Plastic or other synthetic materials should be discouraged. 4) The sign and its supporting structure should be in harmony architecturally with the surrounding structures. 5) Natural colors (earth tones), gray and white should be favored and bright colors should be used only for accent. 6) Landscaping, where required, should be designed to harmonize with the building and surrounding natural iandforms and native plants, 7) Reflective surfaces are not allowed. 8) Lighting should be of no greater wattage than is necessary to make sign visible at night, 9) Temporary signs other than site development signs are discouraged except for non-profit community events and public information signs which should be located on public information kiosks. Page 6 ~ ~ C C` t C C Section 3. Permits. Certificates and Approvals Required. It shall be unlawfiui for any person to erect, alter, or relocate or repair within the Town of Vail, any sign, as defined in this ordinance, without complying with the fiollowing requirements: I) Completion of the sign application permit; 2) Review by Administrator; 3) Review and approval of the Design Review Board; and 4) Completion of certificate of sign in- spection after final inspection by the Administrator. Section 4. Application Procedures. The procedures to be followed in fulfilling the intent of the Sign Ordinance are as follows: I) R sign application permit must be obtained from the Adm i n i strator; 2) The sign application permit must be properly completed and returned to the Administrator; 3) The Administrator shall review and accept the properly completed sign application permit. The Administrator will then refer said application signed and dated, to the Design Review Board after he has determined the sign meets the general requirements of the ordinance; 4} The Design Review Board will review the sign application permit in the presence of the applicant or his representative at their next regularly scheduled meeting. 5} The Design Review Board willapprave, reject or approve upon condition, the sign application permit based upon its conformance with the ordinance and its aesthetic value. Page ~ ~ ~~ C ~ C r C 6) Upon the approval by the Design Review Board, the sign application permit will be returned to the Administrator and the applicant will be duly noti- fied of the Design Review Board's decision. 7) lfpon the conclusion of the construction and erection of the approved sign, the applicant will apply for a certificate of sign inspection from the Administrator. 8) The Administrator will inspect the sign in its proper location and will, if the sign is found to be in compliance with the approval, issue the certificate of inspection completing the sign application pro- cedures. 9) Upon rejection of the sign application permit by the Design Review Board, notification will be given in writing to the applicant defining the reason for disapproval and making recommendations to bring the sign into conformance with the provisions of this ordinance. 10) In the event an applicantts sign application permit is rejected, he has the option to appeal to the Town Council following the procedure outlined in the zoning ordinance, In the event of an appeal, the Design Review Board and the Administrator shall make recommendations to the Council. Section 5. Information Required on Permits and Certificates. All permits and certificates shall be made upon forms provided by and obtained from the Administrator which shalt contain the following information: I) Sign Applica#ion Permit. a) Name, address, telephone number of the applicant and date of application; b) Numerical location of building structure upon its lot; block and filing designation; and street address upon which the sign is to be located; c) Section number and paragraph of the ordinance under which the application is being made; d) Position of the sign on the building in both plan view, drawn to scale and elevation views drawn to scale; Page 8 c r r r r e) Two sets ofi scale drawings of the plans and specifications including size and color of the sign and its various parts, the style of lettering, fighting, type of material of wh°ich it is fabricated and the method at attach- ment to the building or to the ground; ~f) A color sketch or color photograph of the sign and building, as weal as any contiguous street or building in order to display how they would appear in relation to one another; g) Name ofi person or persons constructing and erecting the sign; h) Written consent of the owner of the bui~d- ing, structure, or land to which or on which the sign is to be erected; i) Signature of Administrator stating that sign meets the genera I requirements of the ordinance; j) Signature of approval by the Chairman or Acting Chairman of the Design Review Board, after review. k) If required by the Administrator, a copy of stress sheets and calculations showing that the structure is designed for dead load and wind pressures in any direction in the amount required by fihis and all other laws and or- dinances of the Town. I) Lineal feet of frontage. 2) Certificate of Sign Inspection. a} Name, address and telephone number of the applicant; b) Numerical location of building structure upon its lot; block and filing designation; and the street address upon which the sign is to be attached; and c) Signature and date of approval by the Administrator. Page 9 ~ - c r c r c Section 6. Permit Fees. Rt the time the Administrator accepts the sign application permit, the applicant shall pay a fee of $IO.Oa per sign application permit. The number of signs far a sinnle s~-ructure included in the application is not restricted provided they conform to the provisions of this ordinance. Section 7. Duties of the Design Review Board. The Design Review Board shall review the appearance, lighting, form, color, character, dimensions and materials of all signs required under this ordinance to obtain approval. The Design Review Board steal{ make SUCK aesthetic judgments necessary to insure that all signs requiring approval under this ordi- nance are in Conformance with the sign ordinance and in harmony with the character of the Town of Vail. The Design Review Board may adopt from time to time such rules and regulations as it may deem necessary to perform its prescribed duties. Review shall be in conformance with the procedure outlined in the zoning ordinance. Section 8. Approval of Design Review Board Required. The Administrator upon review and acceptance of a properly completed sign application permit shall forward the applica- tion to the Design Review Board. Following receipt of the sign application permit, the Design Review Board shall consider said application at its next regu- larly scheduled meeting. In the event the Design Review Board is unable to review ail signs on the agenda, they may, with the ap- plicant's approval, postpone review until their next meeting. Section 9. Notice to Repair or Remove, Creation of Lien. If the Administrator shall find that any sign is maintained in violation of the provisions of this ordinance, he shall give written notice of said violation by certified mail to the owner or person entitled to possession of the sign or the owner of the p roperty where the s i gn i s I ocated. If such person fails to alter or remove the sign so as to comply with this ordinance within fifteen (IS) days after receipt of such notice, the Administrator may cause such sign Page 10 ~ _ ~ c ~ c r ~ to be altered or removed at the expense of the owner or person entitled to possession of the property or sign, and shall, upon the determination of such expenses, certify same to the Director of Finance of the Tawn of Vail. The Director of Finance shall notify the owner or person en- titled to possession of the sign or property of the total costs incurred for such alteration or removal of the sign, and if that person shall fail within thirty (30) days after the date of notification to pay the entire costs and expenses of such repair, alteration or removal, then such costs and expenses steal! become a lien against the property, and the Director of Finance shall certify the same to the Eagle Gounty Treasurer for collection in the same manner as general property taxes are collected. The amount certified by the Director of Finance to the County Treasurer for collection shalt include the actual cost of repair or removal of said sign, plus fifteen per cent (15~), and in addition thereto, shall include an amount equal to ten percent` (10~) representing penalty and interest for the cost of collection. Section 10. Restoration. RI! signs in the Town of Vail shall be properly maintained at all times to the satisfaction of the Design Review Board. The Board shall have the authority to order the painting, repair, or removal of a sign and accompanying land- scaping which constitutes a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescense or abandonment. Their decision shall be subject to review by the Town Council in accordance with the provisions of the zoning ordinance. Notification shall be by certified mail. If, within fifteen (15) days, the maintenance orders are not complied with, the Administrator may order the sign removed at the owner's expense under the provisions of Section 9 of this ordinance. Section II Wind Pressure and Dead Load Requirements. Any sign as defined in this ordinance shall be designed and constructed to withstand wind pressures and receive dead Iaads as required in the most recent lJniform Building Code, as adopted by the Town of Vail and shall be determined by the Building official. Exemptions, The provisions of this ordinance shall not apply to the following signs: I) Memorial signs or tablets, names of buildings and date of erection when cut into any masonry surface; 2) Official governmental notices and notices posted by governmental officers in the performance of their duties; governmental signs to control trafific or for other regulatory purposes, or to identify streets, or to warn of danger; 3) Works of fine art (as defined in.thi.~ or- d'rnance,} f wh i ch in~rJO.:way,-identify or adverti se a product or business; 4) Temporary decorations or displays, when such are clearly incidental to and are customarily and commonly associated with any national, local or religious holiday or celebration; provided that such decorations are maintained in an attrac- tive condition and do not constitute a fire hazard, as determined by the Administrator subject to review by the Design Review Board. 5) Temporary or permanent signs erected by pub- lic utility companies or construction companies to warn of danger or hazardous conditions, in- cluding signs indicating the presence ofi under- ground cables, gas lines and similar devices; and 6) Signs displayed on trucks, buses, trailers or other vehicles which are being operated or stored in the normal course of a business, indicating the name of the owner, business and location, which are applied to moving vans, delivery trucks, rental trucks and trailers and the like; provided that the primary purpose of such vehicles is not for the display of signs, and provided that they are parked or stored in areas appropriate to their use as vehicles, Section 13, Liability. The provisions of this ordinance shall not be construed as relieving or limiting in any way the responsibility or liability of any person, firm or corporation, erecting or owning any sign, trom personal injury or property damage resulting from the Page I Z C C C C placing of such sign, or resulting from tfie negligence or willful acts of sucfi person, firm or corparafiion, his or its agents, employees or workmen, in the construction, maintenance, repair or removal of any sign erected in accordance with a permit issued hereunder. Nor shall it be construed as im- posing upon the Town ar its officers, employees, or the Design Review Board, any responsibility or liability by reason of the approval of any signs, materials, or devices under the pro- visions of this ordinance. Section l4. This section concerns those types of permanent and temporary signs requiring a sign application permit under the provisions of this ordinance. This section further includes: purpose of each sign type, size, height, number, location, design and landscaping requirements, and special provisions for each type of sign. The following is a listing of sign categories permitted under the provisions of this ordinance: I} Wall Signs: Single Business Use; 2) Wall Signs: Individual Busin esses Within a Multi-Tenant Building; 3} Wall Signs: Joint Directory Signs for a Multi-Tenant Building: 4) Wall Signs: Arcade; - , 5) Free-Standing Signs: Single Business Use; 6) Free-Standing Signs: Joint D irectory Signs for a Multi-Tenant Building; 7) Projecting and Hanging Signs: Single Business Use: $) Projecting and Hanging Signs: Individual Businesses Within a Multi-Tenant Building; 9) Projecting and Hanging Signs: Joint Directory Signs for a Multi-Tenant Building; 10) Projecting and Hanging Signs: Arcade; [I} Window Signs; pate 13 ~ y C C C C C 12) Display Boxes; 13) Residential Name Plate Signs; 14) Subdivision Entrance Signs; 15) Temporary Site Development Signs; 16) Traffic Control Signs for Private Property; 17) Flags, Pennants, Banners and Bunting; 18) Murals and Supergraphics; and 19) Sign Program; 20) Public Information Signs. The following is a listing by sign types of the require- ments under this ordinance. I) Wali Signs: Single Business Use. a) Purpose: To identify a business or organization being the sole business occupant within a building. b) Size: One (I) square foot for each five (5) front lineal feet of the building, with a maximum area of twenty (20) square feet. Combined maximum area for more than one sign shall not exceed twenty- (20) square feet. c) Height: No part of the sign shall extend above twenty-five (25) feet from average grade. d) Number: One (I) sign per vehicular street or major pedestrian way which the build- ing abuts, with.-a-maximum of two per business, as determined by the Administrator, subject to review by the Design Review Board. e) Location: Parallel to the exterior wall adjacent to the street or major pedestrian way which the building abuts; subject to the approval of the Design Review Board. f) Design: Subject to the approval of the Design Review Board. Page l4 wr - C C ~ C C g) Lighting: Indirect or pan-channeled. h) Special Provisions: I) One (1) free-standing sign or projecting sign per street or major pedestrian way permitted in place of one (!) wall sign. Z) An individual business with a basement entrance with no calculable building footage may have one Sian with a maximum size of three (3) square feat. 2) Wall Signs: Individual Business Within a Multi- Tenant Building. a) Purpose: To identify a business or organization which has its own exterior public entrance within a multi-tenant building. b) Size: One (!) square foot for each five (5) front lineal fleet of the individual business or organization having its own exterior pub- lic entrance in a multi-tenant building, with a maximum area of twenty (2O} square feet, and a minimum area of three (3) square feet will be allowed for a business with insufficient frontage. Combined maximum area for mare than one sign shall not exceed twenty (20) square feet. c) Height: No part of the sign shall extend above twenty-five (25) feet from average grade. d} Number: One (I) sign per vehicuiar street or major pedestrian way which the building abuts, as determined by the Administrator with a maximum of two (2) signs subject to review by the Design Review Board. e) Location: Parallel to the exterior wall of the individuai business or organization, adjacent to the street or major pedestrian way which the building abuts; subject to the approval of the Design Review Board. fi) Design: Subject to the approval of the Design Review Board. Page 15 ~ ~~ C g) Lighting: indirect or pan-channeled. h) Special Provisions: 1) A joint directory sign permitted, subject to the provisions of this ordinance; 2) A business or organization having a wail sign is not excluded from participating in a joint directory; 3) Businesses or organizations not having exterior public entrances are subject to the provisions of the arcade~~section=af th.is ~.. ordinance; and ~~, 4) Space shared with common exterior public entrance by more than one business or organ- ization shaEi be treated as a single business or organization for purposes of calculating frontage. 5) An individual business with a basement entrance with no calculable front footage may have one sign with amaximurn area of ' three (3) square feet. 3} WaII Signs: Joint Directory Signs for a Multi- Tenant Bu i I d i nq, a} Purpose: To list all tenants within a multi- tenant building and to guide the pedestrian to an individual tenant within such building. b) Size: One ({) square foot per tenant within the multi-tenant building, with a maximum area of twenty-five (25} square feet. c} sleight: No part of such signs shall extend above eight (8) feet above average grade. d) Number: One (I) sign on the major pedestrian way which the building abuts; subject to the ap- proval of the Design Review Board with a maximum of one (I} sign. e} Location: Parallel to the exterior wall adjacent to the major pedestrian way which the building abuts; subject to the approval of the Design Review Board. Page 33 `._. ~ _ r c r C c Section 15. Administration. I) Appointment. The Tawn Manager shall appoint an Administrator who shall administer and enforce this ordinance. This position may be combined with another position ofi the Town. 2) Duties. The Administrator shall be responsible for such duties as prescribed in this ordinance, and shall be responsible for enforcement of the sign regulations. The Administrator may serve notice indicating the nature of any violation, or requiring the removal of any sign in violation of this ordinance, on the owner or his authorized agent. The Ad- ministrator may call upon the Town Attorney to institute necessary legal proceedings to enforce the provisions of this ordinance, and the Town Attorney hereby is authorized to institute ap- propriate actions to that end. The Adminis- trator may call upon fihe Chief of Police and his authorized agents to assist in the enforcement of this ordinance. 3} Appeal of Administrative Action. Appeal from any administrative action or deter- mination by the Design Review Board or the Ad- ministrator pursuant to the provisions of this ordinance may be filed with the Town Council by any applicant within 30 days following such ac- tion or determination. In the event ofi appeal, the Council, after receiving a report from the Design Review Board and/or the Administrator, may confirm, reverse, or modify the action of the Design Review Board or the Administrator. A hearing shall not be required. Failure of the Council to act within 60 days of the filing of appeal shall be deemed concurrence in the action of the Design Review Board or the Admi n i strator. 4) Amendments. The regulations prescribed in this ordinance may be amended, or repealed by the Town Council. Page 34 _.~ ~ _ l -t Section 16. Nonconforming Signs. I) Definition of Nonconforming Signs. A nonconforming sign shall be, on the effective date of this ordinance, any sign which: a) Was erected prior to Qrdinance No, 15 Series of 1967; b) Becomes nonconforming due to amendment of this ordinance; c) Was in compliance with Qrdinance No. 15, Series of 1967, but due to the provisions of this ordinance is determined to be non- conforming; d) Is located in newly annexed territory and is determined to be nonconforming. 2) Continuance of Nonconforming Signs. Rny sign which has been determined to be non- conforming may be continued in operation and restored after the effective date of this ordinance provided it was erected prior to September II, 1967, or approved and in com- pliance with Ordinance No. 15 (Series of 1967). Nonconforming signs shall not be altered in any manner, but may be restored (see definition of 'restoration'). 3) Termination of Nonconforming Signs. a) By Abandonment. Abandonment of a non- conforming sign shall terminate immediately the right to continue such sign. b) By Violation of the Ordinance. Rny violation of this ordinance shall terminate immediately the right to continue a nonconforming sign. c) By Destruction, Damage or Obsolescence. The right to continue any nonconforming sign shall terminate when the sign becomes obsolete or substandard under any applicable ordinance of the municipality to the extent that the sign becomes a hazard or danger. d) By condemnation. The Town Council may choose to condemn a non-conforming sign. In the Page 35 ~~ ~~ l event the Town institutes condemnation pro- ceedings, the owner of the sign will be notified by certified mail. The owner will be reimbursed for the reasonable market value of the sign and no other cost factors will be considered. The owner shall submit an appraisal or invoice for the sign and the Town Council shall determine the reasonable market value. Further, the Design Review Board shall not grant a variance unless it specifically finds each and every one of the follow- ing conditions to exist: a) There are special circumstances or conditions, such as the existence of buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent public right- of-way which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or con- ditions must be peculiar to the particular busi- ness or enterprise to which the applicant desires to draw attention, and do not apply generally to ai I businesses or enterprises; b) The variance applied for does not depart from the provisions of this ordinance any more than is required to identify the applicant's business or enterprise, 2) Temporary Variances. The Design Review Board may grant variances of a temporary nature not to exceed six C6) months in duration. The purpose of a temporary variance is to allow an applicant to erect a sign of a temporary nature, which is in harmony with this ordinance, but that is essential to the operation of his enterprise. Rny person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished for such offense by imprisonment for not more than ninety {90) days or by a fine of not more than Three Hundred Dollars ($30Q.00) or by both such fine and imprisonment. Each day such violation is committed or permitted to continue, shall constitute a separate offense and steal! be punishable as such hereunder. Section 19, Safety Clause. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper to provide safiety, preserve the health, promote the prosperity, improve the morals, comfort and con- venience of the Town of Vail and the inhabitants thereof . Section 20. Severability. It is the intention of the Town Council that this ordinance or any part or provisions hereof, shall be considered severable and, if any provisions of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications. Section 2l. Application of Other Laws. Ifi any of the provisions of this ordinance are inconsistent with the provisions of any other ordinance or law, presently existing or enacted in the future, of the Town of Vail, in that the re- quirements regarding signs of the respective pro- visions differ, the provision containing the more restrictive requirements w i l l apply .
