HomeMy WebLinkAbout1973-17 Ratifying and Approving a Settlement in Civil Action No. 1958 in the District Court relating to the condemnation and acquisition of certain real estate in the TOVf ~. t` ~r ORDINANCE NO. 17 Series of 1973 AN ORDINANCE RATIFYING AND APPROVING A SETTLE- MENT IN CIVI L ACTION NO. 1958 IN THE DISTRICT COURT IN AND FOR THE COUNTY OF EAGLE, STATE OF COLORED O REI._ATING TO THE CONDEMNATION AND ACQUISITION OF CERTAIN REAL ESTATE WITHIN THE TOWN OF VAIL; AUTHORIZING THE EXPENDITURE OF FUNDS UPON CERTAIN CONDITIONS AND THE DISBURSEMENT OF SAID FUNDS IN EXCHANGE FOR A CONVEYANCE OF REAL ESTATE; AND SETTII~IG FORTH MATTERS AND DETAILS IN RELATION THERETO. WHEREAS, the Town of Vai[ enacted Ordinance No, 6, Series of 1973, on or about the 2Qth day of March, 1973, authorizing the condemna- tion of certain real estate therein described For municipal purposes; and WHEREAS, the Town of Vail as Petitioner duly filed a petition on or about April 13, 1973, in the District Court for the County of Eagle for the purpose of condemning the subject real estate; and WHEREAS, the Town of Vail and the owners of the subject real estate have negotiated in good faith a settlement of the case involving condemnation of the subject property and have arrived at a valuation of the property which is fair and acceptable both to the Town of Vail and the owners of the property; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF VAI L THAT: SECTION 1 . Ratification of Stipulation and Agreement. The Town Council hereby ratifies and approves a Stipu lotion and Agreement, dated September 17, 1973, entered into between the Town of Vail and Manor Vail Development Co., a Colorado corporation, Leave [l Development Corporation, a De laware corporation, and Leave l l-- Manor Vail, a Joint Venture. The Town Council further authorizes the filing of said Stipulation and Agreement in the District Court for the County of Eagle, State of Colorado, to be approved by the judge aF said court and made a part of the official court records in Civil Action No. 1958. SECTION 2. Authorization for Expenditure of Funds. The Tawn Council approves the expenditure of funds in accordance with said Stipulation and Agreement and authorizes the expenditure of such funds far the acquisition of the real estate described in Ordinance No. 6, Series of 1973. The authorization for any expenditure is specifically contingent upon the occurrence of the following events: a. The passage and approval of a sales tax question submitted to the electors of the Town of Vail at a special municipal election to be held an September 25, 1973. b . The passage and approva [ by the electors of the Town of Vai l of the question of real estate acquisition bonds (for acquiring the subject rea! estate) submitted at a special municipal election to be held on September 25, 1973. c. The successful underwriting of the subject municipal bonds. SECTION 3. Severability. IF any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not aFFect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, irrespective of the Fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
