AN ORDINANCE REZONING THE VAIL/POTATO PATCH
TRACT AND AMENDING THE OFFICIAL. ZONING MAP
WHEREAS, tho Vail/Potato Patch, a part of Section 6,
TSS, R80W, 6th P.M., County of Eagle, State of Colorado, hereinafter
referred to as "Potato Patch",a tract of land within the Town of Vail,
Colorado, hereinafter referred to as the "Town", is currently zoned
as indicated on the Official Zoning Pap of the Town, said zoning
districts also being designated on Exhibit 1 which is ar7 enlarged
reproduction of a portion of the Official Zoning Map showing the
Potato Patch, which exhibit is on file with the Zoning Administrator
of the Town and is made a part hereof by reference;
WHEREAS, Vail Associates, Inc., the sole owner of Potato
Patch, filed a petition for rezoning of said tract with the Zoning
Administrator of the Town on -the 20th day of December, 1973, which
petition proposed rezoning in accordance with Exhibit 2 which is a
copy of the proposed amendi7rent to the Official Zoning Map designating
the rezoning of said tract, which exhibit is on file with the Zoning
Administrator of the Town and is made a part hereof by reference;
WHEREAS, the Planning Commission of the Town held a
public hearing on said petition on the 24th day of January, 1974,
and submitted to the Town Council a report of said date which
recommended the approval of the proposed rezoning requests stated
in t:he petition, as amended;
WHEREAS, the Town Council of the Town scheduled a public
hearing on said petition on the 5th day of February, 1974, which
hearing was deferred to the 19th day of February, 1974;
WHEREAS, the petition for rezoning has been processed
by the Zoning Administrator, Planning Commission, and Towrr Council
in substantial compliance with the Zoning Ordinance, Ordinance .Jo. 8,
Series of 1973; and
WHEREAS, t:l-e Planning Commission has deterrnined that the
proposed rezoning rcguests 'in said petition would in effect dowry-zone
the tract as a whole and rc~~luce therein ti~re allowable developmer~~t
density, the Town Council deems it to be ir7 the public interest to
rezone Potato Patch i;~ accordance with said Exhibit l_ and to amend
accordingly that portion of the Official Zoning P~1ap;
NOW,THEREFORE, 6E IT ORDAINED 6Y THE T06JN COUNCIL OF TFIE
TOWN OF VAIL, COLORADO, AS FULLOtrJS:
Section 1. Title.
This ordinance shall be known as the "Ordinance Rezoning
Vail/Potato Patch".

Section 2. Rezoning of Vail/Potato Patch; amendment of
____ Official 7_oning Map.
Pursuant to Section 21.506 of the Zoning Ordinance, Ordinance
No. 8, Series of 1973, of the Town of Vail, Colorado, the Vail/Potato
Patch tract is hereby rezoned as indicated in Exhibit 2 hereof, which
exhibit is hereby made ar- amendment to the Official Zoning Map of the Town.
Section 3. Prrysical modification of Official Zoning Map.
As provided in Section 1.203 of the Zoning Ordinance, 'the
Zoning Administrator is hereby directed to promptly have the Official
Zoning Map physically modified in accordance with said Exhibit 2.
Section 4. Effective date.
This ordinance shall take effect five days after publication
following the final passage hereof.
INTRODUCED, READ ON FIRST READING, APPROVED, AND ORDERED
PUBLISHED ONCE IN FULL, this 19th day of February, 1974, and a public
hearing on this ordinance shall be held at the regular meeting of the
Town Council of the Town of Vail, Colorado, on the 5th day of larch,
1974, at 7:30 P.M., in the Municipal Building.
