AN ORDINANCE PROHIBITING DELIVERY, SERVICE,
AND OTHER COMMERCIAL MOTOR VEIiICLES FROM USE
OF STREETS TN ~~ONING DISTRICT COMMERCIAL
CORE 1 BETWEEN 11:00 A.M. AND 2:00 P.M.

WHEREAS, zoninc; district Commercial Core 1,

the principal commercial. area of the Town of Vail,
Colorado, hereinafter referred to as the "Yawn", is a
predominately pedestrian. environment having lodges,
residences, offices, retail stores, restaurants, bars,
and other commercial establishments;
WHEREAS, the Town Council of the Town considers
that it is appropriate, desirable, and reasonable to
prohibit delivery, service, and other commercial motor
vehicles from using the streets in said Commercial Core 1
between 11:00 A.M. and 2:00 P.M. daily through October 31,
1974, in order to enable pedestrians to more fully utilize
said streets, to accommodate the patrons of sidewalk restaurants
and bars, to reduce the :impact of motor vehicles on said
area and the persons within it at mid-day, and to enable
the municipality to study the effects of restricted vehicular
traffic in connection with its contemplated mall plan for
said area;
WHEREAS, the aforesaid limited restriction of the
use of its streets in said Commercial Core 1 is within the
police power of the municipality; and
WHEREAS, the amending of the Municipal Traffic
Code, which was adopted key the Towr. Code of Vail., requires
the amendment of said Town Code;

NOW, THEREFORI;1, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS:
Section 1. Title.
This ordinance shall be known as the "Ordinance
Restricting Use of Streets in Zoning District CC1 by
Commercial Motor Vehicles".
Section 2. Commercial motor vehicles prohibited
from using streets in zoning district Commercial Core 1
between 11:00 A.M. and 2:00 P.M. daily from July 24, 1974
through October 31, 1974; exception due to emergency;
amendments to Municipal Traffic Code.
A. Section 23-12 (b) of the Municipal Traffic Code
is amended by the addition of subparagraph (11) as follows:
Delivery, service, and other commercial motor
vehicles prohibited from using the streets in zoning
district Commercial Core 1, as established by Ordinance
No. 8, Series of 1973, of the Town of Vail, Colorado,
between 11:00 A.M. and 2:00 P.M. daily from July 24, 1974
through October 31, 1974; provided, however, that in the
event of an emergency t:he aforesaid restriction shall not
apply.
B. Section 23•-9 (b) of the Municipal Traffic Code
is amended by the addition of subparagraph (26) as follows:
Designate and :sign the streets in zoning district
Commercial Core 1 as to restricted use by commercial motor
vehicles.
Section 3. Effective date.
This ordinance shall take effect five days after
publication following the final passage hereof.

Section 4. Amendment to Town Code of Vail.
Upon its enactment this ordinance shall amend
Section 9-1-3 of the Town Code of Vail as provided in
Section 2 Ylereof .
INTRODUCED, READ ON FIRST READING, APPROVED, AND
ORDERED PUBLISHED ONCE 7CN FULL, this 2nd day of July,
1974, and a public hearing on this ordinance shall be held
at the regular meeting of the Town Council of the Town of
Vail, Colorado, on the 1.6th day of July, 1974, at 7:30 P.M.,
in the Municipal Building of the Town.
