HomeMy WebLinkAbout1974-23 Emergency Ordinance Amending the Zoning Ordinance by the Addition of Provisions to make it Applicable to Areas Subsequently Annexed to the Town for the Impositon of Zoning Districts on Annexed Areas• . • , s ORDINANCE N0. 23 Series of 1974 AN EMERGENCY ORDINANCE AMENDING THE ZONING ORDINANCE BY THE ADDITION OF PROVISIONS TO MAKE IT APPLICABLE TO AREAS SUBSEQUENTLY ANNEXED TO THE TOWN AND FOR THE IMPOSITION OF ZONING DISTRICTS ON ANNEXED AREAS WHEREAS, the Zoning Ordinance, Ordinance No. 8, Ser- ies of 1973, of the Town of Vail, Colorado, enacted on the 7th day of August, 1973, divided the municipality, as it existed upon the enactment thereof, into zoning districts of twelve use classifications as shown on the Official Zoning Map which was incorporated into and made a part of the ordinance, but did not contain provisions to make the ordinance expressly applicable to areas subsequently annexed to the municipality or for the imposition of zoning districts on annexed areas; WHEREAS, the Town of Vail, Colorado, hereinafter referred to as the "Town", annexed a portion of the Bighorn area, County of Eagle, State of Colorado, effective on the 11th day of September, 1974, and is required by Section 139- 21-14(2), Colorado Revised Statutes 1963, as amended, to bring the annexed area under its Zoning Ordinance within ninety days after the effective date of the annexation; WHEREAS, the Town Council adopted on the 24th day of September, 1974, Resolution No. 20, Series of 1974, expressing the intent of the Town to annex the easternmost portion of the Bighorn area, and adopted on the 29th day of October, 1974, Resolution No. 22, Series of 1974, regarding the proposed annexation and requiring the Town to file a petition for an annexation election in the District Court in and for the County of Eagle, State of Colorado, and in Civil Action No. 2285 the Town obtained from said District Court on the 31st day of Octo- ber, 1974, an Order to Hold An Annexation Election calling for Town~Clerk • • • • •' an annexation election to be held on the 10th day of Decem- ber, 1974; WHEREAS, other annexations to the Town may subse- quently occur; WHEREAS, the determination of the zoning districts to be imposed on the portion of the Bighorn area heretofore annexed to the Town and on any other areas annexed hereafter should be made after public hearings on the matter have been conducted by the Planning Commission and the Town Council; and WHEREAS, in order to hold the aforesaid public hear- ings, properly consider and determine the zoning districts to be imposed on the annexed area, and enact an ordinance impos- ing zoning on the annexed Bighorn area which will be effective by the 12th day of December, 1974, as is required by the afore- said statute, the Town Council considers that the enactment of this ordinance as an emergency measure is necessary for the preservation of the public property, health, welfare, peace, or safety; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. Title. This ordinance shall be known as the "Ordinance Amending Zoning Ordinance To Impose Zoning on Subsequently Annexed Areas" Section 2. Amendment procedures fulfilled; Planning Commission report. The amendment procedures prescribed in Section 21.500 of the Zoning Ordinance have been fulfilled with the report of the Planning Commission recommending the enactment of this ordinance. Section 3. Amendment to Zoning Ordinance. The Zoning Ordinance, Ordinance No. 8, Series of 1973, of the Town of Vail, Colorado, enacted on the 7th day of August, ~~. Tow Clerk 2 ~ ~ ~ i ~ 1973, is hereby amended by the addition of the following pro- visions: Article 22. Annexed Areas. Section 22.100. Ordinance applicable to subsequently annexed areas. This ordinance shall be applicable to any area annexed to the Town of Vail, Colorado, subsequent to the effective date hereof, and zoning districts shall be initially imposed on the annexed area within the time prescribed in the annexing ordi- nance and in accordance with the provisions of Article 22 hereof. Section 22.200. Imposition of zoning districts; addition to Official Zoning Map. 22.201. An annexed area shall be divided into one or more zoning districts as established by Section 1.201 hereof. 22.202. The zoning districts imposed on an annexed area shall be shown on a map which shall become an addition to the Official Zoning Map adopted by Section 1.202 hereof. Section 22.300. Procedures for determination of zoning districts to be imposed on an annexed area. 22.301. After the effective date of an annexing ordinance, the Town Council by motion shall direct the Planning Commission to set a date for a public hearing to consider the zoning districts to be imposed on the annexed area. 22.302. Notice shall be given, the hearing shall be conducted, and a report of the Planning Commission stating its findings and recommendations shall be transmitted to the Town Council in accordance with the applicable provisions of Arti- cle 21 hereof. 22.303. Upon receipt of the report of the Planning Commission, the Town Council shall determine the zoning dis- tricts to be imposed on the annexed area in accordance with the applicable provisions of Sections 21.505 and 21.506 hereof. /'-~ ` Town~lerk 3 • ,. • i +. 22.304. The aforesaid determination by the Town Council shall be made through its enactment of an ordinance imposing zoning districts on the annexed area. Section 4. Effective date. This ordinance shall take effect upon the passage hereof .
