HomeMy WebLinkAbout1974-28 Emergency Ordinance Amending Section 9-1-3 of the Town Code of Vail Relating to the Authority to Impound Vehicles,: • . • ORDINANCE N0. 28 Series of 1974 ~ # AN EMERGENCY ORDINANCE AMENDING SECTION 9-1-3 OF THE TOWN CODE OF VAIL RELATING TO THE AUTHORITY TO IMPOUND VEHICLES WHEREAS, the Municipal Traffic Code was adopted by Title IX, Chapter 1, of the Town Code of Vail with the amend- ments set forth in Section 9-1-3 of said chapter; WHEREAS, Section 2 of Ordinance No. 3, Series of 1973, of the Town of Vail, Colorado, rendered it unlawful for any person to park a vehicle on any private property in the municipality without the consent of the owner, tenant, or per- son in possession or control of said property; WHEREAS, Article XII, Section 12-3, of the Municipal Traffic Code provides that on any street or at any place within this municipality where official signs are posted giving notice of parking restrictions or prohibitions as authorized in Sec- tion 23-9 thereof and described in traffic control schedules as provided in Section 23-13 thereof, no person shall park a vehicle in any manner in violation of the provisions contained on such sign, with certain exceptions as specified therein; WHEREAS, the Town Council of the Town of Vail, Colo- rado, hereinafter referred to as the "Town", considers that it is necessary, reasonable, and appropriate to amend Article XXII, Section 22-20, of the Municipal Traffic Code so as to extend the authority to impound vehicles to permit impoundment when- ever a vehicle is parked in violation of a provision contained on an official sign, provided that said sign warns that viola- tion thereof shall occasion impoundment; and WHEREAS, inasmuch as many persons are illegally park- ing vehicles on the public streets and on private property in the municipality and thereby creating serious inconvenience to Town erk .. • • .~. -. ~- i Ord. 28, 1974 Page 2 the citizens, inhabitants, and visitors of the Town, the Town Council finds that the enactment of this ordinance as an emer- gency measure is necessary for the preservation of the public property, health, welfare, peace, or safety; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. Title. This ordinance shall be known as the "Ordinance Amending Code Section 9-1-3 Relating to Impounding Vehicles". Section 2. Amendments to Section 9-1-3 of Town Code. Section 9-1-3 of the Town Code of Vail is hereby amended by the addition of the following subsections: (g) Article XXII, Section 22-20, is hereby amended by adding the following subsections: (c) Whenever any police officer finds a vehicle parked on any street or at any place within this municipality in violation of a provision contained on an official sign which provides that a violation shall occasion impoundment of the vehicle, such officer shall require such vehicle to be removed or cause the same to be removed and placed in storage in a place of safety designated or maintained by this municipality. (d) A vehicle illegally parked on private pro- perty shall not be impounded pursuant to section 22-20(c) hereof unless a complaint for said violation is signed by the owner, lessee, tenant, or authorized agent, who is legally in posses- sion or control of said property. (e) In the event a vehicle is properly impounded pursuant to subsection (a), (b), or (c) of section 22-20 hereof the owner or driver of the vehicle shall pay as a fine a reasonable amount for said removal or removal and storage in addition to the penalty imposed for illegal parking or any other violation of any of the provisions hereof. Town lerk Ord. 28, 1974 Page 3 (h) Article XXIII, Section 23-9, is hereby amended by adding the following subsection: (c) Prior to establishing pursuant to section 23-9(b)(9) hereof restrictions for the parking of vehicles on private property which he considers to be necessary, reason- able, or appropriate, the traffic engineer or other official vested with the office as provided herein shall receive a written request regarding the proposed restrictions signed ' ~ by the owner, lessee, tenant, or authorized agent, who is ~~~ legally in possession or control of said property. Section 3. Effective Date. This ordinance shall take effect upon the passage hereof. INTRODUCED, READ AS AN EMERGENCY ORDINANCE, APPROVED, ENACTED TO TAKE EFFECT UPON FINAL PASSAGE ON THIS DATE, AND ORDERED PUBLISHED ONCE IN FULL WITHIN TEN DAYS AFTER PASSAGE OR AS SOON AS POSSIBLE, this 3rd day of December, 1974.
