HomeMy WebLinkAbout1977- 4 Requiring the Registration of ContractorsA ~ ! r ORDINANCE NO. ~- Series of 1977 AN ORDINANCE REQUIRING THE REGISTRATION OF CONTRACTORS; THE ISSUANCE OF CONTRACTORS' REGISTRATION; PROVIDING DEFINITIONS; ESTAB- LISHING STANDARDS; PRESCRIBING REGISTRATION FEES; PROVIDING FOR REVOCATION OR SUSPENSION OF THE REGISTRATION AND PROVIDING PENALTIES FOR VIOLATIONS, AND SETTING FORTH DETAILS IN RELATION THERETO WHEREA5, The Town Council for the Town of Vail has determined that it is in the public interest to regulate certain construction work within the Town of Vail by re- quiring the registration of contractors under certain cir- cumstances; and WHEREAS, the registration of contractors will assure improved standards of work, and assure the safe and competent construction of structures within the Town of Vail, as well as repairs and related works, and WHEREAS, the requirement of registration for con- tractors will enable the better control and regulation of construction activities within the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TO~'~IN COUNCIL OF THE TOWN OF VAIL, COLORADO: Section 1. Definitions. A. Board: Shall be the Board of Appeals as defined in the Uniform Building Code, as adopted by the Town of Vail. B. Building Permit: Shall be such permit as is prescribed in the Uniform Building Code, as adopted by the Town of Vail. C. Building Code: Shall be i~he Uniform Building {Bode as adapted by the Town of Vail. D. Building Official: Sha11 be as defined in the Uniform Building Code as adopted by the Town of Vail. . ~ {~ Ord. y' Page 2 E. Contractor: Shall be any person who contracts with or offers to contract with another for the undertaking of any form of construction work inclu- ding, but not limited to, repairs, alterations, ar renovation of any building or structure. "Contrac- tor" shall also include any person who for himself undertakes any form of construction work including, but not limited to, repairs, alterations, or reno- vation of any building or structure. F. Person: Means individual, corporation, business trust, estate, trust, partnership, ar association, or any other legal entity. G. Registration: Shall be issued by the Building Authority of the Town of Vail in accordance with the provisions of this ordinance. Section 2. Registration. All contractors engaged in construction work, including, but not limited to, repairs, alterations, or renovations of any building or structure, or excavation work, shall be registered under the terms and provisions of this ordinance prior to under taking any construction or excavation work or contracts and/or applying for any type of permit required by applicable State Statutes or ordinances of the Town of Vail. Section 3. Building Permits. Contractors shall apply for and be issued building permits or street cut permits to do only such work as they are entitled to do under their respective registrations, Any appli~ cation for a permit or license filed in derogation of this ordinance shall be deemed to have been filed with fraudulent intent and shall be a nullity. Exceptions. Any individual may make application for a building permit to do his own work on his own premises without being registered under the following provisions: A. That such work shall be limited to minor altera- bons, maintenance, and decorating, providing such work does not alter the building structurally. Ord. ~ Page 3 B. That in the opinion of the Building Official Such work can and will be accomplished in a safe manner by the applicant. Section 4. Application and Tssuance of Registration. Appeals. A. Applications. Applications for registration sha11 be on such forms as provided by the Town of Vail. Forms sha11 be available from the Building Official's office. B. Tssuance. (1} All applications shall be reviewed by the Build- ing Off icial. The standard to be applied in the con- duct of such review shall be the protection of public health and safety for the people of the Town of Vail. (2) Tf in the judgment of the Building Official, the applicant is qualif ied by training or experience and is financially responsible to fulfill the obliga-~ tion of a contractor, he shall issue the applicant a registration card upon payment of the registration fee as prescribed by this ordinance. (3) Tf the applicant is seeking a Registration E, M, or P, and holds a State of Colorado license corres- pond ing therewith, the Building Official shall issue the applicant a registration card upon payment of the registration fee as prescribed by this ordinance. (4} Tf the Building Official does not believe that the applicant qualifies for a registration card as required by this ordinance, he shall refer the application to the Board far review and action. (a) The applications referred by the Bui1d- 5 ing Official sha11 be reviewed by the Board. The standard to be applied in the conduct of such review shall be the protection of public health and safety for the people of the Town of Vail. (b) If in the judgment of the Board, the applicant is qualified by training or experience and is financially responsible to fulfill. the ,_ r E Ord. L~ Page 4 obligation of a contractor, it shall direct the Building Official to issue the applicant a registration card upon payment of the registration fee as prescribed by this ordi- Hance. {c) If in the judgment of the Board, the applicant is not qualified, it may require an oral or written examination or both. Such written examination shall be administered by the Building Official who will forward the results of such examination to the .Board for review and final action. All such examination requirements shall be limited to areas as may be applicable to the registration type being sought. {d} The Building Official may issue a probationary registration pending review of the Board. Such probationary registration shall expire Hat later than thirty {30) days after date of issue. (e) If other licenses or lawful require- ments~are imposed upon the applicant by other ordinances of the Town or laws of the State of Colorado, such requirements shall be deemed pre- requisites to the issuance of a registration as required by this ordinance. Section 5. Supervisors. All persons to wham a registration card has been issued shall not be required to possess those skills and qual-~ ifying experience required for the work they are permitted to do under their respective licenses provided they retain in their business a supervisor whose skills and experiences are such that he would be qualif ied to do all work in his principal's registration category. Ord. ~' Page 5 Section 6. insurance. A. Every person granted a registration card under the provisions of this ordinance shall be required to maintain the following types and amounts of insurance at all times: employee's liability, work-- men's compensation, and public liability within minimum limits of not less than Three Hundred Thou- sand Dollars ($300,000.00) for any one person and any one accident, and public property damage with a minimum limit of not less than Twenty-Five Thousand Dollars ($25,000.00) for any one accident. B. Contractors applying for an excavation registra- tion ("X" Registration) as def fined herein shall be required to have at least Twenty-Five Thousand Dollars {$25,000.00) worth of "X.C.U." (Explosion, Collapse, Underground) insurance in addition to the required General Liability and Workmen`s Compensation Insurance. C. At the time application is made and before a registration card can be issued, the applicant sha11 file with the Building Official a certificate issued by an insurance company qualified to do business in the State of Colorado stating that the policy or policies required by this ordinance have been issued to the applicant listing the minimum limits of each, effective policy numbers, the name of the company,. effective date of policies,- and the expiration dates, together with a statement and a copy of an endorse- ment placed on such policy or policies requiring ten (10) days written notice by registered mail. to the Building Official, Town of Vail, if it becomes nec- essary to cancel the policy ar policies, for any reason. • Ord. ~ Page 6 Section 7. Registration Classification and k'ees. A. Building Contractor Registration A shall entitle the holder thereof to contract for and build, alter, or repair any type or size of structure for which a building permit is required, excluding excavation, plumbing and mechanical. B. Building Contractor Registration B shall ba the same as "A" above except limited to a building permit value of $100,000 excluding excavation. C. Electrical Contractor Registration E shall entitle the holder thereof to contract for and install all electrical apparatus and appurtenances for which an electrical permit is required. D. Mechanical Contractor Registration M shall entitle the holder thereof to contract for and install all warm air heating, ventilation, exhaust systems, and all appurtenances for which a mechanical permit is required. E. Plumbing Contractor Registration P shall entitle the holder thereof to contract for and install all piping and other appurtenances for which a plumbing permit is required, excluding fire systems. F. Special Contractor Registration S shall entitle the holder thereof to contract for other trades not specifically classified elsewhere in this ordinance such as, but not limited to, masonry, plastering, ele- vator installation, glaziers, drywall, landscaping, steel fabrication and erection, house moving, demo- lition, asphalt paving, concrete form and finish, or any other particular trade or work connected with the building industry, excluding excavation and heavy earth moving equipment. All work classif ied under this registration card shall be limited to the trade spec if ied in such registration. Ord. ~ Page 7 G. Excavation Contractor Registration x shall entitle the holder thereof to excavate and utilize heavy earth moving equipment. Trucking for the purpose of merely transporting materials shall not require a license. Registration Fees. A. A11 registrations shall be valid for a period ending one year after the last day of the month prior to which the registration was issued. C. The holder of one registration sha h. be charged one-half the registration fee for each additional registration card he may require under this ordinance. D. No permits may be obtained, nor may work already under permit be continued until the registration has been renewed. Registration may be renewed by the Building Off icial upon payment of the renewal fee provided the registration card has not expired, been suspended, or revoked by the Board. Section 8. Responsibility, Revocation and Appeals. A. Responsibility. A contractor sha11 be responsible for all work included in his contract or undertaking .:ii „~ ' Ord, 4 Fage $ whether or not such work is done by him directly ar by a subcontractor. B. Violations. Tt shall be a violation of this ordinance for any registree hereunder to commit any of the following acts: {1} Commencing any construction work without first obtaining a registration card as required by this ordinance. (2) Any violation of ordinances or codes governing construction. (3) Failure to maintain construction site grounds clean and safe, or causing damage to pro- perty adjoining the construction site. (4) Fraudulent use of a registration card to obtain permits for another person, firm, or corpor- ation. (5) Failure to obtain inspections when same are required or failure to obtain a permit when required. C. Revocation and Penalties. {1) Upon written notice from the Building Offi- cial, any registered contractor violating any of the provisions of this ordinance shall appear before the Board of Appeals at a public hearing, . (2) Notice - not less than 15 days prior to the date set for the hearing, the Building Official shall cause a notice of the time and place of such hearing to be published once in a newspaper of general circu- lotion in the County of Eagle. (3) Action by the Board of Appeals - if the Board finds that the registered contractor has not acted with the standards set out to preserve the health, safety or welfare of the community, they may ~ issue a warning, revoke or suspend the registration of the contractor' in question far whatever time they deem reasonable. r Ord. ~ Page 9 (4) Appeal of any action of the Board of Appeals in connection with the revocation or sus- pension of a contractor's license or conditions attached thereto may be filed with the Town Council by any resident, property owner, or contractor within 30 days following such action. In the event of an appeal, the Council, after receiving a report by the Board of Appeals, may confirm, reverse, ar modify the action of the Board of Appeals. Failure of the Council to act within 30 days of the filing of an appeal shall be deemed concurrence in the action of the Board of Appeals. (5) A complaint may be filed in the Municipal Court for the Tawn of Vail charging a violation of this ordinance. Upon conviction thereof, the con- tractor, agent or representative therefor may be punished by a fine of not more than $300 or imprison- ment of not more than 90 days or bath such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. Section 9. 5everability. If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Town Council hereby declares that it would have passed this ordinance and each section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub-sections, sentences, clauses or phrases may be declared invalid. Section 10.
