HomeMy WebLinkAbout1977- 5 Amending the Sign Code of The Town of Vail ORDINANCE NO, Series of 197 7 AN ORDINANCE AMENDING THE SIGN CODE OF THE TOWN OF VAIL, TO PROVIDE DEFINITIONS, CONTINUANCE, AND TERMINATION OF NONCON- FORMING SIGNS AND THE ADMINISTRATIVE PROCEDURE FOR THE IMPLEMENTATION THEREOF; AND THE ADMINISTRATIVE PROCEDURE WITH RELATION THERETO; SAVING PROSECUTIONS AND PENALTIES FOR VIOLATIONS; AND, SETTING FORTH MATTERS IN DETAIL IN RELATION TO THE FOREGOING WHEREAS, the Sign Code for the Town of Vail was adopted in Ordinance No. 9, Series of 1973, providing a comprehensive sign ordinance for the Town of Vail; and WHEREAS, the Town Council has determined that provisions should be made for the amortization of non-- conforming signs to fully implement the stated purposes of the Town's comprehensive sign ordinance including the co-ordinatcd and harmonious development of the Town in a manner that will conserve and enhance its natural environ- ment and character; and WHEREAS, the Town Council has determined that it is in the interest of the public welfare to enact these fallow- ing amendments to Ordinance No. 9, Series of 1973, for the public health, welfare and safety; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 1b "Nonconforming Signs" of Ordinance Na. 9, Series of 1973, is amended to read as follows: Section 16. NONCONFORMING SIGNS (1) Definition of Nonconforming Signs. Nonconforming signs shall be, on the effective date of this ordinance, any sign which: • (a) was erected prior to the effective date of Ordinance No. 9, Series of 1973, and does not conform to the provisions set forth therein; .: ~: ,. , :.. - ~ .;£ Ord. 5 Page 2 (b) is located in newly annexed terri- tory and is determined to be non- conforming (the effective date of the annexation shall constitute the beginning date upon which all non- conforming signs shall be subject to the amortization schedule set forth herein); (c) becomes a nonconforming sign due to amendment of the Town of Vail Sign Code. (2) Continuance of Nonconforming Signs. Any sign which,in accordance with the def ini- tions contained in Subsection 16{1) above, has been determined to be nonconforming may continue in use and operation after the effective date of this ordinance only as provided in Subsection 16(3} below. However, the amortization period spec if ied below shall cease immediately if the operation of the nonconforming sign is otherwise terminated, and the nonconforming sign shall be removed within 30 days of said termination. {3) Termination of nonconforming signs. The use or operation of nonconforming signs shall be terminated as follows: {a) by obsolescence - at such time as any sign shall become obsolete. A sign becomes "obsolete" with the discontinuance of the business, ser- vice or activity which it advertises; removal of the business or activity from the location to which it directs or for other similar reasons provided, however, that this provision shall not apply to seasonal closings. {b) by abandonment. Abandonment of a non- conforming sign shall terminate imme- diately the right to use or operate such sign. (c} by destruction, damage or alteration. The right to continue use or operation of any nonconforming sign shall ter- minate whenever the sign is altered in any way, or damaged or destroyed over 50% of its appraised value. {d) by violation of this ordinance. Any violation of this ordinance shall ter- minate immediately the right to continue a nonconforming sign. (e} by condemnation. The Town Council may choose to condemn a nonconforming sign. Recommendations for condemnation may be made by the Design Review Board. Ord . .~ (f} by amortization. continue to use conforming sign five years after of this ordinanc of the area in ti located to the '~ The right to or operate a non- shall terminate the effective date e or the annexation hi.ch the sign is own of Vail. {9) Administrative Procedure. t Page 3 (a) Within a reasonable time after the effective date of this ordinance ar the effective date of the annexation of any area to the Town of Vail, the Sign Code Administrator shall compile a list of the existing nonconforming signs and present said list to the Design Review Board at its next regularly scheduled meeting. The Design Review Board may affirm, add to or delete signs Pram the list as presented by the Sign Code Administrator. After the review of the list of noncon- forming signs by the Design Review Board, the Sign Code Administrator shall send written notice by regular mail, postage prepaid, to the owner of the nonconform- ing sign (if known to the Sign Code Administrator) and to the owner of the property, business, interest or enter- prise advertised or identif ied by the nonconforming sign. Within 15 days from the date of said notice, the owner of the sign or the property, business, interest ar enterprise advertised or identif ied by the nonconforming sign may appeal the classification of the sign as n~nconform- ing to the Design Review Board and the Town Council, or he may file an applica- tion for a variance. The date of the notice shall be deemed to be the date of its mailing. The Design Review Board may recommend to the Town Council that the application for a variance be granted, and the Town Council may approve the appli- cation if it is found that the sign sub- stantially conforms to Ordinance Na. 9, Series of 1973 (as amended}, that it does not adversely affect the character of the neighborhood, and the same would be in the public's interest. If the variance is granted, the sign may continue in existence subject to the provisions of Ordinance No. 9, Series of 1973 {as amended) and subject to any conditions that may be made on the approval by the Town Cauncil. If the application is denied, the right to con- tinue a nonconforming sign shall terminate in accordance with the provisions of this Section l6. (b} In the event that a nonconforming s~.gn is not removed upon termination as proms vided above, the Sign Code Administrator shall give written notice of said failure to remove the nonconforming sign by regis- tered or certified mail to the owner of the Ord. s Page 4 sign (if known to the Sign Code Administrator}, the owner of the property upon which the sign is located, and the owner of the bus- iness, property, interest or enter- prise identified or advertised by said nonconforming sign. If the sign is not removed or repaired as required by this ordinance, within 15 days after the date of the notice, the Sign Code Administrator may cause such sign to be removed at the expense of the person to wham the notice was directed, and shall, upon the deter- mination of such expenses, certify the same to the Director of Finance for the Town of Vail. The Director of Finance shall notify the person or persons to whom the notice was directed of the total cost incurred for such removal of the sign, and if that cost has not been paid within 30 days after the date of notification to pay the entire cost and expense of such removal, such costs and expenses shall became a lien against the property of the recipi- ents, and the Director of Finance shall certify the same to the Eagle County Treasurer for collection in the same manner as general property taxes are collected. The amount certified by the Director of Finance to the County Trea- surer for collection shall include the actual cost of repair or removal of said sign, plus 15~ in addition thereto, shall include an amount ecrual to 10~ as penalty and interest far the cost of collection. The date of mailing sha11 be deemed the date of the notice or notification Section 2. The repeal and re-enactment of the above section of the Sign Code of the Town of Vail shall not consti- tute a bar to the enforcement of any violations of the sections so repealed or re-enacted, or the prosecution and punishment of any act or acts already committed in violation of this section so repealed or so re-enacted. All sections repealed by this ordinance shall remain in full force and effect for the purposes of sustaining any and all actions to enforce the same, suits, proceedings, prosecutions instituted, and the penalties imposed therefor, which arose prior to the effective date of this ordinance. Section 3. A11 sections or parts of sections of the Sign Code or Zoning Ordinance of the Town of Vail, ordinances or parts of ordinances in conflict or inconsistent herewith, . ~ . ~ ~ * ~ Ord. 5/ Page 5 are hereby repealed, provided, however, that the repeal of any section or parts of sections of the ordinances of the Town of Vail shall not revive any other section of said ordi- nances heretofore repealed or superseded. Section 4. Tf any part or parts hereof are held to be invalid, unconstitutional, or void, such shall not affect the remaining portions of this ordinance. Section 5. This ordinance shall take effect in accordance with the provisions of the Charter of the Town of Vail.
