AN ORDINANCE AMENDING SECTION 18,54.020
BOARD - ORGANIZATION ~ AOWERS AND DUTIES
OF THE VAIL MUNICIPAL CODE, ENLARGING THE
DESIGN REVIEW BOARD FROM FIVE TO SEVEN
MEMBERS; PROVIDING FOR A THREE MEMBER
SIGN-REVIEW SUBCOMMITTEE OF THE DESIGN
REVIE[nT BOARD; SETTING FORTH DFTAZLS AS
TO MEMBERSHIP, TERMS, HEARING AND AppEA7.,
PROCEDURES OF THE' SIGN--REVIE[,z COMMITTEE
AND SETTING FORTH DETAILS IN RELATION
TO THE FOREGOINr
WHEREAS, the Design Review Board presently reviews
signs as well as its other duties+
WHEREAS, the review of signs consumes a great amount
of time of the Design Review Board
WHEREAS, the time of the Design Review Board could
be more efficiently used if the review of signs were delegated
to another body; and
WHEREAS, the Town Council is of the opinion that a
sub-committee of the Design Review Board should be formed to
review only sign applications;
DTOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, THAT;
(1) Section 18.54.020 Board - Organization - powers
and Duties of the Vail Municipal Code is hereby repealed and
reenacted to read as follows:
18.54.020 Board - Organization - Powers and Duties.
A. Pursuant to the charter of the town, Section
8.6, there is established a design review board
of the town, a board composed of seven members
appointed by the town council to which is
delegated the powers and duties to administer
Chapter 18.54 of this title.
B. The term "Design Review Board" shall be deemed
to refer to the full seven member board, provided,
however, that three members of the Design Review
Board shall serve as a sign review committee as
more fully set forth below.

C. That portion of the Design Review Board that
reviews all matters except signs shall consist
o£ five members. Four mer!~bers sha11 be from
the c~,~LL~~unity at large and the fifth member
sha11 be a member of the planning commission of
the town. The terms of off ice for the four
members at large shall be two years on an over-
lapping basis and the term of off ice for the
planning c~~~u«ission member sha11 be six months;
provided, however, that of the four members at
large initially appointed, two members shall
serve for terms of two years, and two members
shall serve for terms of one year, and after the
expiration of the initial terms, each member
subsequently appointed shall serve for a term of
two years.
D, The sign review committee of the Design Review
Board shall consist of three members. Two members
shall serve only on the sign review committee and
the third shall serve on the sign review committee
and the other portion of the Design Review Board.
The terms of off ice of the two members serving
only on the sign review committee sha11 be two
years, provided, however, that one of the initial
members appointed by the town council shall be
appointed to a one year term and the other to a
two _year term. The third member shall be selected
by the Design Review Board from its members not
appointed by the town council to serve only on
the sign review committee and the third member's
term shall be for six months.
E. The sign review committee sha11 review all appl-
cations for signs except those attached to a
structure and which have been or will be reviewed
by the five member Design Review Board along with
review of the structure.
F. A vacancy on the Design Review Board shall occur
whenever a member of the board is removed by the
town council dies, becomes incapacitated and unable
to perform his duties for a period of ninety days,
resigns, ceases to be a resident of the community
at large, or is convicted of a felony, In the
event a vacancy occurs, the town council shall
appoint a successor to fill the vacancy and serve
the remainder of the term of the former member.
A11 members of the board sha11 serve without
compensation. The board and the sign review
committee shall select its own chairman and vice-
chairman from among its members. The chairman or, ~'
in his absence, the vice chairman shall be the
presiding officer of its meetings. Tn the absence
of both the chairman and the vice--chairman from a
meeting, the members present shall appoint a member
to serve as acting chairman at the meeting. All
business of the board sha11 be conducted at meet
ings which are open to the public, A11 meetings
shall be held at the municipal building of the
town; unless otherwise spec if led with adequate
notice given to all interested parties. Three
,members sha11 constitute a quorum for the trans
action: of business, but in the absence of a quorum,
a lesser number shall adjourn any meeting to a
later time or date, and in the absence of all
members, any staff member shall adjourn any meeting
to a later time or date.

G. The procedures of the sign

H. The board shall operate in accordance with its
own rules of procedure as provided for in
Section 8.6 of the Home Rule Charter. The
rules shall be filed with the town clerk and
maintained in the records of the town and
shall be subject to public inspection; pro-
vided, however, that the board shall submit
its proposed rules or any amendment thereto to
the town council which by motion shall approve
the rules or amendment and direct their adopt-
ion by the board or disapprove the proposal with
directions for revision and resubmission.
I. The town manager or his designated representa-
tive is authorized to retain the services of
one or more consulting architects, landscape
architects, or urban designers, who need not
be licensed to practice in the state, to advise
and assist the board in performing the design
review functions prescribed in this chapter.
The consultants may be retained to advise the
board on a single project, on a number of pro-
jects, or on a continuing basis. It is the
intent of this section that the board will
review relatively small--scale projects, such
as individual single-family residences, duplexes,
accessory structures, and minor additions to
existing structures, without the assistance of
consultants, and that consultants will be retained
to advise and assist the board in reviewing rela-
tively large-scale projects, such as groups of
single-family residences or duplexes, individual
multiple dwellings, lodges, semi-public facilities
of all types, and commercial, industrial and
utilities developments.
J. The design review board and the sign review com-
mittee thereof shall meet upon call of the chair-
man. Meetings shall be called sufficiently fre-
quently that the design review procedure prescribed
in this chapter shall c~~~LL«ence within 30 days of
submission of material required by Section 18.54.050.
{2) Section 18.54.090 Appeal to Town Council is hereby
amended by the addition of a new subparagraph E, to read as
follows
E. A decision of the sign-review committee may be
appealed to the five-member Design Review Board
by the applicant, any aggrieved person or the
town manager. Said appeal must be filed with
the Sign Code Administrator within 20 days of
the date of the decision. Review by the besign
Review Board shall be in accordance with Chapter
18.54 and the procedures of the Design Review
Board. A decision by the Design Review Board
after appeal may be appealed to the Town Council
in accordance with the procedures therefor con-
tained in this Section 18.54.090.

{3) If any part or parts of this ordinance are for
any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this ordinance. The
Town Council hereby declares that it would have passed this
ordinance and each section, subsection, sentence, clauser or
phrase thereof, irrespective of the fact that any one or more
sections, subs-sections, sentences, clauses or phrases may be
declared invalid.

appealed to iha Tawn Cauncll in accordance
with the procedures tharefgr contalneq In
this Section 18.54.090.

are for any reason held to be Invalid, such
decision shall not affect the validity of the
remaining portions of this ordinance, Tha
Town Cauncll hereby declares that It would
have passed Thl s ordinance and each section,
sub-section, seniente, clause, or phrase
thereof, irrespective of the fact that any one
or more sections, sub•secffons, sentences,
clauses or phrases may be declared Invalid.
