AN ORDINANCE AMETdDING CHAPTER 18.30 OF
THE VATL MUNICIT~AL CODE TO REQUIRE THAT
ALL EXISTING USES IN HEAVY SERVICE ZONE
DISTRICTS THAT HAVE OR WILL HAVE OUTSIDE
STORAGE SHALL FENCE OR LANDSCAPE THE
OUTSIDE STORAGE TO SHIELD THE SAME FROM
VIEW FROM ANY PUBLIC ROAD, STREET, OR
RIGHT-OF~-WAY; PROVTDI.NG THAT SAID LATdD-
SCAPTNG OR FENCING SHALL BE COMPLETED
ON OR BEFORE JULY 1, 1979; PROVIDING
THAT THE MAINTENANCE OF OUTSIDE STORAGE
TTd A HEAVY SERVICE ZONE DISTRICT WITHOUT
FENCING OR LANDSCAPING AS REQUIRED SHALL
BE UNLAWFUL; AND SETTING FORTH DETAILS
IN RELATION THERETO
WHEREAS, the Town Council is of the opinion that the
outside storage of materials adjacent to public ways and visible
from public ways is detrimental to the aesthetic character of
the Town that the Council wishes to maintain;
WHEREAS, the outside storage of materials that are
visible to the traveling public is contrary to the recreational
and resort character of the Town of Vail;
L~HEREAS, the outside storage of materials adjacent to
public ways creates dangerous obstructions to the traveling public
including possible distraction to operators of vehicles and the
blowing of materials or debris across the public way; and
WHEREAS, the Town Council is of the opinion that this
ordinance is necessary for the public health, safety and welfare;
NOW, THEREFORE, BE TT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VATL, COLORADO, THAT:
Section. ~.. Chapter 18.30 Heavy Services District of
the Vail Municipal Code is hereby amended by the addition of a
subsection B to Section 18.30.130 Landscaping and Site Develop-
ment , to read as follocas
B(1} The Town Council hereby finds and declares
that the establishment and use and mainte-
nance of outside storage areas in Heavy
Service Districts adjacent to public streets,
roadways, or highways should be controlled in
order to protect the public investment in
such streets, roadways and highways, to pro-
mote the safety and recreational value of
public travel, and to preserve the beauty,
aesthetics and resort character of the Town
of Vail.

(2) Tt shall be unlawful for any owner,
manager, occupant or tenant who owns
or controls any parcel of property
located within a Heavy Service District
to fail to effectively screen from view
any outside storage of materials, vehi-
cles, debris or junk which is within
150 feet of the nearest edge of the
traveled portion of any roadway, street,
or highway or which is visible from the
traveled portion of the street, roadway
or highway.
(3) Effective screening from view means that
outside storage shall be screened by
natural objects, plantings, fences, or
other appropriate means so as not to be
visible from the main traveled way of the
street, roadway or highway, or shall be
removed from sight.
(4) Plans for proposed improvements must be
submitted to the Design Review Board no
later than November 1, 1978, and approved
improvements installed no later than
~u~y 1, 1979.
(5) Prior to the installation, construction
or placement of any screening as required
by this ordinance, plans therefor shall
be submitted to the Design Review Board
for its approval in accordance with Chap-
ter 18.5 of this Title.

Section 2. If any part, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance; and the Town Council hereby
declares that it would have passed this ordinance, and each part,
section, subsection, sentence, clause or phrase hereof, regard-
less of the fact that any one or mare parts, sections, subsections,
sentences, clauses or phrases be declared invalid.
Section 3. The Town Council is of the opinion that
this ordinance is necessary for the protection of the public
health, safety and welfare.
INTRODUCED, READ ON FTRST READING, APPROVED, AND ORDERED
PUBLTSHED ONCE IN FULL, this 20th day of June, 1978, and a public
hearing on this ordinance sha11 be held at the regular meeting
of the Town Council of the Town of Vail, Colorado, on the 18th
