AN ORDINANCE A.MENDTNG TITLE 18 OF THE
VATL MUNICIPAL CODE BY THE ADDITION OF
SECTION 18.66.180 TO PROVIDE THAT ALL
REAL PROPERTY ACQUIRED BY THE TOWN OF
VATL FROM VATL ASSOCIATES IN ANY MANNER
SHALL BE SUBJECT TO THE ZONING ORDINANCES
OF THE TOWN OF VAIL AND ANY CHANGES IN
USE OR ZONING DISTRICT SHALL TAKE PLACE
ONLY AFTER COMPLIANCE WITH THE PRQVTSIONS
AND TERMS OF THE TITLE 18; AND PROVIDING
DETAILS TN RELATION THERETO
WHEREAS, the Town of Vail has acquired and will acquire
in the future numerous parcels of real property from Vail Assoc-
fates ; -
WHEREAS, Vail Associates has expressed a concern that
the property conveyed to the Town of Vail be used in accordance
with the Zoning Code, and any changes in use or zoning district
shall take place only after compliance with the terms of the
Zoning Ordinance, and in particular, that public hearings and
input will be provided;
WHEREAS, the Town Council believes that the real property
owned and held by the Town of Vail is subject to the ordinances
of the Town and that full public participation should be encour-
aged before the use of public property is changed; and
WHEREAS, the Town Council is of the opinion that Title
18 should be amended by the addition of a provision specifying
its intent to comply with the procedural requirements of Title
18 for the rezoning or changes in use of property awned by the
Town;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VATL, COLORADO., THAT:
Section 1. Title 18 of the Vail Municipal Code is
amended by the addition of a new Section 18.66.180 to read as
follows:
18.66.180 ZONING CHANGES - TOWN OF VATL PROPERTY
(a1 All real property owned by the Tawn of Vail
and acquired by sale/purchase, gift, dedi~
cation or any other means shall be zoned.
or rezoned to a zoning category appropriate
to the use or proposed use thereof.

{b} The zoning classification of any real
property owned by the Town of Vail shall
not be changed without full compliance
with the terms and requirements of this
Title 18.
{c) Property owned by the Town of Vail shall not
be used contrary to the terms of this Title
1$, in particular, the restrictions of the
zoning district in which the property is
located.
Section 2. SEVERABTLTTY. Tf any part of this ordinance
is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this ordinance.
The Town Council hereby declares that it would have passed this
ordinance and each section, subsection, sentence, clause or phrase
hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid.
Section 3. The Tawn Council finds that this ordinance
is necessary for the protection of the public, safety and welfare.
