AN ORD�NANCE ANNEXTNG TO THE TOWN OF VAIL
A PARCEL OF PROPERTY LOCATED IN THE W 1/2
OF SECTTON 12, T5S, R81W OF TH� 5�'H P.M.,
EAGLE COUNTY, COLORADO, PRESENTLY OWNED
BY VAIL CITY CORPORATION, A COLORADO
CORPORAT�ON, AND ELMORE .AND ASSOCIATES,
A DELAWARE CORPORATION; AND SETTING F�RTH
FINDINGS AND CONCLUSIONS AND OTHER DETAILS
_ �N RELATION THERETO
WHEREAS, a petition for annexation to the Town of
Vail of certain parce].s of property located in the W I./2 of
Section 12, TSS, R81W, of the b�h P.M., Eagle County, C��orada,
has been submitted to the Town Cl�rk of the Town of Vail and

aceferred therefrom to the Town Counci�.;
wHEREAS, the owners of 1fl0$ of the property propc►sed
. for annexati�+n, exclusive bf the st�eets and al�.eys, are Vai�
� �City C�arpo�ation, a Colorae�+� corpv��tir�n, and �lmore and
Associates, a Delaware corporation:
WHEREAS, the petition was signed by David G. Elmore,
President, and �obert w.`Glahe, S�cretary and Assistant �ecr�tary
of the �.andawners;
WHEREAS, in accordance with C.R.S. 31-�2-107(i)(g),
the Town Co�ncil may by ordinance annex the a��ove specified pro-
perty without notice, hearing or electa.on �.nasmuch as th� petition
was signed by 100� of t�e �roperty owners; a:�a
WHEREAS, the Town Cauncil is of the opinion that the
petition shou�d be granted and tha� the subject property should
be annexed to the Town of Vail;
NOW, THEREFQRE, BE ZT ORDA�NED BY THE TOWN COUNCIL 4F
Ti�E TOWN QF VAIL, COLORADO, THAT:
Section 1. F"indinqs.
The Town Clerk of the Town of Vail has referred to the
Town Council a petition for annexation of a certain parcel of
praperty (hereinafter referred to as the "subject property" and.
is more specifically described in Exhibit "A" at�ached hereto}

that is iocated on the W 1/2 of Section 12, T5S, R81W of the
fith P.M., Eag1e Cqunty, and �he Town Coe�ncil specitically finds
upon review of said petition:
(A) The petita.on is in substantial compliance wa.th
the requirements of C.R.S. 31-12-1Q7(2), 19'�3, as amend�d.
(B) The petition was signed by the owners of 10�$
of the area,proposed to be annexed, exclusive of streets and
and alleys.
{C3 The subject prdperty is eligible for annexa�i�n
to the Town of Vaii in that at least one-sixth of its boundaries
are contiguous with the Town of Vai1, there is community of
interest between the Town of Vail and the subject propezty, the
subject property wi11 be urbanized in the near futuare, and it
is oapable of being integrated into the Town of Vail.
(D) Th�re are no 3.imitations to the annexation af the
se�bject property to the Town of Vail in �hat nb land he�d in
icientical ownership has been divided without the written consent
af the landawners thereof, na land held in identical ownership
comprising 20 acres or more with an assesseci valuation in exc�ss
qf S2��I,pf10 for ad va�.or�m tax purposes has been included without
the �rra.tt+�n consent of the owner, no cather annexatian procee�dir�gs
hav�e been cornmenced by a�►other municipality with a�elation to the
subject property, and no a�^ea wi13. be det�ched �rom a� schc+ol
district by this annexation.
(E) Ncr �dditional terms or conditi€�ns are to be impased
upan this annexatian.
(F) The subject prvperty may be annex:�d by ardinance
withaut no�k�.ce, hearing or election in �ccordance with subseet�on
(g} o� 3l-12-107.
Sectian 2. Annexation.
That property iocated in the W 1/2 of Section 12, T5S,
R81W, af th� 6th P.M., Eagle County, Colorado, more particularly
described in Exhibit "A" attached hereto is annexed to the Town
of Vail, Colorado.

Section 3. Eftective Date.
The ann�xation and this ordinance shal� take effect
in accordance with th� charter of the Town of Vail and the
Town Clerk is dir�ct�d to fil� fnr r�cording two ce:-�a.fied
copies of this orciinance and a map of the area annexed contain-
ing a legal description of such area with the Eagle County Clerk
and Recorder and one copy thereof with the Division of Local
Government of the Department of Loca� A£fairs.
Section 4. �oning.
The subject property hereby annexed tc the Town oi
Vail shall be referred to the Planning Commission for revfew
and recommendation regarding zoning in accordance with Chapter
18.68 of the Vail Municipal Code.
