Series of 1978 AN ORDINANCE AMENDING CHAPTER 12.04 OF THE VAIL MUNICIPAL CODE, RELATING TO EXCAVATION AND STREET CUT PERMITS; PROVIDING THAT PUBLIC WORKS IS SUBSTITUTED FOR BUILDING OFFICIAL; SPECIFYING DEFINITIONS, FEES AND CHARGES, DEPOSITS WHICH MAY BE REQUIRED, DUTIES AND RESPONSTBTLITIES OF PERMITTEES, TIME FOR PERFORG!IING STREET CUT WORK, PAYMENT OF THE COSTS OF TIIE V'dORK DOiIE BY THE TOWN OF VAIL; SETTING I'ORTH PENALTIES AND SANCTIONS FOR VIOLATIONS OF' I~HE ORDINANCE AND PERMITS; AND, SETTING FORTH DETAILS RELATING THEP.ETO WHEREAS, the existing street cut ordinance of the Town of Vail has been in effect for some period of time; WHEREAS, a number of problem areas have arisen with the ordinance; and WHEREAS, it is the opinion of the Town Council that the public health, safety and welfare would be served by amending the street cut ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. In Chapter 12.04 of the Vail Municipal Cade, the following sections shall be amended by the deletion of the term "Building Official" and the substitution of "Public Works" therefor: 040, 060, 100, 120, 130, 170, 180, 190, 220, 240, 300, 410, and 420. Section 2. The following sections of Chapter 12.04 of the Vail Municipal Code are repealed and reenacted: 010, 020, 030, 050, 070, 080, 110, 140, 200, 210, 230, 240(f), 310, 320, 330, 340, 350, 370, 380, 400, and 430, all to read as follows: 12.04.010 DEFINITIONS The following words, when used in this Chapter, sha11 have the meanings ascribed to them in this section, except in those instances where the context clearly indicates otherwise. A. "Emergency" means any unforeseen circumstance or occurrence, the existence of which constitutes a clear and immediate danger to persons or property. ' y , Ord. Page 2 S. "Public works" shall mean the Public Works Director of the Town of Vail or his designated representative. C. "street" means and includes all public or private street, easements, rights of way, highways, alleys, ways, places, or roads. 12.04.020 PERMIT - REQUIRED It is unlawful for any person to make any tunnel, opening, boring, or excava- tion of any kind in or under the surface of a street without first securing a permit from the Town for each separate undertaking; provided, that any person maintaining pipes, lines or other under- ground facilities in or under the surface of any street, may proceed without a permit when emergency circumstances demand the work be done immediately, and the permit cannot be reasonably and practicably have been obtained beforehand. Such person shall there- after apply for a permit on the first regular business day which the Town offices are open for business. 12.04.030 PERI~IIT - APPLICATION -- NOTICE OF COMMENCEMENT Each application for a permit shall be made twenty-four (24) hours before the work authorized by the permit is to begin. Each permittee shall notify all utilities operating in the Town, the Police Department and the I"ire Department of the nature and location of the work authorized by the permit and the time that the work shall begin, at least 24 hours before the work author- ized by the permit is to begin. Such application and notice shall be made during the normal office hours of the utilities, the Town, and the Fire Depart- ment. 12.04.050 PERMIT - APPLICA'T'ION - FEE REQUIRED Each application for a permit shall be accompanied by a permit fee as determined by Public Works as provided in 12.04.350. The permit fee and all other charges or costs shall be paid at the time the permit is issued unless specifically provided otherwise by Public Works. a f • ord. Page 3 12.04.070 LTTTLITIES EXEMPT Any utility companies providing electric, telephone, gas, water, sewer or cable television service an a regular basis to the residents of the Town are exempted from pasting a deposit an street excava- tion work, provided the utility company files a letter with Public 6~7orks, signed by the appropriate officers of the company, agreeing to reimburse the Town for all costs incurred in repairing street openings made by the utilities, and agreeing to abide by all the terms of this Chapter. Each utility company sha11 submit a list ofc persons authorized to sign permit applications and to keep that list current. 1.2.04.080 PERMIT ~- TOWN NOT A LIABILITY Prior to the issuance of any permit here- under, every applicant shall agree to hold the Town, its officers, employees, and agents harmless from any and all costs, damages and liabilities which may accrue or be claimed to have accrued by reason of any work perfox`med under a permit issued under this Chapter. The acceptance of a permit shall constitute such an agreement by the applicant. 1.2.04.110 FERI`~lTT - NONTRAi'VSFERABLE Permits under this Chapter are not trans- ferable, and the work shall. not be made any place other than the location specifi- cally designated in the permit, or by any person, agent, or independent contractor other than the permittee unless specifically provided in the permit. 12.04.140 SIZE RESTRICTION The opening which may be made in the street at any one time sha11 be no greater than will permit the reasonable use of the street by the public and will not cause substantial hazards in the use of the street by the public. Reasonable and adeguate provisions shall be made .for use of the street by the public, and the use of the street by the public may not be blacked entirely unless prior approval has been granted. by Public Works, the Police Department and the Fire Department. Ord. ~+ ~ ` ~ l Page 4 12.04.200 SAFETY DEVICES Every permittee shall provide adequate barricades and warning lights for each opening in the street during the night. Every permittee shall provide a suitable barricade for the opening in the street at all times. Additional safety regula- tions may be prescribed by Public Works. Whenever any person fails to provide or maintain adequate safety devices, such devices may be installed and maintained by the Town, and the amount of the cost thereof shall be paid by the person obtaining the permit. It shall be unlaw- ful to willfully move, remove, injure, destroy or extinguish any barrier, warn- ing light, sign, or notice erected, placed or posted in accordance with this section. 12.04.210 ACCESS TO DRIVEWAYS AND FIRE HYDRA'VTS Access to private driveways shall be provided, except during working hours when construction operations prohibit provisions of such access. Provided, however, that access to private drive- ways shall be restored promptly and the blocking of private driveways shall be only for such a period of time as is necessary to complete the work immediately in front of the private driveway. Free access must be provided at all times to fire hydrants. 12.04.230 TIME WORFi MAY BE PERFORMED A. Work authorized by a permit shall be performed between the hours of 7:00 A.M. and 7:00 P.M., Monday through Friday, unless the permittee obtains written consent from Public Works to do the work earlier or later than the stated hours or on a weekend. B. No street cut permit authorized under this Chapter shall be issued so as to allow a street opening or pavement cut between November 15 and April 15, except in accordance with the following: (1) Public Works may issue a permit for a street opening or pavement cut between November 15 and Decem- ber 1 if it is determined that special or unforeseen circumstances require the issuance of the permit or if the applicant for the permit is a public utility. If Public Works determines that an extension should be allowed, the applicant may be required to comply with any of the following additional items: r Ord. Page 5 (a} Post an additional sum to pay the costs of cold patch- ing the cut, maintenance of the cut, or possible damage to the public way that may occur over the winter; or, (b} To temporarily cold patch the excavation; or, (c) To do any other reasonable thing that Public Works deter- mines is necessary to protect the public way until the exca- vation is permanently closed. In addition, any applicant requesting an extension shall agree to provide a permanent patch or closure for the street cut the following summer when the ground and weather permit the same. (2) In no event shall a permit be issued after December 1 except in the case of an emergency or upon specific approval by a resolution of the Town Council. 12.04.240 ADDITIONAL REGULATIONS - PUBLIC WORKS AUTHORITY In granting any permit Public Works may attach such other conditions as may reasonably neces- sary to prevent damage to public or private property or to prevent the operation from being conducted in a manner hazardous to life or property or in a manner likely to create a nuisance. Such conditions may include, but shall not be limited to the following: (A. through E. shall remain the same.} F. Minimum depth of any utility or service Line shall be eighteen (18} inches below grade. G. Temporary patches or other measures that may be necessary to protect the public and the public way. H. Deposits or securities that may be neces- sary to insure that the cost of repair or maintenance is paid by the permittee. 12.04.310 ASPHALTIC CONCRETE OR OIL-AND-CHIP SURFACE RESTORATION The cut and restoration of asphaltic concrete or oil-and-chip surface shall be made in the following manner: A. The initial pavement cut shall be made a minimum of one foot wider than the trench an all sides of the trench, a minimum of three feet wide, and the cut and the pav- ing shall be made with a power circular saw or other method as specifically approved in writing by Public G~Torks . The asphaltic concrete or a.il-and-chip sur- face sha11 match the depth, quality, and appearance of the existing surface sur- rounding the excavation, and be sealed with a chemical as approved by Public works. 12.04.320 RESURFACING - WHEN - COST ASSESSMENT If Public Works finds that paving surfaces adjacent to the street opening may be damaged where trenches are made parallel to the street, or where a number of cross trenches are laid in close proximity to one another, where the equipment used may cause such damage, the permittee shall be required to pay the cost of resurfacing. The cost of resurfacing shalh: be charged to the permittee on a time-and-- materials basis. Public Works may require the permittee to deposit with the Town an estimated sum to pay for the cost of resur- facing as required herein prior to the issu- ance of a permit. If a deposit is filed with the Town for the cost of resurfacing, and the cost thereof exceeded the amount of the deposit, the additional cost sha11 be paid by the per- mittee within ten (10} days of being billed therefor by the Town or in any event, prior to the issuance of any additional permits. If the cost of resurfacing was less than the amount of the deposit, the Town shall return to the permittee the remainder of the deposit within ten days of the work being done. If no deposit is made by the permittee, the cost of resurfacing shah. be paid by the permittee within ten days of being billed therefor by the Town or in any event, prior to the issuance of any other permits. 12.04.330 SETTLING If any settlement in a restored area occurs within a period of one year from the date of completion of the permanent restoration, any expense incurred by the Town in correcting the settlement shall be paid by the permittee, unless proof is submitted by the permittee, satisfactory to Public Works, that the settle- ment was not due to defective back filling. Failure to back fi11 properly may be grounds for revocation of the permittee's contractor's license. It shall be the duty of the permittee to submit to the Town sufficient proof as to the date of completion if there is a disagree- ment as to the date of completion for the purposes of this section. 12.04.340 TOWN RESTORATION A. It shall be the responsibility of the permittee to restore and repair street cuts and make back fills on any street cut or excavation. •~ ~ •f ~ Page 7 Ord. B, Upon the request of the permittee and the agreement of the Town, the Town may repair the street cuts and make back fills for the permittee, and permittee shall pay to the Town the cost of restor- ation in an amount computed by Public Works in accordance with the rates set forth in Section 12.04.350. The permittee shall relinquish the right to restore street cuts and make back fills ten days after expiration of the permit or after November 1, if no extension for time has been granted by Public ~Jorks to the per- mittee. 12.04.350 FEES - DESIGNATED Upon receipt of a properly completed applica- tion, Public Works shall determine the amount of the fee which shall be paid by the holder of any permit under this Chapter, which fee shall cover the cost of restoring the street involved in such work. The fees to be charged for permits shall be as follows: A. The basic permit fee shall be $25.00 for administration, inspec-~ion and issuance of the permit. B. Pavement cuts done by Public Works shall be $2.00 per lineal foot per each two inch depth or fraction thereof, with a minimum fee of $25.00. C. For replacement of paving with asphaltic concrete or oil-and-chips surface, the charge will be $2,50 per square foot. D. Back filing and compaction by Public Works shall be charged time-and-material to per- mittee. E. Any rework or additional work agreed upon between the Town and permittee and done by the Town shall be a time-and-material charge. F. Salaries and equipment rates will be charged by the Town to the permittee in accordance with the prevailing schedule on file in the Public Works Department. 12.04.370 FEE - DEFICIENT If any fee or deposit is less than sufficient to pay all casts, the permittee shall, upon demand, no later than ten (10} days after being billed by the Town, or prior to the issuance of any further permits, pay to the Town an amount equal to the deficiency. If the permittee fails or refuses to pay the deficiency, the Town may institute an action to recover the amount in any court of compe- tent jurisdiction, refuse to issue any subse - quent permits, or revoke the permittee's con- tractor's license. Until the defici- ency is paid in full, no additional permits shall be issued to the permittee. The remedies herein are in the alternative and are not exclusive. i i~- Ord. Page 8 12.04.380 MORE THAN FIVE OPENTNGS Whenever any person or company anticipates more than five (5) street openings or excavations per year, the utility or authority may past a single deposit for the entire year or part thereof to cover the cast of any and all such work. The amount of the deposit shall be determined by Public Works. 12.04.400 MAP OF UNDERGROUND FACTLTTTES - REQUIRED Every person owning, using, controlling, or having an interest in pipes, conduits, ducts, or other structures under the surface of any street used for the purpose of supplying or conveying gas, electricity, communication impulses, water, sewer, or steam to or from the Town, or to or from its inhabitants, or for any other purpose, shall file with the Public Works Department within 120 days after the adoption of this ordinance, a map or set of maps, each drawn to a scale of not less than 1 inch to 400 feet, show~.ng the location, size and description of all such installations. The owner agrees, upon reasonable notice from the Town or any permittee, to accurately locate his installations upon the ground as shown on the maps. 12.04.430 VTOLATTON - PENALTY A. Any person violating any of the provisions of this Chapter shall be guilty of a mis- demeanor and, upon conviction thereof, shall be punished for such offense by imprisonment far not more than ninety (90) days or by a fine of not less than $5.00 nor more than $300.00 or by both such fine and imprisonment. Each day the violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as set forth in this section. Both the licensed contractor and the per- son, firm or corporation the work is for, are responsible for the compliance with this Chapter, and any or all of the same may be summonsed into Municipal Court, and any or all may be found guilty of a vio- lation hereof. B. The sanctions, remedies, or penalties available under this Chapter are deemed cumulative and any or all may be pursued by the Town of Vail to enforce the pro- visions of this Chapter. Section 3. The repeal or the repeal. and reenactment of any provision of the Vail Municipal Code as provided in this ordi- Hance shall. not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective elate .• ~_ ard. Page 9 hereof, any prosecution commenced, nor any other action or pr_o- ceedi.ng as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 4. If any part, section, subsection, sentence, .` clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remain- ing portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, sub- section, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 5. The Town Council hereby finds, determines, i and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. INTRODUCED, READ ON FIRST READING, APPROVED, AND ORDERED PUBLISHED ONCE IN FULL, this 21st day of November, 1978, and a public hearing on this ordinance shall be held at the regular meeting of the Town Councill_ of the Town o~ Vail, Colorado, on the 5th day of December, 197$, at 7:30 P.M. in the Munica.pal Building of the Town. / ~ .
