WHEREAS, the Vail Town Council and staff are interested in providing more efficient service to the public in the matter of administering a sign code; j~YHEREAS, the Planning & Environmental Commission has recommended to the Town Council certain amendments to the Vail Pdu~icipal Code to improve the Sign Code and its administration; WHEREAS, the Design Review Board has recommended to the Town Council certain amendments to the Vail ~,Zunicipal Code to improve the Sign Code and its administration; and WHEREAS, the Town Council is of the apinian that these amendments make a positive contribution to serving the public more efficiently; NOSY, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, THAT: Section 1. Chapter 16.1.2 "Administrative Procedure" of the Vail ATunicipal Code is repealed and reenacted to read as follows: Chapter 16.12 ADMINISTRATIVE PROCEDURE 16.12.010 APPLICATION~AND APPROVALS REQUIRED It is unlawful for any person to display any sign I within the Town of Vail without complying with the following requirements: j {A) Completion of the Sign Application; (B) Review by the Sign Administrator: (C) Review and approval of the Design Review Board for signs exceeding f~.~re (5) square feet , sub- division entrance signs, and all sign programs. {D) Approval by the Sign Administrator for signage not specifically required to be reviewed by the the Design Review Board. Repeal and reenact Section 16.12.020 as follows: 16.12.020 APPLICATION PROCEDURES The procedures to be (allowed in fulfilling the intent 1 • '' ~ ~ Ord. Page 2 of the Sign Ordinance are as follows: (A} A sign application must be obtained, properly completed, and returned to the Sign Administrator; (B) The Sign Administrator shall accept and review the properly completed sign application permit. If the administrator determines that the sign application does not meet the technical. require- ments including, but Wert limited to size, height, and number of this title, the administrator may deny the application. Upon denial of an application by the administrator, the applicant may resubmit a modified application, file an application for a variance, or file an appeal to the Design Review Board. The board shall con- sider an appeal. at its next regularly scheduled meeting or as promptly as practicable at a subse- quent regular meeting of which the applicant is given written notice. The board shall render a decision on the appeal within thirty (30} days after the hearing, unless additional time is required for good cause, and serve a copy of its decision on the applicant by mail to the applicant's last known address; (C) After having determined that the sign meets the general requirements of this Title, the Sign Administrator may approve signs not exceeding five {5) . square feet or .si,gr~s conforming to the requirements of a prior approved sign program; the Sign Administrator shall notify the Design Review Board of all administrative decisions at its next regularly scheduled meeting; the Design Review Board may require that any decision of the Sign Administrator be reviewed by it at its next regularly scheduled meeting; {D) Applications for signs in excess of five {5) square feet, subdivision entrance signs, or sign programs, shall be reviewed by the Design Review Board at its next regularly scheduled meeting in the presence of the applicant or his representative following a determination by the Sign Administratar that the application has been properly completed; (F) The Design Review Board will approve, condita.onally approve or reject the sign application permit based upon its conformance with the Title and its aesthetic value; (F} Upon the approval by the Design Review Board, the sign application permit will be returned to the administrator and the applicant will be duly notified of the Design Review Board's decision; (G) Upon rejection of the sign. application permit by the Design Review Board, notification will be given•in writing to the applicant specifying the reason for disapproval. and making recommendations to bring the sign into conformance with the provisions of this Title; {H) In the event an applicant's sign permit is rejected, he has the option to appeal to the Town Council following the procedure outlined in the zoning Title. In the event of an appeal, the Design Review Berard and the Sign Administratar shall make reconunendations to the Town Council. . ~ • ~! {,~ Ord. No. Page 3 16.12.030 PERP~~IT FEES At the time the administrator accepts the sign application, the applicant shall pay a fee of twenty {$20) dollars per sign, or sign program. The number of signs for a single structure included in the application is not restricted, provided they conform to the provisions of this Title . Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares that it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase hereof regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phxases be declared invalid. Section 3. The repeal or the repeal and reenactment of any provision of Title 16 of the Vail A~unicipal Code by this ordinance sha11 not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, or any other section or proceeding as commenced under or by virtue of the provisions repealed or repealed and reenacted. It is the express intention of the Town Council that all matters presently before the Sign Review Board shall not be interrupted and shall proceed as scheduled or directed. Any duty, condition, or requirement imposed by the Sign Review Board or the Town Council prior to the effective date of this ordinance shall not be set aside, abrogated, or in any way invalidated by the adoption of this ordinance. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 4. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof . ~~ +~ Oxd.
