Nov 6, 1979 Recorder: Johnnette Phillips, Eagle County ORDINANCE NO. 27 Series of 1979 AN ORDINANCE ANNEXING TO THE TOWN OF VAIL A PARCEL OF PROPERTY LOCATED IN THE NW4 OF THE NW4 OF SECTION 10, T5S, R80W OF THE 6th P.M., EAGLE COUNTY, COLORADO, PRESENTLY OWNED BY THE TOWN OF VAIL A COLORADO MUNICIPALITY; AND SETTING FORTH FINDINGS AND CONCLUSIONS AND OTHER DETAILS IN RELATION THERETO WHEREAS, a petition for annexation to the Town of Vail a certain parcel of property located in the NW4 of the NW4 of Section 10, T5S, R80W of the 6th P.M., Eagle County, Colorado has been submitted to the Town Clerk of the Town of Vail and referred therefrom to the Town Council; WHEREAS, the owner of 100 of the property proposed for annexation, exclusive of the streets and alleys, is the Town of Vail, a Colorado municipality; WHEREAS, the petition was signed by Richard Caplan, Town Manager WHEREAS, in accordance with C.R.S. 31-12-107(1)(g), the Town Council may by ordinance annex the above specified property without notice, hearing or election inasmuch as the petition was signed by 100 of the property owner; and WHEREAS, the Town Council is of the opinion that the petition should be granted and that the subject property should be annexed to the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF, VAIL, COLORADO, THAT: Section 1. Findings. The Town Clerk of the Town of Vail has referred to the Town Council a petition for annexation of a certain parcel of property (hereinafter referred to as the "subject Property" and is more specifically described in Exhibit "A" attached hereto) Ordinance No. 27 •• i• Page 2 that is located on the NWT of the NWT of Section 10, T5S, RSOW of the 6th P.M., Eagle County, and the Town Council specifically finds upon review of said petitioi~~: (A) The petition is in substantial compliance with the requirements of C.R.S. 31-12-107 (1), 1973, as amended. (B) The petition was signed by the owner of 1000 of the area proposed to be annexed, exclusive of streets and alleys. (C) The subject property is eligible for annexation to the Town of Vail in that at least one-sixth of its boundaries are contiguous with the Town of Vail, there is community of interest between the Town of Vail and the subject property, the subject property will be urbanized in the near future, and it is capable of being intergrated into the Town of Vail. (D) There are no limitations to the annexation of the subject property to the Town of Vail in that no land held in identical ownership has been divided without the written consent of the landower thereof, no land held in identical ownership comprising 20 acres or more with an assessed valuation in excess of $200,000 for ad valorem tax purposes has been in- cluded without the written consent of the owner, no other annexation proceedings have been commenced by another municipality with relation to the subject property, and no area will be detached from a school district by this annexation. (E) No additional terms or conditions are to be imposed upon this annexation. (F) The subject property may be annexed by ordinance without notice, hearing or election in accordance with sub- section (g) of 31-12-107. •• •• • • Ordinance No. 27 Section 2. Annexation. Page 3 The property located in the NW; of the NWT of Section 10, T5S, R80W of the 6th P.M., Eagle County, Colorado, more particularly described in Exhibit "A" attached hereto is annexed to the Town of Vail, Colorado. Section 3. Effective Date. The annexation and this ordinance shall take effect in accordance with the charter of the Town of Vail and the Town Clerk is directed to file for regroding two certified copies of this ordinance and a map of the area annexed containing a legal description of such area with the Eagle County Clerk and Recorder and one copy thereof with the Division of Local Government of the Department of Local Affairs. Section 4. Zoning. The subject property hereby annexed to the Town of Vail shall be referred to the Planning and Environmental Commission for review and recommendation regarding zoning in accordance with Chapter 18.68 of the Vail Municipal Code. INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PUBLISHED ONCE IN FULL, this 17th day of July, 1979, and a public hearing on this ordinance shall be held at the regular meeting of the Town Coucnil of the Town of Vail, Colorado, on the _ day of G~ 1979, at 7:30 P.M., in the Municipal Building of e Town. _~ Mayor / " ATTEST: „.. Mayor l ' ATTEST: Town Clerk ~` r` ' a ~ • J EXHIBIT A A part of the NW4, NW4, Section 10, Township 5 South, Range 80 West of the 6th Principal Meridian, Eagle County, Colorado, said part of the NW4, NWT, Section 10, being more particularly described as follows: Beginning at a point on the west line of said NW4j NW4, Section 10, whence the NW Corner of said Section 10, bears N 0~ 02' 30" W 856.36 feet distant; thence the following six courses along the existing Town of Vail boundary: (1) N 89° 57' 30" E 310.00 feet; (2) N 00° 02' 30" W 211.36 feet; (3) N 38° 52' 51" E 600.00 feet; (4) N 65° 32' 51" E 140.00 feet; (5) S 82° 07' 09" E 340.00 feet; (6) N 78° 22' 31" E 161.38 feet, to a point on the east line of the said NWT, NW4, Section 10, thence S 00° 02' 15" E 1200.00 feet, along the east line of said NtN~, NWT, Section 10, to the southeast corner of the said NW4, 1VW4i Section 10, thence N 89° 23' 38" W 1309.30 feet, along the south line of said NWT, NW4j Section 10, to the southwest corner of said NW4j NWT, Section 10; thence N 00° 02' 30" W 463.64 feet, along the west line of said NW4, 1VW4, Section 10, said line also being the existing Town of Vail boundary, to the point of beginning, containing 1,225,964 square feet or 28.1443 acres, more or less.
