AN ORDINANCE ZONING A RECENTLY ANNEXED PARCEL OF
PROPERTY LOCATED IN THE VA IL VALLEY FOURTH FILING
AS TWO FAMILY PRIMARY/SECONDARY AND PUBLIC USE
DISTRICT.
WHEREAS, in accordance with Chapter 18.68 of the Vail Municipal
Code, the Zoning of a recently annexed parcel of property has been requested
by the Town of Vail, owner thereof; and
WHEREAS, the Planning and Environmental Commission of the Town
of Vail has considered the same and recommended approval of Zoning a portion
of the property Two Family Primary/Secondary and the remainder as Public
Use District; and
WHEREAS, the Town Council considers that it is in the public
interest to so zone said property;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF VAIL THAT:
(1) The Council specifically finds that the procedures for
the amendment of the Official Zoning Map and zoning of recently annexed to
the Town of Vail as prescribed in Chapter 18.68 of the Vail Municipal Code
have been fulfilled, and the Council hereby receives the report and recommendation
of the Planning and Environmental Commission recommending the approval of the
zoning of the subject property.
(2) Pursuant to Chapter 18.68 of the Vail Municipal Code, the
following described parcel is zoned as follows:
(a) A portion of the property consisting of 17,200 square feet-
Two Family Primary/Secondary with the total Gross Residential
Floor Area (GRFA) on the lot not to exceed 3,950 square feet.
(b) Remainder of the property-Public Use District
(3) As provided in Section 18.08.030 of the Vail Municipal Code,
the Zoning Administrator is hereby directed to promptly modify and amend
the Official Zoning Map to indicate the zoning specified in paragraph (2)
above.
(4) If any part, section, subsection, clause or phrase of this
ordinance is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portion of this ordinance; and the
Town Council hereby declares that it would have passed this ordinance, and

each part, section, subsection, sentence, clause or phrase hereof
regardless of the fact that any one or more parts, sections, subsections,
sentences, clauses or phrases be declared invalid.
(5) The Town Council hereby finds that this ordinance is
necessary for the protection of the public health, safety and welfare.
INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PUBLISHED
