HomeMy WebLinkAbout1980-10 Adopting the Uniform Fire Code, 1979 Edition by Reference` ~ ~ ~ • • ORDINANCE N0. 10 Series of 1980 AN AMENDMENT ADOPTING THE UNIFORM FIRE CODE, 1979 EDITION BY REFERENCE; SETTING FORTH AMENDMENTS THERETO; PROVIDING THAT SAID CODE BE AVAIL- ABLE FOR INSPECTION AT THE OFFICE OF THE TOWN CLERK, TOWN OF VAIL; DE- SIGNATING A PUBLIC HEARING THEREON; AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. WHEREAS, the Charter of the Town of Vail, and the Statutes of the State of Colorado provide that standard codes maybe adopted by reference with amendments; WHEREAS, the Town of Vail adopted the 1976 Edition of the Uniform Fire Cade by reference, with amendments; WHEREAS, the I.976 Edition of the Uniform fire Code has been revised and the 1979 Edition issued; WHEREAS, it is the opinion of the Town Council of the Town of Vail that the public health, safety and welfare would be sexved by adopting the 1.979 Edition of the Uniform Fire Code by reference, with amendments; WHEREAS, the Town of Vail adopted the 1979 Edition of the Uniform Building Code, Uniform Plumbing Code and Uniform Mechanical Code by reference, with amendments; NOW, THEREFORE, BE IT ORDAINED, THAT THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. The 1979 Edition of the Uniform Fire Code is hereby adopted by reference, with amendments. The Uniform Fire Code, 1979 Edition, is published by the International Conference Hof Building Officials, 5360 South Workman 1~Iill Road, Whittier, California, 90601. Section 2. The following amendments are made to the 1979 Edition of the Uniform Fire Code: A. Section 2.204 is amended to include the following subparagraphs: (d) The Chief or his duly authorized representative upon ascertaining a building or the appliances and systems • • • Ordir,/'~~ce No. 10 ~-- Page 2 installed therein to be unsafe so as to create an immediate hazard to life and safety of persons or property, shall serve upon the owner or person having control of the property or premises, a written notice, stating forthwith, the hazard and its cause, and giving a tinge and date by which the hazard must be eliminated, and warning that failure to comply with said notice shall result in an Order of Closing being served, at which time the building shall be closed and shall remain closed until the hazard has been eliminated and written permission from the Chief or his duly authorized representative shall be required before the building can be re-opened. (e) An order that a building or its premises has been closed shall be served by the Chief or his duly authorized rep- resentative upon the owner or the person having control of the property or premises, and said order shall state the hazard and its cause which necessitates said closing, indicating that the written notice provided in subparagraph (d) of this section was not complied with, and that the area closed shall remain closed until so ordered by the Chief or his duly authorized repre- sentative in writting. {f) A closed building shall. not be occupied by any person except personnel required to eliminate the hazard indicated in the Order of Closing. (g) The Chief or his duly authorized representative may, at his discretion, issue an oral order to correct hazards referred to in this section, in the event that said hazard can be corrected in 48 hours, from the time of issuance of the order, to the owner or person having control of the property or premises; provided, however, that issuance of an oral order shall not abrogate the necessity for the issuance of a written order. B. Section 2.303(b) shall be amended to include all of the National Fire Protection Association Standards published in the • • • Ordinee No. 10 ~~ Section 1979 Edition of the National Fire Codes as published by the National Fire Protection Association, 470 Atlantic Avenue, Boston, MA. 02201 C. Section 3.101 shall be amended to read: Any person operating ar maintaining any occupancy, premises, vehicle, property or building subject to this Code who shall fail to take immediate action to abate a hazard to life or property, or who shall permit a hazard to exist on the property under his control, when so ordered by the Chief of his duly authorized representative, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine or not more than $00,00 or by imprisonment not to exceed 90 days or both fine and imprisonment. Each and every day a violation exist shall constitute a separate offense. Each and every violation of this Code shall const~.tute a separate offense. D. Section 4.101 All categories are to remain as is except the following categories are amended to read: Compressed Gases, Flammable. To store, handle or use at normal temperature and pressures, more than 50 cubic feet of flammable compressed gas, mare than 50 pounds of flammable compressed gas, ar more than 250 cubic feet of nonflammable compressed gas, or more than 100 pounds of nonflammable compressed gas. Flammable or Combustible Liquid Pipeline Operation. To install, use or construct a pipeline for the transportation of flammable or combustible liquids within a building. Such pipeline systems shall be approved by the Fire Prevention Bureau and shall be in compliance with all applicable codes and standards. Plans of the system sha11 be submitted for approval prior to construction. • • Ordzn~ ;e No. 1.0 Page 4 ~ `~ Portable or Temporary Iieating Devices Using Liquid or Gas Fuels. To use, rent, lease, or hire any portable or temporary heating device which employees liquid or gas fuel, whether in conjunction with electric power or generator, or not. Roofing Operations. To use, transport, or employ the usage of a tar kettle ar heating container, or hat tar pump which is used for roofing operations. Hazard Chemicals. To store, use, handle ar transport more than 5 gallons of corrosive liquid, more than 25 pounds of oxidizing material, more than 10 pounds of organic peroxide, more than 1000 pounds of ammonia nitrate, ammonia nitrate fertilizer mixtures, or amy~c amount of highly toxic or dangerous material. E. Section 4.106 shall be amended to read; Whenever, under this Cade, more than one category re- quiring a Permit is for the same location, a separate Permit shall be required for each category. F. Section 9.1.04 Definitions and Abbreviations; Bulk Oxygen Systems shall be amended to read; is an assembly of equipment, such as oxygen storage containers, pressure regulators, safety devices, vaporizers, manifolds and interconnecting piping, Which has a storage capacity, at normal temperature and pressures of (1) More than 120 cubic feet of oxygen connected in service or ready for service {2) More than 250 cubic feet of oxygen, including unconnected reserve on hand at the site. The Bulk Oxygen System terminates at the point the oxygen enters the supply line at service pressure. The oxygen may be stared either as a liquid or a gas, and either in portable or fixed containers. Ordi.~ ice Na. l0 • • _'~~ Page 5 ~r- G. Section 10.307 shall be amended to .include: (e) All plans for fire alarm systems shall be submitted to the Fire Prevention Bureau for approval. EXCEPTION: Plans need not be submitted for type R~-3 Occupancy is less than 3 separate occupancies are concerned. (f) When, in the opinion of the Chief, the public or the occupants of the building would be better served, or due to circumstances, nature of construction, location, or proximity of hazards or other conditions, the fire alarm system shall be tied into the Central Recieving Station, as designated by the fire department. Said connection to the Central Recieving Station shall be done at the expense of the owner of the property and shall be maintained at all times. H. Section 11.117 shall be added to read: Storage of flammable or combustible material is not permitted in any bailer room, electrical room, valve room, or elevator mechanical room. A minimum of 4$ inches shall be maintained if front of all equipment in the above mentioned areas to allow access to said equipment. If noncombustible materials are judged to be a hazard in any of the above mentioned rooms, the Chie:~ or his designated representative may order such materials to be removed from the area. I. Section 11.301 shall be amended to include: (c) Failure to report a fire to the lire department shall constitute a misdemeanor. J. Section 11.415 shall. be amended to read: When exposed to probable damage ~ to proximity to alleys, driveways or parking areas, or when exposed to weather or danger from snow or ice, above ground gas meters, electrical meters, and water meters and valves shall be suitably protected. K. Section 12.113 (b) 2 shall be amended to read: All other occupancies serving an occupant load of more than 50 persons. EXCEPTION: Main exterior exit doors which obviously and clearly are identifiable as ~~~~~s need not be signed when approved by the building official and the Chief . • • Ordi~ ce No. 10 Page 6 (c) illumination of Signs. Exit signs serving occupancies with moxe than 100 persons shall be lighted and maintained with a minimum of two electric light bulbs of at least 15 watts each, in the following manner: {l) Group A, Division 1, 2, 2.1 Occupancies with occupant loads of more than 50 persons anal Group I Occupancies with occupant Loads of more than 50 persons shall have two separate sources of power. (2) Group A, Division 1, 2, 2.1, 3, 4, Group E and Group B occupancies with occupant Loads of more than 3.00 persons; and Group H, Group R, Division 1, occupancies with occupant ~.oads of more than 50 persons; and Group T occupancies with occupant loads of moxe than 100 persons shall have two independent circuits, separate from each other with which to power the required exit signs. L. Section ?9.103 shall be amended to include: (5) It shall be unlawful to store more than 1 gallon of flammable or combustible liquid in other than an approved metal container. M, Appendix; This Code shall adopt by reference the Appendix of the Uniform Fire Code, 1979 Edition, ,including Appendix Sections A,B, C, D, E, F, G, H, and I. Section 3. Three copies of the 1979 Edition of the Uniform Fire Code and the amendments proposed by this Ordinance sha11 be available for ,inspection at the Office of the Town Clerk of the Town of Vail, Colorado. Section ~k. Upon the adoption of this ordinance, Chapter ].5.12 of the Vail Municipal Code shall be repealed. Section 5. if any part, section, subsection, sentence, clause or phrase of this ordinance or of the Uniform Fire Code, 19?9, Edition, is far any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ~ i • Ordi ce No. 10 ~~ Page 7 Ordinance or of the Uniform Fire Code, 1979 Edition, and the Town Council hereby declares it would have adopted this Ordinance and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 6. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this Ordinance shall not affect any right which has accured, any duty imposed, any violation that occured prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenancted. The repeal of any provision hereby shall not revive any provision or other ordinance previously repealed or superseded unless expressly stated herein. Section 7. There shall be a public hearing for the consider- ation of the adoption of the 1979 Edition of the Uniform Fire Code by reference, on the 18 day of March, 1980, at 7:30 P.M, in the Town Council Chambers, Municipal Building, Vail, Colorado. The Town Clerk shall havo notice of that public hearing published in the Vail Trail on two occasions, the first not less than fifteen (15) days prior to the public hearing and the second notice not less than eight (8) days prior to the public hearing. Section $. The Town Council hereby finds, determines, and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
