HomeMy WebLinkAbout1980-21 Amending Title 18 of The Vail Municipal Code Relative to Zoning; Providing for Procedures and Regulations to Maintain the Unique Character of the Vail Village Commercial Core I Area~ _/ ~ ~ ~ ORDINANCE NO. 21 Series of 1980 AN ORDINANCE AMENDING TITLE 1$ OF THE VAIL MUNICIPAL CODE RELATIVE TO ZONING; PROVIDING FOR PROCEDURES AND REGULATIONS TO MAINTAIN THE UNIQUE CHARACTER OF THE VAIL, VILLAGE COMMERCIAL CORE I AREA AND TO ENSURE THE MAINTENANCE AND PRESERVATION OF BUILDINGS FRONTING ON PEDESTRIAN WAYS AND PUBLIC GREENWAYS, AND TO ENSURE CONTINUATION OF BUILDING SCALE AND ARCHITECTURAL QUALITIES THAT DISTINGUISH THE VILLAGE; AND PROVIDING PROCEDURES AND REGULATIONS TO ENSURE A MIXTURE OF MULTIPLE DWELLINGS, LODGES AND COMMERCIAL ESTABLISHMENTS IN A CLUSTERED, UNIFIED DEVELOPMENT IN THE LIONSHEAD COMMERCIAL CORE II AREA AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. WHEREAS, the Zoning Ordinance for the Town of Vail needs to be amended to provide for the preservation of the unique character of the Vaal Village Commercial Core I area and further to provide for Land development and use for the Lionshead Commercial Core II area; and WHEREAS, the Planning and Environmental Commission has considered and studied the amendments proposed and the recommendations of the staff of the Town of Vail have recommended the same to the Town Council; and WHEREAS, the Town Council is of the opinion that said amendments are necessary far the protection of the public health, safety and welfare; NOiV, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado that: SECTION I Sections 18.24.010, 18.24.065, 18.24.100, 18.24.120, 18.24.130, ].8.24.150 and 1.8.24.170 are repealed and reenacted and new Sections 18.24.200 and ],8.24.220 are added to read as follows: 18.24.010 Purpose The Commercial Core I District is intended to provide sites and to maintain the unique character of the Vail Village Commercial Area, with its mixture oI' lodges and commercial establishments in a predominately pedestrian environment. The Commercial Core I District is intended to ensure adequate light, air, open space and other 2menities appropriate to the permitted types of buildings and uses. Page 2 accordance with the Vail Village Urban Design Guide Plan and Design Considerations prescribe sate development standards that are intended to ensure the maintenance an;d preservation of the tightly clustered arrangements of buildings fronting on pedestrian ways and pu blac greenways and to ensure continuation of building scale and architectural rualities that distinguish the Village. 18.24.065 Exterior Alterations or Modaficataons~-Procedure All alterations of the exterior of an existing building in CCI shall comply with the following procedure: A. The alteration of an existing building which adds or removes any enclosed floor area or outdoor patio or the replacement of an existing building shall be subject to review by the Planning and Environmental Commission as follows: 1) Application shall be made by the owner of the building or agent on a form provided by the Zoning Administrator; 2) The Public Hearing before the Planning and Environmental Commission shall be held in accordance with Sections 18.66.060 through 18.66.090. A decision of the Planning and Environmental Commission may be appealed to the Town Council an accordance with the procedure specified in Section 18.60.070; 3) It shall be the burden of the applicant under this Subsection A to prove by a preponderance of the evidence before the Planning and Environmental Commission that the proposed building alteration is in compliance with the purposes of the CCl District as specified in 18.24.010; and that the proposal substantially complies with the Vail. Village Urban Design Guide Plan and Design Considerations or that the proposal does not otherwise alter the character of the neighborhood. 4) The Planning and Environmental Commission :nay approve the application as submitted; approve the application with conditions or modifications; or, if the Planning and Environ- mental Commission finds that the applicant failed to meet his burden of proof, it may deny the application. ~~ ~~ .~ Ordinance No.~w~ Page 3 5) Applications for this Subsection "A" shall be submitted semi-annually on or before the fourth Monday of May and November. The Planning and Environmental Commission shall then hold a preliminary review session within 21 days of the above submittal date. A Public Bearing shall then be held within 60 days of the preliminary review session. 1'or projects which are deemed by the Commission to constitute a major amendment to the approved Vail Village Urban Design Guide Plan or other- wise constitute a significant impact on the Town, a 90-day study period may be requested by the Planning and Environmental Commission, prior to a final disposition of such projects. B. The modification ar change to the exterior facade of a building or to a site within CCI shall be reviewed by the Design Review Board in accordance with the following: ~.} Application shall be made by the owner of the building or his agent on a form by the Zoning Administrator. 2} The hearing before the Design Review Board shall be held in accordance with Chapter 18.54. A decision of the Design Review Board may be appealed to the Town Council in accordance with the procedure specified in Chapter 18.54. 8} 7t shall be the burden of the applicant to prove by a predonderance of the evidence before the Design Review Board that the proposed building modification is in compliance with the purposes of the CCI District as specified in 18.24.010; that the proposal substantially complies with the Vail. Village Design Considerations, or that the proposal does not otherwise alter the character of the neighborhood. 4) The Design Review Board may approve the application as submitted; approve the application with conditions or modifications; or, if the Design Review Board finds that the applicant Mailed to meet his burden of proof, it may deny the application. 5} The Zoning Administrator may approve minor modifications as provided in Section 18.54.060. All alterations under Subsection "A" above shall be subject to review by the Design Review Board Environmental Commission approval in The Design Review Board shall review same comply with the Vail Village 18,24.100 Setbacks There shall be no required setbacks, following Planning and accordance with Chapter 18.54. the same to insure that the Design Consideratiar~s. except as may be established pursuant to the Vail Village Design Guide Plan and Design Considerations. 1$.24.120 Height The maximum height of buildings in the CCI District sha11 be thirty- five feet as may be otherwise specified by the Vail Village Urban Design Guide Plan and Design Considerations. 18.24.130 Density Control Unless otherwise provided in the Vail Village Urban Design Guide Plan, not more than eighty (80) square feet of gross residential floor area (GRFA) shall be permitted for each one hundred (100) square feet of buildable site area. Total density sha11 not exceed twenty-five (25) dwelling units per acre of buildable site area. 18..24.150 Coverage Not more than eighty {80) percent of the total site area shall be covered by building and ground level patios and decks unless otherwise specified in the Vail Village Urban Design Guide Plan and Design Considerations. 18.24.1'70 Landscaping and Site Development No reduction in landscape area shall be permitted without sufficient cause shown by the applicant, or as specified in the Vail Village Design Considerations. 18.24.200 Reconstruction of Existing Usos Any building or structure located within Commercial Core I may be reconstructed to the same or substantially the same enclased floor area in accordance with the procedures outlined in Section 18.64.090. The building, however, shall substantially comply with the applicable provisions of the Vail Village Urban Design Guide Plan and Design Considerations. Ordinance No. 21 Page 5 18.24.220 Adoption of Vail Village Urban Design Guide Plan and Design Considerations. A. The Vail Village Urban Design Guide Plan and Design Considerations are hereby adopted for the purposes of maintaining and preserving the character and vitality of the Vail Village (CCI) and to guide the future alteration, change and improvement in CCI. Copies of the Vail Village Design Guide Plan and Design Considerations shall be on file in the Community Development Department of the Town. B. Revisions to the Vail Village Urban Design Guide Plan and Design Considerations shall be reviewed by the Planning and Environmental Commissin with official action to be taken by the Town Council by Resolution on a semi-annual basis to ensure that the plan reflects the purposes and intent for which it has been adopted. The Review and Action shall take place within 30 days following the Public Hearing on the applications. SECTION Il Sections 18.26.010, 18.26.070, 18.26.090, 15.26.100, 18.26.120, and 18.26.140 are repealed and reenacted and new Sections 15.26.045 and 18.26.180 are added to read as fallaws: 1$.26.010 Purpose The Commercial Core IT District is intended to provide sites for a mixture of multiple dwellings, lodges and commercial establishments in a clustered, unified development. Commercial Core SI District in accordance with the Vail Lionshead Urban Design Guide Plan and Design Considerations are intended to ensure adequate light, air open space and other amenities appropriate to the permitted types of building and uses and to maintain the desirable qualities of the district by establishing appropriate site development standards. 18.26.070 Setbacks In CCII D~.strict the minimum front setback shall be ten (10) feet; the minimum side setback shall be ten (10) feet; and the minimum rear setback shall be ten {IO) feet unless otherwise specified in the Vail ~t •. Page 6 1$.26.090 Height The maximum height of buildings in the CCIT District shall be forty-five (45) feet unless otherwise specified in the Vail Lionshead Urban Design Guide Plan and Design Considerations. 1$:26.100 Density Control Unless otherwise specified in the Vail Lionshead Urban Design Guide Plan, not more than eighty (50) square feet of gross residential floor area {GR1'A) shall be permitted for each one hundred square feet of buildable site area. Total density shall not exceed twenty-five (25) dwelling units per acre of buildable site area. 1$.26.120 Coverage Not more than seventy (70} percent of the total site area shall be covered by buildings unless otherwise specified in the Vail Lionshead Urban Design Guide Plan and Design Considerations. 18.26.140 Landscaping and Site Development At least twenty (20} percent of -the total site area shall be landscaped unless otherwise specified in the Vail Lionshead Urban Design Guide Plan and Design Considerations. 15..26.045 Exterior Alterations or Modifications-Procedure All alterations of the exterior of an existing building in CCII sha11 comply with the following procedure: A. A decision of the Planning and Environmental Commission may be appealed to the Town Council in accordance with the procedure specified in Section 18.60.070. 1 ..; ~ .~~ Ordinance No. ~- Page 7 3) It shall be the burden of the applicant under Subsection "A" to prove by a preponderance of the evidence before the Planning and Environmental Commission that the proposed building alteration is in compliance with the purposes of the CCII Distr~.et as specified in 18.26.010; and that the proposal complies with the Va~.l Lionshead Urban Design Guide Plan and Design Considerations or that the proposal. does not otherwise alter the character of the noighborhood. 4) The Planning and Environmental Commission may approve the application as submitted, approve the application with conditions or modifications; or, if the Planning and Environmental Commission finds that the applicant tailed to meet his burden or proof, it may deny the application. 5) Applications for this Subsection "A" shall be submitted semi-annually on or before the fourth Monday of May and November. A decision of the Zoning Administrator may be appealed to the Design Review Board far review. C. A1]. alterations under Subsection "A" above sha11 be subject to review by the Design Reviow Board following Planning and Environmental Commission's approval in accordance with Chapter 1$.54. The Design Review Board shall review the same to ensure that the same complies with the Vail Lionshead Urban Design Considerations. 18.26.180 Adoption of the Lionshead Urban Design Guide Plan and Design Considerations A. The Vail Lionshead Urban Design Guide Plan and Design Considerations are hereby adopted for the purpose of maintaining and presenting the character and vitality of Vail Lionshead (CCII) and to guide the future alterations, change and improvement in the CCI1 District. Copies of the Vail Lionshead Urban Design Guide Plan and Design Considerations shall be on file in the Community Development Department of the Town. B. Revisions to the Vail Lionshead Urban Design Guide Plan and Design Considerations sha11 be reviewed by the Planning and Environmental Commission with official action to be taken by the Town Council by Resolution on a semi-ammual basis to ensure that the plan reflects the purposes and intent for which it has been Ordinance No. 21 Page 9 adopted. The Review and Action shall take place within 30 days fallowing the Public Hearing on the applications. SECTION III The effective date of the time frames referred to in Section 18.24.065 A(5) and Section 18.26.045 A(5) shall be August 1, 1980. All applications received prior to the date shall be reviewed according to the normal review procedures outlined in Chapter 18.66. SECTION IV If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this Ordinance; and the Tawn Council hereby declares it would have passed this Ordinance and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid. SECTION V The Town Council hereby finds, determined and declares that this ordinance is necessary and proper for the health, safety and welfare of the Tawn of Vail and the inhabitants thereof. SECTION VI The repeal or the repeal-and reenactment of any provision of the Vail Municiapl Code as provided in this ordinance shall not ai'fect any right which has accured, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of an,y provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
