HomeMy WebLinkAbout1980-34 Making Certain Corrections to Numbering and Wording Inaccuracies in Chapter 15.24 of the Vail Municipal Code, Relating to the Uniform Mechanical Codej ~ ~ F 'S r ORDINANCE NO ~4 Series of 1980 AN ORDINANCE MAKING CERTAIN' CORRECTIONS TO NUMBERING AND WORDING INACCURACIES IN CHAPTER 15.24 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL, RELATING TO THE UNIFORM MECHANICAL CODE; CHAPTER 15.20 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL RELATING TO THE UNIFORM PLUMBING CODE; ORllINANCE NUMBER 2 (SERIES OF 1980) RELATING TO THE IyIUNICIPAL COURT OF THE TOWN OF VAIL; AND CHAPTER 1.01 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL RELATING TO THE ADOPTION OF SECONDARY CODES BY REFERENCE; AND SETTING FORTH IDETAILS RELATING THERETO. WHEREAS,the Town is inthe process of adopting a supplement to the Vail Municipal Code; and WHEREAS, the review of the existing Ordinances indicate certain numbering and typographical errors that need to be corrected before the Supplement is complete. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF 'SHE TOWN OF VAIL, COLORADO, THAT; Section 1. Section 15.24.010 adopted is repealed and reenacted as follows: 15.24.01.0 adapted. The Uniform Mechanical Code, 1979 edition, published by the International Association of Plumbing and Mechanical Officials, 5032 Alhambra Avenue, Los Angeles, California 90032 and International Conference of Building Officials in adopted. Section 2. ` Section 15.20.010 adapted is hereby repealed and reenacted as follows: 15.20.010 adopted. The Uniform Plumbing Code, 1979 edition, published ~. ` fit. .~ by the International Association of Plumbing and Mechanical Officials, 5032 Alhambra, Los Angeles, California 90032 and International Conference of Building Officials is adopted. Section 3. Ordinance Nn. 'l (1y80) Section 1 is hereby repealed and reenacted as follows: Section 1..01.100 is hereby repealed and reenacted to read as foI'_aws ~C ~i Page 2 Section 1.01.100 Violations and Punishment It is unlawful far any person to violate any provision • or fail to comply with any of the requirements of this Code. Unless otherwise specifically provided, any person eighteen (18) years of age or older violating any provision of this Code by performing an act prohibited or declared to be unlawful by this Code or by failing to perform an act required by or otherwise made mandatory by this Code shall be punished by a fine of not more than three hundred dollars ($300.00) or by by incarceration not to exceed ninety {90) days or by both such fine and incarceration. Any person under age eighteen (18) years of age convicted of violating any provision of this Code, except the provisions of the Model Traffic Code as adopted by Section 10.04.010 herein, may be punished by a fine of not more than three hundred dollars ($300.00}, Any person under the age of eighteen (18) years of age convicted of violating any provision of the Model Traffic Code adopted by Section 10.04.010 herein, may be punished by a fine of not more than three hundred dollars ($300.00} or by incarceration not to exceed ninety {90) days ar by both such fine and incarceration. Any such person shall be guilty of a separate offense for each and every day during any portion of which a violation of any provision of this code is committed, continued, or permitted by such person and shall be punished accordingly. In addition to penalties provided in this Section, any condition caused or permitted to exist in violation of any provisions of this Code shall be deemed a public nuisance, and may be by this Town similarly abated as such, and each day that such condition continues sha11 be regarded as a new and separate offense. ~( ~! ~r Page 3 Section 4. Section 1.01,020 6econdary Codes adopted by Reference is hereby repealed. Section 5. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for reason held to be invalid such decision shall not affect the validity of the remaining portions of this Ordinance; and Town Council hereby declares that it will pass this Ordinance, and each part, section, subsection, sentence, clause or phrase hereof regardless of the fact that any one or mote parts, sections, subsecta.ons, sentences, clauses or phrases be declared invalid. Section 6. The repeal or the repeal and reenactment of any provision of the Vail Municipal Cade by this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, ox any other section or proceedings as commenced under or by virtue of the provisions repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 7. The Town Council hereby finds, determines, and declares that this Ordinance is necessary and proper far the health, safety, and welfare of the Town of Vail and the inhabitants thereof.
