ORDINANCE X20 f~`''~~'~'` `~ ~''" ''(F''`J' (Series of 1981.) ~%~ -~. ~ ..... - 1 ~r~,~l, :,i:~i~,..,.., ...::i7 AN ORDINANCE AMENDING CHAPTER 12.04 "STREET OPENINGS, EXCAVATIONS AND PAVE- MENT CUTS OF THE VAIL MUNICIPAL CODE RELATING TO THE DEFINITION OF STREET; SECURITY FOR PERMITS; UTILITIES; PERMIT EXCLUSIVE FOR CONTRACTORS; OSHA REQUIRE A4ENTS; SPECIAL PERMITS; STREET RESTORATION; FEES; REVOCATION OF LICENSE; AND SIGNS; AND DETAILS RELATING THERETO. WHEREAS, the Town Council is of the opinion that certain amendments to the Town's Street Cut Ordinance are necessary; and WHEREAS, these amendments are necessary to protect the integrity of the public streets and ways, insure completion of restoration of the public streets and ways, and to strengthen the requirements relative to work in the public streets and ways: NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Sections 12.040.010(c); 12.04.050; 12.04.110; 12.04.230 (B)(1}; ].2.04.230{B){2); 12.04.250; 12.04.270; 12.04.290; 12.04.340{b); 12.04.350(A),(B), & (C); and 12.04.430{B) of Chapter 1.2.03 of the Vail Municipal Code are hereby repealed and reenacted to read as follows: 12.04.010 Definitions. (C) "Street" means and includes a public street, easement, right--of-way, highway, alley, way, place, road, ar bike path; and any nan--exclusive utility easement. 12.04.050 Permit-Application-Fee required. Each application for a permit shall be accompanied by a permit fee as determined by public works, as provided in Section 12.04.350. The permit fee and all ether charges or casts shall. be paid at the time the permit is issued unless a bond or other security is posted for the permit. The permit fee shall be charged, separate and apart from the bond and security and shall not be included in the bond or security amount. 12.04.1,10 Permit-Nontransferable. Permits under this chapter are not transferable, and the work shall net be made in any place other than the location specifically designated in the permit, or by any person, agent or independent contractor other than the permittee unless specifically provided in the permit. The permit shall be issued and held only by the excavating contractor making the street cut. All billing shall be sent to the excavating contractor. ~J . .d• • 12.04.230. Time wont may be performed. (B}(~.). Public works may issue a permit for a street opening ox pavement cut between November 15th and December 15th if it is determined that specia3. or unforeseen circumstances .require the issuance of the permit or if the applicant for the permit is a public utility. {B)(2). In no event shall a permit be issued after December 15th except in the case of an emergency or upon specific approval by a resolution of the Tawn Council. 12.04.250. Paved street restoration-Required. All pavement costs, openings and excavation shall be back- filled, surfaced and restored. Final surfacing shall be made within 30 days from the date the street cut is issued. Failure to complete surfacing within the 30 day period shall deem ~h~; street cut permit null and void. The bond or security will also become due at this tame. The Department of Public Works shall then take steps necessary to complete the unfinished work. The original permittee may also complete the work upon obtaining a new permit and bond. In the case of street cut permits issued after October 15th, the permittee shall. completely restore the paved surface by November 15th without exception. Failure to do so wall also result in the permit becoming null and void. The bond will become due on November 15th and the Department of Public Works shall take the necessary steps to complete the work. Back- filling under paved streets shall be in accordance withe the specifacataons in Sections 12.04.260 and 12,04.340. 12.04.270. Paved street restoration-construction methods. (A). The bottom twelve inches and the top eighteen inches of backfill shall be the same type of material specified in Section 12.04.260. The excavated maternal. may be used for the remainder of the backfill, provided that no materials greater than six inches in diameter shall be used for backfill. The material shall be deposit nn layers not exceeding twelve inches in thickness prior to compacting. Each layer shall, be compacted with suitable mechanical tamping equipment. Tt shall be compacted sufficiently to obtain a field density which is at least nanety- five percent of theoretical density as determined by A.A.S.H.O. Method T-147. The Department of Public Works may require density tests to verify compaction and the cast therefore shall be paid by the permittee. Compaction methods not authorized herein must be approved by the Department of Public Works prior to their use by the permittee. (B). All longitudinal cuts that are located 4' or more into the paved area and exceeding 15' in length shall be patched and the entire street overlaid wrath asphaltnc concrete a minimum of lz" thick. This requirement shall not be applicable to cuts for the installation of structures that extend 4' or more into the paved area, unless otherwise required by the Director of Public Works. 12.04.290. Unpaved street restoration-construction methods. The material shall be deposited in layers not exceeding eighteen inches in thickness prior to compacting. Each layer shall be compacted with suitable mechanical tamping equipment. It shall be compacted sufficiently to obtain a field density which is at least ninety percent of theoretical density as determined by A.A.S.H.O. Method T-99. Field density shall be determined by A.A.S.H.4. Mathod T-147. In no event shall ~vater ,jetting be allowed for compaction of backfill material. 12.04.340. Town restoration. Upon the request of the permittee and the agreement of the Town, the town may repair the street cuts and make backfills for the permittee, and permittee shall. pay to the Town the cost of restoration in any amount computed by public works in accordance with the rates set forth in Section 12.04.350. The permittee shall relinquish the right to restore street cuts and make backfills after the expiration of the permit {34 days after date of issue) ar until November 15th, if no extension for time has been granted the permittee by the Director of Public Works. ~ • • 12.04.350. Tees-Designated. (A} The basic permit fee shall be seventy-five dollars 1'or administration, inspection and issuance of the permit. (Il) Pavement cuts done by public works shall be five dollars per lineal foot per each two--inch depth or fraction thereof, with a minimum fee of twenty-five dollars. (C} Far replacement of paving with asphaltic concrete or oil--and-chips surface, the charge will be :Five dollars per square foot. (D) Utilities providing electric, telephone, gas, water, sewer or cable television service on a regular basis to the residents of the Town shall pay a permit fee of $50.00 per permit. The utility permit fee may be paid annually in advance in a sum equal to the number of permits obtained by the particular utility during the previous construction season times $50.00. If the utility obtains more permits than paid for, the utility shall pay to the Town the difference within ten (10) days of being billed therefor by the Town. Tf the utility does not use the number of permits paid for i.n the construction season, the Town will remit the difference within ten (1.0} days of a written request by the utility. T'or main line installations by a utility, the permit fee shall be $50.00 or .1% of the cost of construction of the main line (excluding above grade structures or installations) whichever is greater. 12.04.430. Violation-Penalty. The sanctions, remedies or penalties available under this chapter are deemed cumulative, and az~y or all may be pursued by the Town of Vail to enforce the provisions of this chapter. Any two violations in a building season (April 15-November 15} shall constitute grounds for automatic revocation of the contractor's license. Section 2. Chapter 12.04 of the Vail Municipal Cade is amended by the addition of the following sections: 12.04.070. Utilities exempt. (B) Each utility shall also submit a list of all subcontractors working for them to the Town. A blanket permit fee shall be paid by each utility by April 15th as provided in Section 12.04.350(D). 1.2.04.165. Signs. No signs or traffic control devices shall be removed without consent and approval. from the Department of Public ~Uorks and the Police Department. Ail signs and traffic control devices disturbed by the permittee shall be replaced to the satisfaction of the Public Works Director or his designated representative. The permittee sha11 be responsible for all replacement costs. 12.04.200. Safety devices. (B) The permittee shall abide by all Occupational Safety and Health Administration (OSHA) requirements. Section 3. Tf any part, section, sub--section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decisions shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it ~vould have passed this ordinance, and each part, section, sub-section, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, sub-sections, sentences, clauses, or phrases be declared invalid. -g_ '~ Section 4. • • The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section ~. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violatx_on that occurred prior to the effective date hereof, any prosecution commended, nor any other action or proceeding has commended under or by virtue of the provisions repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superceded unless expressly stated herein.
